BACKGROUND
Tamarack Development — Martin Farms, LLC has submitted plans for development of Outlots C,
D, and E, Martin Farms located north of 70th Street (CSAH 38) and east of MacIver Avenue. The
47.35 acre subject site is to be subdivided into 97 single family lots, six outlots, and public
rights-of-way. The proposed development requires consideration of applications for a
preliminary plat, PUD -CUP, and vacation of existing drainage and utility easements. A public
hearing to consider these applications has been noticed for the Planning Commission meeting
on 21 July 2021.

ANALYSIS
Comprehensive Plan. The 2012 Comprehensive Plan guides the subject site for Medium -to -
High Density residential uses. The guided land use reflects the original plans for Martin Farms
that would develop the subject site with 185 row townhomes. The City allows for development

of single family lots within areas guided for Medium -to -High Density residential use as the
primary form of housing in Otsego. The City Council approved a study of multiple family
housing on 14 September 2020, which recommended the Future Land Use Plan be amended to
guide the subject site for Low -to -Medium Density Residential uses consistent with the character
of surrounding development. The proposed subdivision of the property with single family lots
is consistent with the 2012 Comprehensive Plan, as well as the 2020 Multiple Family Housing
Study.
Zoning. The subject site is zoned R-6, Residential Medium Density District. This zoning
designation was established in 2002 with the original approvals for Martin Farms to allow for
the planned development of 185 townhomes within the subject site. The proposed subdivision
includes only single family lots. Single family lots are a permitted use within the R-6 District.
The City is recommending that the Zoning Map be amended to rezone the subject site to R-5,
Single and Two Family District. This change reflects the character of development and removes
the allowance of townhouses from this property consistent with the Multiple Family Housing
Study Recommendations.
The developer is also requesting approval of a PUD -CUP with the preliminary plat. The
proposed PUD -CUP is to allow flexibility in lot area requirements provided the mean lot area
complies with minimum R-6 District standards. The PUD -CUP is also proposed to allow for
averaging of the wetland buffers required at the perimeter of protected wetlands.
Consideration of the Zoning Map amendment and PUD -CUP is to be based upon, but not
limited to, the criteria outlined in Section 20-3-2.F and Section 20-4-2.F of the Zoning
Ordinance:
1. The proposed action's consistency with the specific policies and provisions of the Otsego
Comprehensive Plan.
Comment: The 2012 Comprehensive Plan establishes policy to encourage housing styles
and development techniques that conserve land and increase efficiency provided that
guided densities are not exceeded. The flexibility in minimum lot area and the
averaging of wetland buffers requested under the Zoning Map amendment and PUD -
CUP follows the City's past practices for subdivisions within the sewer districts to provide
a variety of lot sizes and subdivision layouts related to the natural conditions of the
property being subdivided. The requested Zoning Map amendment and PUD -CUP is
consistent with policies of the 2012 Comprehensive Plan.
2. The proposed use's compatibility with present and future land uses of the area.
Comment: The subject site is an infill parcel surrounded by existing development shown
in the table below. The proposed single family lots shown on the preliminary plat are
similar in character to the established Martin Farms neighborhood to north and east.

