AGENDA ITEM DETAILS RECOMMENDATION: City Staff is recommending City Council approval of Pay Application #1 to Novco, Inc. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No No BACKGROUND/JUSTIFICATION: This payment application is being submitted for work completed through September 7, 2021 by Novco, Inc. (the Contractor). The Contractor has completed placement of trails on Page Avenue and approximately 1/3 of Odean Avenue. The Contractor has also started placement of ADA pedestrian ramps on Odean Avenue, Page Avenue, and 78th Street. No work has been completed on the 70th Street trail to date, but shop drawings for storm sewer were received and approved. In accordance with Minnesota Statute, the City is withholding the maximum 5% retainage of work completed, which amounts to $6,521.37 at this time. Due to the project not being substantially completed by the contract deadline, the City is also withholding $300 per day of liquidated damages.
