City staff is recommending the City Council adopt a resolution adopting an assessment for the 2021 Street
Renewal Project.

BACKGROUND/JUSTIFICATION:
The 2021 Capital Improvement Plan included the 2021 Street Renewal Project, which is a street
reconstruction project within the Heritage Hills subdivision. This project was to be financed in part with
special assessments to benefitting property owners, with the balance of the project costs financed with
funds from the Pavement Management fund.
The City hosted an open house on April 8th which provided a less formal opportunity for property owners to
ask questions and learn about the project. On April 12th, in accordance with State Statute §429 the City
conducted a hearing on the proposed improvement.
On June 14th, the City Council accepted the bids from the competitive bidding process and awarded the
construction contract to Omann Brothers Paving, Inc. The construction work initiated the week of August
2nd. The first lift of bituminous asphalt was installed the week of September 1st, and the project is expected
to be completed on time.
In accordance with State Statute §429, on August 9th, the City Council set a hearing on the proposed
assessment, with the purpose of the hearing to give property owners an opportunity to express concerns
with the proposed assessment. Property owners were provided mailed notice at least two weeks before
the hearing, and in addition, the City published notice at least two weeks in advance of the hearing in the
Star News.
During the assessment hearing on September 13th, the City Council shall hear and consider all objections to
the proposed assessment, whether presented orally or in writing.
City Attorney Kendall has reviewed the attached resolution adopting the assessment and has provided
recommendation for approval.

RESOLUTION NO: 2021-69
ADOPTING AN ASSESSMENT
WHEREAS, pursuant to proper notice given as required by law, the City Council has met and heard and passed
upon all objections to the proposed assessment for the 2021 Street Renewal Project, City Project No. 21-04,
which is a street reconstruction improvement within the Heritage Hills subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each tract
of land therein included is hereby found to be benefitted by the proposed improvement in the
amount of the special assessment levied against it.
2. Such assessment shall be payable in equal annual principal installments, extending over a period of
ten years, the first of the installments to be payable on or before the first Monday in January 2022,
and shall bear interest at the rate of 2.40% (percent) per annum from the date of the adoption of this
assessment resolution. To the first installment shall be added interest on the entire assessment from
the date of this resolution until December 31, 2021. To each subsequent installment, when due, shall
be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to
the Wright County Auditor, pay the whole of the assessment on such property, with interest accrued
to the date of payment, to the City, except that no interest shall be charged if the entire assessment
is paid within 30 days from the adoption of this resolution. An owner may at any time thereafter, pay
to the City the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 31 of the next succeeding year.
4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the Wright County
Auditor to be extended on the property tax lists of the County. Such assessments shall be collected
and paid over in the same manner as other City taxes.
