AGENDA ITEM DETAILS RECOMMENDATION: City staff recommends the City Council approve a resolution accepting public improvements. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: All improvements have now been completed including the final lift of pavement. Erosion control is still in place until vegetation has been established and shall be removed at the end of the warranty period, prior to final acceptance. An initial acceptance walk-thru was conducted with City Staff, the developer, and contractor on October 1, 2020. All items have been completed and no items remain to be completed. Staff recommends that all public improvements be initially accepted as of the date of the initial acceptance walk-thru date of October 1, 2020. BUDGET INFORMATION FUNDING: BUDGETED: N/A N/A CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2021-51 ACCEPTING PUBLIC IMPROVEMENTS FOR ARBOR CREEK 3RD ADDITION — PHASE 6 WHEREAS, the City Council approved the final plat of Arbor Creek 3rd Addition — Phase 6 (the "plat"); and WHEREAS, the City and Developer entered into a Development Agreement February 7, 2018 for Arbor Creek 3rd Addition — Phase 6 and recorded with Wright County as Document No A1370405 regarding approval of the plat and installation of required public improvements within the plat; and WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and gutter, sidewalk, grading and erosion control have been completed; and WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and services, and storm sewer have been completed; and WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved plans within the plat; and WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on October 1, 2020 with City staff and the Developer, and all remaining items have been successfully completed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA: The City accepts all public improvements, other than streets, within the plat as of October 1, 2020 thus commencing the one (1) year warranty period from this date. The City accepts all public street improvements within the plat as of October 1, 2020 thus commencing the two (2) year warranty period from this date. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection by City staff and satisfaction of any conditions of said final inspection, improvements lying within public easements and public right-of-way shall be come City property without further notice or action.
