05-24-21 City Council MinutesOTSEGO CITY COUNCIL MEETING MONDAY, MAY 24, 2021 7:00 PM OTSEGO PRAIRIE CENTER Call to Order. Mayor Stockamp called the meeting to order at 7:01 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Tina Goede, Jeff Dahl (*) and Brittany Moores. City Staff: City Administrator/Finance Director Adam Flaherty; Human Resources/Assistant City Administrator Sabrina Hille; Streets Operations Manager Kevin Lamson; City Attorney Dave Kendall; City Engineer Ron Wagner; City Planner Daniel Licht; City Engineer Ron Wagner; and City Clerk Audra Etzel (*). Absent Councilmember Tom Darkenwald. This meeting is preceding under MN State Statute 13D.021 allowing members to appear by telephone or video conference due to the ongoing health pandemic and state of emergency. Those indicated with a (*) attended via video conference. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7:02 PM. Special Presentation: Wright County Sheriff's Department - Sheriff Sean Deringer and Lieutenant Jason Kramber were present to review the 2020 Annual Report. Sheriff Deringer said with the development and growth, good things are going on in Otsego the Sheriffs Office looks forward to a continued public safety partnership. The 2022-2023 contracts have been sent to the City for approval; includes a 3% increase each year. Lieutenant Kramber before starting the report added the City is fortunate to have Sergeant Oltmanns and then reviewed the 2020 Annual Report for the City. Mayor Stockamp asked if ICAC is taking away from contracted hours? Lieutenant Kramber said no, this does not take away from the 48 contracted daily hours. Great partnership with the Feds to discover issues before they become problems. CM Goede has a question regarding the comparison and Otsego having higher sex crimes. Lieutenant Kramber said the partnership with ICAC is helping to lower this percentage. The Council thanked the Wright County Sheriff's Department. Mayor Stockamp closed the Open Forum at 7:18 PM 2. Planning: 4.1 Bury Companies, LLC: A. Presentation by City Planner Licht. B. Consider an Interim Use Permit Amendment. City Planner Licht presented the staff report. Mayor Stockamp asked if the applicant had any comments. The applicant stated they had no comments. CM Moores asked if semitrucks will have enough space to access the area? Planner Licht noted on the site plan the whole area is planned industrial park and the street that accesses the Bury site is 46' wide and turning into a driveway that is sufficiently wide; enough to accomodate semitrucks. Mayor Stockamp added she appreciated the applicant replanting the landscaping that did not survive the last growing season. Mayor Stockamp motioned to approve an interim use permit amendment for Bury Companies, LLC subject to the conditions as stated on the findings of fact and decision as presented, seconded by CM Goede. Voice Roll Call: Voted in favor; Goede, Stockamp, Moores, and Dahl. Motion carried 4-0. 4.2 Hunter Hills 2nd Addition: A. Presentation by City Planner Licht. B. Public Hearing. C Consider Resolution 2021-42 Vacating Drainage and Utility Easements. D. Consider Approval of Final Plat. E Consider Resolution 2021-43 Approving a Development Contract. City Planner Licht presented the staff report. Mayor Stockamp asked if any public comment were received. City Clerk Etzel stated no comments were received. Mayor Stockamp opened the public hearing at 7:30 PM. No one from the public spoke. Mayor Stockamp closed the public hearing at 7:31 PM. Page 2 of 6 Mayor Stockamp asked if the larger house option would have been allowed on other lots? Planner Licht said the house would have fit on several lots within the development. The issue was the corner setbacks required 20' to the side yard and it was just too narrow on that lot; there were several lots this house plan would fit. The developer did not anticipate putting the largest house pad on this lot. CM Goede motioned to adopt Resolution 2021-42 vacating existing drainage and utility easements, approve the final plat for Hunter Hills Second Addition subject to the conditions stated by the Findings of Fact and Decision as presented and adopt Resolution 2021-43 approving a Development Contract, seconded by CM Moores. Voice Roll Call: Voted in favor; Goede, Stockamp, Moores, and Dahl. Motion carried 4-0. 