Noticed for December 9, 2013.
Annually, the Council reviews proposed fees to be adopted as part of the City Code for the upcoming
year. City staff has outlined the adjustments to the fee schedule for 2014 in the attached draft.
Items to note include:
Parr and Trail: Park and Trail dedication requirements established in Section 21-7-18 of the Subdivision
Ordinance are reviewed annually to demonstrate that there is a nexus between the cash fee in lieu of
land accepted by the City for park and trail acquisition and development purposes is representative of
the costs incurred as required by Minnesota Statutes 462.358, Subd. 2c and case law from Dolan v.
Tigard. The City completed a detailed study in 2003 of park and trail development costs including land
acquisition, land preparation and construction, the relationship between housing density and park land
needs, community facility needs and fees for commercial and industrial development. Since that initial
2003 study., the City has annually adjusted the park and trail dedication fee paid in lieu of land
dedication to account for changes in land value or construction costs.
The calculation of the proposed park and trail dedication fee for 2014 is attached as an exhibit. The
current fee of $2,635.00 per dwelling unit can be increased to $3,348.00 per dwelling unit based on the
formula established with the 2003 study. The $713.00 increase is attributable primarily to a significant
increase in estimated market value of undeveloped property guided for low density residential uses to
which utilities are available. The 2013 fee was based on estimated land values of $10,000 per acre as
determined by the Wright County Assessor. The City has appraisals completed for the 70th Street
project that estimate the value of such land as $26,000 per acre, which the City may utilize in the
calculation of the park dedication fee for 2014. The proposed 2014 fee also incorporates the 3.35
percent increase in construction costs in accordance with the Engineering News Record index.
The City has maintained the cash fees in lieu of land for commercial and industrial subdivisions at the
levels set in 2003 balancing park and trail development needs with economic development goals. No
change to the commercial and industrial fee structure is recommended for 2014. The City Council may
also consider its broader development goals for the residential cash fee in lieu of land dedication
requirements. The potential increase of $713.00 per dwelling unit would be a 27 percent increase in the
park and trail dedication fee. The City is just now seeing development applications for preliminary and
final plats for single family development with the supply of available lots decreasing and increased
number of building permits the last three years. The City Council may elect to implement the increase in
park and trail dedication fees over a two year period to allow the housing market to continue to build
rn omentum a nd to establish more data regarding property value trends.

Sewer and Water Rate: The Sewer and Water Rate Study approved by the City Council on 28 January
2013 directed annual increases in the City's utility availability and connection fees of 1.0 percent for the
water system and 3.0 percent for the sewer system. The annual increases to the availability and
connection charges were determined to be necessary as part of the Sewer and Water Rate Study in
order to repay the existing debt for construction of the utilities and maintain the City's AA- bond
rating. The changes to the sewer and water availability and connection charges for 2014 are shown in
the tables below and are proposed as a total increase of $290 per Residential Equivalent Connection
(REC) unit or 2.5 percent. Prior to the Sewer and Water Rater study, the increases in utility availability
acrd connection charges was modified annually ba sed on the Construction Cost Index published by the
Engineering News Record, which would indicate an increase of 3.35 percent for 2014.