3. The proposed use's conformity with all performance standards contained within the
Zoning Ordinance and other provisions of the City Code.
Comment: The proposed preliminary plat will comply with the requirements of the
Zoning Ordinance, Subdivision Ordinance, and Engineering Manual except as modified
by the PUD -CUP.
4. Traffic generation of the proposed use in relation to capabilities of streets serving the
property.
Comment: The proposed preliminary plat has accesses to 70th Street (CSAH 38) and
MaclverAvenue. The Transportation Plan designates 70th Street (CSAH 38) as a minor
arterial roadway providing connection between 1-94 and TH 101. MaclverAvenue is
designated as a major collector street by the Transportation Plan. Both 70th Street
(CSAH 38) and Maclver Avenue have been improved to standards with capacity to
accommodate traffic generated by development of abutting parcels, including the
proposed preliminary plat.
5. The proposed use can be accommodated by existing public services and facilities and
will not overburden the City's service capacity.
Comment: The proposed preliminary plat is an infill development surrounded by existing
subdivisions within the West Sewer District. The City has in-place utilities and services
necessary to serve the proposed development planned for as part of the Comprehensive
Plan. The proposed development will not overburden the City's service capacity.
EAW. A mandatory EAW was prepared with the Martin Farms preliminary plat in accordance
with Minnesota Rules Section 4410.4300, Sudp. 19.D for residential development of more than
250 dwelling units. The City Council approved the EAW and adopted findings that preparation
of an EIS is not required. The proposed preliminary plat has 97 single family lots, whereas the
original plan for Martin Farms anticipated development of the subject site with 185 townhouse
dwellings. The proposed preliminary plat is consistent with the information included in the
approved EAW and no additional environmental studies are required.
Blocks. Section 10-8-3.A of the Subdivision Ordinance establishes that blocks within a
subdivision are to be a minimum of 300 feet and not more than 1,200 feet in length. Blocks 1,
3, 4, 5, and 6 all exceed the maximum block length established by the Subdivision Ordinance.
The subdivision layout is determined by the limitations on access to 70th Street (CSAH 38) and
MacIver Avenue, the and the configuration of the Martin Farms plat along the north and east
plat lines. The proposed block lengths are acceptable under these circumstances.
Lot Requirements. Section 11-67-6.A.1 of the Zoning Ordinance requires single family lots
within the R-6 District to be a minimum of 9,000 square feet in area and 60 feet in width. The
developer is requesting approval of a PUD -CUP with preliminary plat to allow for lots 97 lots
with a minimum area of 8,424 square feet and a mean area of 10,694 square feet. All of the
lots are a minimum of 65 feet wide and those fronting on the cul-de-sac turnarounds are a
minimum of 75 feet wide as required by Section 10-8-5.C.1.c of the Subdivision Ordinance.
Setbacks. Section 11-67-6.13 of the Zoning Ordinance establishes the principal building setback
requirements of the R-6 District shown in the table below. The setbacks shown on the
preliminary plat comply with the requirements of the R-5 District.

Access. The proposed preliminary plat has accesses to 70th Street (CSAH 38) and MacIver
Avenue. The Transportation Plan designates 70th Street (CSAH 38) as a minor arterial roadway
providing connection between 1-94 and TH 101. MacIver Avenue is designated as a major
collector street by the Transportation Plan.
The location of the proposed intersections with 70th Street (CSAH 38) and MacIver Avenue
comply with the spacing requirements established by Section 11-8-5.13.4 of the Subdivision
Ordinance. As a minor arterial street, the proposed access to 70th Street (CSAH 38) may be
restricted to right-in/right-out or three-quarter access in the future. The preliminary plat
provides connections between the subject site and abutting Martin Farms subdivision to the
north and east via street intersections planned as part of the Martin Farms neighborhood to
disburse traffic from that neighborhood to 70th Street (CSAH 38) and MacIver Avenue.
The preliminary plat is subject to Wright County Highway Department review as it abuts CSAH
38. Wright County has indicated they will require dedication of additional right-of-way for
CSAH 38, as well as construction of right/left turn lanes on CSAH 38 at Marlowe Avenue. The
turn lanes may be incorporated as part of a planned Wright County pavement management
project for the approximately one-half mile section of CSAH38 between MacIver Avenue and
Martin Farms Avenue for which the developer would agree to reimburse Wright County.
Streets. The preliminary plat provides for public streets having a 60 foot right-of-way and 28
foot wide street section, as required by Section 10-8-5.B.1 of the Subdivision Ordinance. The
preliminary plat includes two cul-de-sacs that comply with the depth requirements and provide
a turnaround as specified by Section 10-8-5.C.2 of the Subdivision Ordinance.