4.3 Zoning Ordinance Amendment — Secondary Dwellings in Detached Accessory Buildings: A. Presentation by City Planner Licht. B Consider Ordinance 2021-12 Amending the Zoning Ordinance. City Planner Licht presented the staff report. Mayor Stockamp thanked the Planner for preparing the map, this allowed a visual to see properties potentially being affected. Mayor Stockamp asked if other cities around Otsego have this in place? Planner Licht said none specific to secondary dwelling units, such as this. It would be a conversation the Planner and Building Official would discuss to what point is the applicant finishing the building and if not when; it become an implementation of an administration issue. CM Goede asked if secondary dwelling is limited to 1,200 square feet? Planner Licht said that is how the ordinance is written now. The proposed amendment would allow accessory building to exceed the square feet based on acreage; but the area dedicated to living space cannot exceed 1,200 square feet. Mayor Stockamp asked if an applicant could choose to build just a 1,200 square foot space dwelling? Planner Licht said yes, the applicant would still need to have the 240 square feet for the garage requirement. CM Moores asked the maximum sized allowed based on acreage? Planner Licht explained: 6,000 square feet for 10 acres or larger and 3,500 square feet for 5-10 acres. Mayor Stockamp said the current applicant is on 20 acres, so the 5-10 acres could be removed since there are not current requests? Planner Licht said yes, the 5-10 acres with 3,500 square feet could be removed. CM Moores asked, because it's one parcel with two dwellings how will the assessor tax this accessory building? Planner Licht said the assessor's office will look at the value of the building and the quality of its finishes and add that appraised value to the overall property. CM Dahl said looking at the example proposed, is the applicant waiting for a permit? Planner Licht said the applicant is waiting for a permit, as of right now the residential portion is not allowed. The applicant is going to build the building, they are waiting to find out if they can finish the 1,200 square feet residential portion. Mayor Stockamp asked about land rights and building entitlements within this development. Planner Licht said this subdivision was originally part of the Carron Addition, allowed 1 building unit per 10 acres. This property could have been further subdivided, by buying one of the development rights and divided into two 10 acre lots; with a conditional use permit and subdivision. Page 3 of 6 Mayor Stockamp asked what happens in the future. Planner Licht said a future home owner could use for any purpose related to their occupancy: guest house, office space, additional living, etc. Definition could be added that if it becomes a problem the City could fall back on. Due to limitations of size and the primary house and this space are closely connected, this limits issues. Mayor Stockamp asked how to handle for emergency calls. Planner Licht said the secondary dwelling is within a 100 -foot proximity of the primary residence and accessed off the same driveway. Police can respond to the primary residence. CM Moores understands the space can be rented and it's within 100 feet of the primary residence, is concerned there may be issues. Planner Licht said it is like renting a room in your house which is allowed in the ordinance, it will be in close proximity. CM Goede asked if the secondary dwelling is it required to have a bedroom, bathroom and/or kitchen? Planner Licht said these requests within the secondary dwelling triggered the request for the ordinance amendment. Allows for more options for how the accessory buildings can be used. Mayor Stockamp asked about the Al & A2 zoning districts that are already built, are they limited to the quantity of buildings and square footage? Planner Licht said those properties would be limited to two buildings with a max of 6,000 square feet total, depending on acreage. If buildings exist, one might need to go and/or meet the total square footage and the other performance standards. Mayor Stockamp further asked why cap residential space at 1,200 square feet? Planner Licht said it was a broad range of what if's scenarios: what if someone has a 6,000 square foot house and now, they are allowed a 6,000 square foot accessory building, so now you have two 6,000 square foot dwelling spaces on the property. Still all the same factors apply, limit the potential size and location of the building. It is a graduated scale for accessory buildings; on 5 acres 3,500 square feet is not that large of an accessory building. Mayor Stockamp asked why the 5 -acre parcels were included? Planner Licht said mainly to limit the potential number and it creates physical separation for any adjoining properties. There are some