BACKGROUND/JUSTIFICATION:
All improvements have now been completed including the final lift of pavement in Highlands of Riverpointe
2nd Addition. Erosion control is still in place in some areas as required by the NPDES Permit until vegetation
has been established but will be removed prior to final acceptance at the end of the warranty period. An
initial acceptance walk-thru was conducted with City Staff, the developer, and contractor November 18,
2020. As -built construction plans and all remaining items have now been successfully completed.
Staff recommends that all public improvements be initially as of the date of the initial acceptance walk-thru
date of November 18, 2020.

RESOLUTION NO: 2021-49
ACCEPTING PUBLIC IMPROVEMENTS FOR
HIGHLANDS OF RIVERPOINTE 2"D ADDITION
WHEREAS, the City Council approved the final plat of Highlands of Riverpointe 2nd Addition (the "plat"); and,
WHEREAS, the City and Developer entered into a Development Agreement April 23, 2018 for Highlands of
Riverpointe 2nd Addition and recorded as Document #: A1372400 with Wright County regarding approval of
the plat and installation of required public improvements within the plat; and,
WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and
gutter, sidewalk, grading and erosion control have been completed; and,
WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and
services, and storm sewer have been completed; and,
WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved
plans within the plat; and,
WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on
November 18, 2020 with City staff and the Developer, and all remaining items have been successfully
completed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
The City accepts all public improvements, otherthan streets, within the plat as of November 18, 2020
thus commencing the one (1) year warranty period from this date.
2. The City accepts all public street improvements within the plat as of November 18, 2020 thus
commencing the two (2) year warranty period from this date.
Upon conclusion of the respective warranty periods and completion of a final acceptance inspection
by City staff and satisfaction of any conditions of said final inspection, improvements lying within
public easements and public right-of-way shall be come City property without further notice or action
ADOPTED by the Otsego City Council this 28th day of June, 2021.
