RECOMMENDATION:
City staff recommends adoption of a resolution certifying conveyance of three tax forfeit outlots within
Crimson Ponds West to the City for public purposes.

BACKGROUND/JUSTIFICATION:
The City has received a list of properties within the City forfeited to the State of Minnesota for non-
payment of property taxes. The City has the ability under Minnesota Statutes 282.01 to request that
tax forfeit parcels been conveyed to the City for public use. City staff has reviewed the property list and
determined that three outlots within the Crimson Ponds west subdivision were to have been conveyed
to the City by the developer in accordance with the conditions of preliminary plat approval. The other
properties on the list would serve no public purpose and should be put up for public auction or auction
to the abutting property owners for private use. A resolution requesting conveyance of outlots A, B and
C, Crimson Ponds west is attached hereto for consideration.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
A RESOLUTION REQUESTING CONVEYANCE OF OUTLOTS A, B AND c,
CRIMSON PONDS FEST To THE CITY OF OTSEGO FORFIETED FOR NOW
PAYMENT OF PROPERTY TAXES.
WHEREAS, the city of Otsego received notice on 4 January 2014 from the
Wright county Auditor/Treasurer of parcels within the City forfeited to the State of
Minnesota for non-payment of property taxes; and,
WHEREAS, Minnesota Statutes 282.01, Subd. 1 a(a) allows the City sixty (60)
days from the date of notice to request that tax forfeited parcels be conveyed for public
purpose uses; and,
WHEREAS, city staff has reviewed the listing of tax forfeited parcels to make
recommendations as to potential public uses of said properties; and,
WHEREAS, Outlots A, B and C, crimson Ponds West listed as tax forfeited
properties were to have been conveyed to the city for park and stormwater utility
purposes under conditions of preliminary plat approval for crimson Ponds West as
approved by the city council on 23 May 2005; and,
WHEREAS, the other parcels identified in the listing of properties forfeited to the
State of Minnesota for non-payment of property taxes serve no potential public purpose
if conveyed to the city.
WHEREAS, the city council reviewed the list of tax forfeited properties and the
recommendations of city staff as to potential public purposes at their regular meeting
on 10 February 2014.
NOW, THEREFORE BE IT RESOLVED by the city council of the city of Otsego
that Otsego that
1. Outlots A, B and C, crimson Ponds West (1 1 8-228-00001 0, 118-228-000020
and 118-228-000030) are requested to be conveyed to the city of Otsego in
accordance with the development agreement for crimson Ponds West to be
used for park and/or stormwater utility purposes.
2. The City of Otsego approves of all other parcel forfeited to the State of
Minnesota for non-payment of property taxes to be offered at public auction or
auctioned to adjacent owners.