There is a sidewalk on one side of the through public streets as required by Section 10-8-5.C.2
of the Subdivision Ordinance. There are existing trails abutting the subject site along 70th Street
(CSAH 38) and MacIver Avenue. The sidewalk along Street C between Street A and 70th Street
CSAH 38 should be converted to a trail to be maintained by the City. Likewise, the sidewalk on
Street A abutting Outlot C is also to be changed to a trail that transitions to a sidewalk abutting
Lot 1, Block 7. No additional trails are planned by the Parks System Master Plan.
Street lighting is to be provided at intersections, mid -block locations longer than 900 feet, and
cul-de-sac ends as required by Section 8-8-4.0 of the City Code.
All street design and construction plans are subject to review and approval of the City Engineer.
Streets.
Landscaping. Section 11-19-2.B.2 of the Zoning Ordinance requires that two shade trees be
provided each lot. The developer has submitted a landscape plan for the proposed preliminary
plat consistent with the landscaping installed in Martin Farms. The landscape plan includes 143
shade trees within the boulevards along the public streets and 97 additional yard trees shown
in the rear yards. The number of trees proposed exceeds the number required by the Zoning
Ordinance for the 97 single family lots. The landscape plan also includes buffer yard plantings
as required by Section 11-19-3.B of the Zoning Ordinance abutting 70th Street (CSAH 38) and
MacIver Avenue. Buffer yard landscaping shown in the outlots is to be removed from the
landscape plan as there will not be irrigation to ensure survivability of the plantings. The sizes
of proposed plantings comply with Section 11-19-2.B.3.b of the Zoning Ordinance.
Grading. The developer has submitted plans for grading of the subject site. The developer
completed a wetland delineation and submitted a wetland impact plan as shown on the grading
plan. Wetlands to be preserved are to be protected by a 20 foot buffer with the wetland and
wetland buffer platted within an outlot deeded to the City as required by Section 11-16-5.F of
the Zoning Ordinance. The wetland buffer is to be averaged within the preliminary plat under
the PUD -CUP, but not less than 10 feet in width. All grading, drainage, wetland buffers,
wetland impacts, and erosion control issues are subject to review and approval of the City
Engineer. The subject site is within the Otsego Creek watershed and payment of a stormwater
impact fee as established by Section 8-4-1 of the City Code is required at the time of final plat
approval.
Utilities. The subject site is within the West Sewer District and the developer has submitted
plans for extension of sewer and water utilities. All utility plans are subject to review and
approval of the City Engineer. The City is nearing capacity limits at the West Waste Water
Treatment Facility. While capacity currently exists to accommodate the 97 lots within the
preliminary plat, access to sewer capacity is only allocated to approved final plats with signed
development contracts to assure the City of timely development. Payment of utility availability
charges are due at the time of final plat approval and payment of utility connection charges are
due at the time a building permit is issued for each lot in accordance with Title 6, Section 1 of
the City Code.

Easements. Section 10-18-12.A of the Subdivision Ordinance requires 10 foot drainage and
utility easements at the perimeter of all lots (overlying side lot lines) and over any stormwater
management facilities, wetlands, and wetland buffers not platted within outlots deeded to the
City. The preliminary plat provides for dedication of required easements, which are to be
subject to review and approval of the City Engineer.
There is an existing drainage and utility easement established over Outlot D, Martin Farms of
the subject site, which overlays existing trunk utility pipes. This easement will no longer serve a
public purpose with the platting of the property and dedication of right-of-way over the utility
corridor between 70th Street (CSAH 38) and Mackenzie Avenue. The existing drainage and
utility easement is to be vacated concurrent with recording a final plat for the subject site.
Outlots. The proposed preliminary plat includes six outlots totaling 17.18 acres or 36.3 percent
of the subject site, which encompass wetlands and wetland buffers and storm water basins.
The outlots are to be deeded to the City at the time of final plat approval for long-term
ownership and maintenance as part of the City's stormwater system.
Park Dedication. The Park System Master Plan does not identify acquisition of land from the
subject site for City park purposes. The proposed preliminary plat is within the service area for
Zimmer Farm Park to the south and Prairieview Elementary School to the north. Park
dedication requirements established by Section 11-18-15 of the Subdivision Ordinance are to
be satisfied as a cash fee in lieu of land. The cash fee in lieu of land will be determined on a per
lot basis in accordance with the City fee schedule in effect at the time of final plat approval.
Development Contract. The City Attorney will prepare a Development Contract related to a
proposed final plat for any portion of the preliminary plat to provide for completion of all public
improvements, establishment of required securities, and payment of applicable fees in
accordance with Section 10-10-4.A of the Subdivision Ordinance. The Development Contract is
to be adopted by resolution of the City Council concurrent with the final plat approval and
executed prior to recording of the final plat.
Neighborhood Meeting. The developer hosted a neighborhood meeting on 8 July 2021 at
Prairie Center. Invitations were sent to property owners within 350 feet of the subject site
consistent with the notice sent for the public hearing. Approximately 20 people attended the
meeting for an opportunity to learn about the proposed development and ask questions of the
developer and City staff. Notes of the meeting prepared by the developer have been provided.
RECOMMENDATION
The proposed Northwater preliminary plat is consistent with the goals and policies of the
Comprehensive Plan and complies with the provisions of the Zoning Ordinance and Subdivision
Ordinance. Our office recommends approval of the applications subject to the stipulations
outlined below.

