Recommend approval of the attached resolution calling for a public hearing for the Duke Gateway North
Business Park 6, Lot 1 Block 1 project tax abatement as defined in the previously approved Development
Agreement for Gateway North Business Park dated September 11, 2006.

At the December 9, 20131 City Council meeting the Council discussed a proposed development in
Gateway North Business Park and Duke Realty Limited Partnership's request for the City's approval of
tax abatement as approved in the previously executed Development Agreement. The Council directed
staff to proceed with processing Duke's tax abatement request.
On February 3, 2014, the Planning Commission recommended to the Council approval of the Gateway
North Business Park 6, Lot 1 Block 1 final plat and site plan. The Council will act on the proposal on
February 10, 2014, prior to taking action on this tax abatement item.
The next step in the tax abatement process after approval of the final plat and site plan is approval of a
resolution calling fora public hearing. The resolution calls for the public hearing to be held on March
101 2014. The notice states that the abatement amount is $500,000; however, the actual amount will be
less. The total for all tax abatement projects, this one and the previously approved abatement, in
Gateway North is $500,000. The amount of this project will be determined before the public hearing.

RESOLUTION NO. 2014-11
RESOLUTION CALLING FOR A PUBLIC HEARING ON PROPOSED
PROPERTY TAX ABATEMENTS FOR THE GATEWAY NORTH PROJECT
BE IT RESOLVED by the City Council (the "Council") of the City of Otsego, Minnesota
(the "City"), as follows:
1. Recitals.
(a) Minnesota Statutes, Sections 469.1812 through 469.1816, as amended,
both inclusive, authorize the City, upon satisfaction of certain conditions, to grant an
abatement of all or a part of the taxes levied by the City on real property within its
boundaries.
(b) It is a legal requirement that the City hold a public hearing prior to
adoption of a resolution granting any property tax abatements.
2. Hearing. A public hearing on the consideration of the property tax abatement will
be held at the time and place set forth in the Notice of Hearing attached hereto as Exhibit A and
hereby made a part hereof.
3. Notice. The City Clerk is hereby authorized and directed to cause notice of said
hearing in substantially the form attached hereto as Exhibit A to be given one publication in a
newspaper of general circulation in the City at least 10 days but not more than 3 0 days before the
hearing. The newspaper must be one of general interest and readership in the City, and the
notice must be published at least once.

NOTICE OF PUBLIC HEARING
REGARDING PROPOSED PROPERTY TAX ABATEMENTS
FOR THE GATEWAY NORTH PROJECT
NOTICE IS HEREBY GIVEN that the City Council of the City of Otsego, Minnesota,
will hold a public hearing at a meeting of the Council beginning at 7:00 p.m., on Monday, March
10, 2014, to be held at the Otsego Prairie Center, 8899 Nashua Avenue NE, Otsego, Minnesota,
on the proposal that the City abate property taxes levied by the City on Parcel Identification Nos.
Lot 1 Block 1 Gateway North 6 in the City (the "Property") for an approximately 300,000 square
foot building (the "Improvements") to be constructed by the Dube Realty Limited Partnership
(the "Recipient"). The total amount of the taxes proposed to be abated by the City on the
Property for up to a ten year period is estimated to be not more than $500,000. The City Council
will consider granting a property tax abatement in response to the request.
Information about the proposed tax abatements and a copy of the draft Tax Abatement
Agreement for the Recipient are available for inspection at the office of the Director of the
Economic Development Authority at the City Hall during regular business hours.
Any person with residence in or the owner of taxable property in the City may file a
written complaint with the City if the City fails to comply with Minnesota Statutes, Sections
I 16J. 9 93 to 11 6J.995, and no action may be filed against the City for the failure to comply unless
a written complaint is filed.
All interested persons may appear at the March 10th public hearing and present their
views orally or in writing.