subdivisions are zoned A-1 Districts with one acre lots. The obvious place this could be expanded in the future would be rural cluster subdivision where someone has a large investment into their property with the surrounding open space. Here is the opportunity to build a separate detached building for a home office, studio space, etc. This is where the lot area could come down or look at a different zoning district, put it up and separate it from different adjacent properties for compatibility reasons and see that it works. CM Moores motioned to adopt Ordinance 2021-12 amending the Zoning Ordinance to provide for secondary dwelling unit within detached accessory buildings in certain zoning districts and approve publication in summary form, seconded by CM Goede. Council agreed with this new and unique request. The Planning Commission and City Council wanted to make sure allowing a secondary dwelling within a detached accessory building does not become an issue. Planner Licht said he has only dealt with one other time in Wayzata to allow guest houses. Voice Roll Call: Voted in favor; Goede, Stockamp, Moores, and Dahl. Motion carried 4-0. S. City Council Reports and Updates. 5.1 Commission Liaison Updates: Page 4 of 6 A. Heritage Preservation Commission - Liaison CM Moores said the group has been in contact with the media specialist at ISD 728 and the schools will have access to books through the City's website, archiving continues, and the June commission meeting will be in person. B. Parks and Recreation Commission - Liaison Mayor Stockamp said the last meeting cancelled due to lack of agenda items. C. Planning Commission - Liaison Mayor Stockamp said the council approved all the items from their recent meeting, the commission did a great job reviewing the applications. D. Public Safety Commission - Liaison CM Goede said Albertville Fire Chief Bullen attended the meeting. Chief Bullen has been busy with assisting other departments and responding to calls (50 calls for April). Their response time is 9 minutes and 22 seconds from station. In 2021 so far, nationwide, 124 officers have been killed in the line of duty. The commission wants to participate in the Prairie Festival. They have cancelled their June and July commission meetings. CM Dahl asked about Wold and the status of their report. City Administrator/Finance Director Adam Flaherty said Wold wasn't ready to present the status tonight, they will attend an upcoming meeting to update the Council. CM Dahl said Wold and the subcommittee group did visit 8 sites and all sites have provided good ideas. 6. Staff Reports and Updates. City Administrator/Finance Director Adam Flaherty reminded Council that City Hall will be closed next Monday in observance of Memorial Day. Human Resources/Assistant City Administrator Hille said thanks for having her and she is excited to continue on. Attorney Kendall is busy working on development contracts. Engineer Wagner provided updates on Water Tower #4 - the center crane is in and they are starting to work on the concrete pedestal which goes in by sections, so you will start to see above grade work occur. Bids for the trail project have been opened. The bids include the new trail that goes from Kittridge Crossings to CSAH 19 along with some of the older trails for repair. Good bids were received and they were similar to the engineer's estimate; within 1%. Engineer Wagner said they are researching the low bidders resume and will be brought for Council at the next meeting. Planner Licht said the next Planning Commission meeting is June 21St where they will review an application for the phase 3 of Hunter Hills consisting of 130 single family lots and also expecting an application for a commercial user on the commercial lot at Parkview Retail 2"d Streets Operations Manager Lamson said the Clean -Up Day event had a great turn out. There were 147 participants, including: 100+ TVs and 75 couches and mattresses. The pre -registration worked well and there were only a handful that showed up that had not registered. Staff will prepare a list of data from the collection. One suggestion was to host earlier in the year. The staff and vendors were done by 12:15 PM. The City Council thanked all that participated. Sergeant Oltmans said it is that time of year to remind residents to lock vehicles, garage doors, and houses; there is a group that take advantage of residents. These criminals are on foot in the middle of the night and take items not locked. There is an orange at risk notice card the sheriff's office may leave at a residence to warn them to lock up.