POSSIBLE ACTIONS
Decision 1— Zoning Map Amendment
A. Motion to recommend approval of a Zoning Map amendment rezoning Outlots C, D,
and E Martin Farms to R-5 District based on a finding that the request is consistent with
the Comprehensive Plan.
B. Motion to recommend the application be denied based on a finding that the request is
not consistent with the Comprehensive Plan.
C. Motion to table.
Decision 2 — Preliminary Plat/PUD-CUP and Easement Vacation
A. Motion to recommend approval of the Northwater preliminary plat, PUD -CUP, and
vacation of existing drainage and utility easements, subject to the following conditions:
1. Approval of the preliminary plat shall not guarantee access to sanitary sewer
service. The City shall only allocate sanitary sewer capacity to approved final
plats with signed development contracts to assure the City of timely
development.
Right-of-way dedication and construction of access for CSAH 38 shall be subject
to Wright County Highway Department review and approval.
3. All street design and construction plans shall be subject to review and approval
of the City Engineer.
4. Landscaping shall be installed in accordance with the approved landscape plan at
the time a certificate of occupancy is issued for each lot.
5. All grading, drainage, wetland buffers and impacts, and erosion control issues
shall be subject to review and approval of the City Engineer.
6. A stormwater impact fee for Otsego Creek as established by Section 8-4-1 of the
City Code shall be paid the time of final plat approval in accordance with the fee
schedule then in effect.
7. All utility plans shall be subject to review and approval of the City Engineer.
8. Utility availability charges shall be paid at the time of final plat approval in
accordance with the fee schedule then in effect.

9. All easements shall be subject to review and approval by the City Engineer.
10. Outlots A, B, C, D, E, and F as shown on the preliminary plat shall be deeded to
the City for stormwater management purposes.
11. Park dedication requirements for the preliminary plat will be satisfied as
payment of a cash fee in lieu of land.
12. Prior to recording of a final plat for any portion of the preliminary plat, the
developer shall enter to development contract with the City as drafted by the
City Attorney and subject to approval of the City Council in accordance with
Section 10-10-4.A of the Subdivision Ordinance.
B. Motion to recommend the application be denied based on a finding that the request is
does not comply with the Zoning Ordinance and Subdivision Ordinance.

Northwater Neighborhood Meeting

Tamarack Land Development hosted an open house for the Martin Farms neighborhood to present the
Northwater Development. Meeting started at 6 PM and ended at 7:15 PM

Notices were sent to 164 property owners, list provided by the City of Otsego.
The meeting was attended by 20 or so people, 14 people signed in, the sign in sheet is attached.
Dan Willenbring provided a brief overview of the development.
Citizens' concerns/comments:
• Traffic stop signs at the intersections of Mackenzie and Marlowe and Mackenzie and 72nd ST. NE
Response: Brent Larson explained the City's policy regarding installation of stop signs.
• Landscaping in the back yards of the Mackenzie homes
Dan Willenbring stated landscaping will be provided per the city requirements, all these properties
border the wetlands and proposed detention basins, and the closest homes will be 200-300 feet to the
south of the existing homes on Mackenzie.
• Concern over kids from the Northwater development using the Martin Farms' playgrounds
which is a HOA amenity, was Northwater going to have its own playground.
City staff responded that the City's Park Master Plan places the proposed development within the
service areas of Zimmer Farm Park and Prairieview Elementary School. The Parks Master Plan does not
designate acquisition of land from the proposed development and fees in lieu of land dedication will be
required. City staff also indicated that issues regarding access to the Martin Farms HOA facilities are to
be addressed by the HOA.
• Questions regarding the zoning changes.
City Planner described that the existing R6 District zoning is the same as applied to Martin Farms. The
City is recommending the Zoning Map be changed to downzone the property to R5 District, which would
no longer allow for the previously approved townhouse development t with the original plans for Martin
Farms.
• Question as to who will be the home builder whether the builder was going to have a
Homeowners Association (HOA)
Tamarack responded that we did not know but would ask D.R. Horton what their intent is.
• Question as to the roadway widths
City Engineer responded that the road width consistent with City Code and other developments,
including Martin Farms.
Concern about maintaining Martin Farms Monument sign, trees and white fence at 70th and
Maciver Ave.
Tamarack responded, intent is to leave the monument sign and trees and if fence is on/at city r/w line
then most likely would leave in place.
• Resident at 7193 Mackenzie is adjacent to storm inlet that needs an apron.
Tamarack will notify resident in advance of the work adjacent to her home.
Observation:
Neighbors seemed OK with the development, especially with regards to proposed single family dwellings
versus townhouses, with several expressing encouraging comments as we go through the approval
process.
