10-11-10 CCOTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL OCTOBER 11, 2010 7:00 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Dan Scharber, Tom Darkenwald and Doug Schroeder. Staff: Mike Robertson, City Administrator; Tami Loff, City Clerk; Gary Groen, Finance Director; Daniel Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney; Brad Belair, Public Works Supervisor and Mary Olson, Utility Billing. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. CM Heidner motioned to approve as written. Seconded by CM Schroeder. All in favor. Motion carried. 3. Consider the following minutes. 3.1. September 27, 2010 Special City Council Meeting. CM Heidner motioned to approve as written. Seconded by CM Scharber. CM Darkenwald said he will be voting on this but he was not in attendance for most of the meeting. All in favor. Motion carried. 3.2. September 27, 2010 City Council Meeting. CM Scharber motioned to approve as written. Seconded by CM Heidner. All in favor. Motion carried. 4. Open Forum: (5 minute limit) No items. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Approve Pay Estimate #1 for 2010 Street Maintenance Project in the amount of $132,721.79 to Pearson Brothers. CM Heidner motioned to approve. Seconded by CM Darkenwald. All in favor. Motion carried. 6. Unfinished Business. 6.1. Hospital Letter. City Planner Licht said this is information requested from New River Medical Center regarding their tax levy reduction. The board has a reduction plan to decrease the levy by 200,000 each year. No further action is required. 7. Public Hearing: 7.1. PUBLIC HEARING: Proposed assessment unpaid Utility Billing Accounts and Escrow Accounts. A. City Clerk attest to legal notice. City Council Meeting October 11, 2010. Page 2. City Clerk Loff attested that all proper noticing, publishing and posting was completed. We received one letter from resident Christine Cook requesting a payment plan and waive the $100 fine. B. Comments by City Staff. C. Presentation of proposed assessment roll. Finance Director Groen said there is $60,883.92 in utility bills still unpaid and $904.25 in unpaid development fees and charges. CM Darkenwald asked if the $100 per parcel is not included in these numbers. Finance Director Groen said yes. D. Public comments. Mayor Stockamp opened the Public Hearing at 7:06 PM. Anatoliy Mantsevich, 11365 79"' Street asking for the council to forgive the penalty and allow a payment plan. E. Close the public hearing. Mayor Stockamp closed the Public Hearing at 7:19 PM. F. Adopt Resolution 2010-37. Finance Director Groen said the $100 fee covers administrative costs. Mayor Stockamp noted the letter received from Christine Cook requesting a payment plan or time to pay the bill. Finance Director Groen said the assessment roll will not be sent to the county until middle of November. They have 45 days to pay. CM Heidner motioned to approve Resolution 2010-37. Seconded by CM Schroeder. CM Heidner motioned to retract Seconded by CM Schroeder. City Planner Licht said can change wording to add "minus the administrative fee" CM Heidner motioned to approve as amended. Seconded by CM Schroeder. CM Heidner motioned to retract removing the clause to original form. Seconded by CM Schroeder. CM Darkenwald motioned to approve Resolution 2010-37 including the amendment written by City Planner Licht. Seconded by CM Scharber. All in favor. Motion carried. 8. Public Works. 8.1. Approve Hiring of Seasonal Employees. Public Works Supervisor Belair said he would like to advertise for the winter/seasonal position. He is asking for approval to rehire Curt Otterness with a 50 cent raise. CM Scharber motioned to approve advertising for the winter/seasonal position. Seconded by CM Heidner. All in favor. Fire Inspection Code. City Planner Licht presented the Planning Report. CM Heidner motioned to adopt Ordinance 2010-08 amending the City Code of the City of Otsego to require fire inspections of commercial, industrial and institutional buildings. Seconded by CM Scharber. All in favor. Motion carried. 9.2. Darkenwald Landina. City Planner Licht presented the Planning Report. CM Heidner said he notice on drawing the Dog Beach area and does not feel that would be safe to have dogs or anyone going in the river there. Mayor Stockamp suggested signage of no swimming. City Planner Licht said he would City Council Meeting October 11, 2010. Page 3. include those comments as part of the Concept Plan. CM Heidner said he would like to delay this item out of respect to the Darkenwald family, which was the consensus of the City Council. City Planner Licht said he would advise the Parks and Recreation Commission. 10. Ron Wagner, City Engineer. 10.1. Review of I-94/CSAH 37 Project. City Engineer Wagner presented total estimated cost just under $50,000. Only 20% of the ramp is in Otsego. Mayor Stockamp asked about information from the bonding agent from Albertville. City Attorney MacArthur said Otsego's bond agent Mary Ippel, agreed that it is possible through joint powers and additional documentation. The City Council discussed that has Albertville rejected Otsego's offer to contribute to the project and consider the issue closed. The City Council also directed that City staff take no further action. 10.2 Other Engineering Business: City Engineer Wagner said that they did some soil boring in Otsego Creek by the Begin property and found there is a sand bottom. The City Engineer's office will be turning in permit to DNR to get it cleaned; City crews will be doing the work. City Administrator Robertson said he will contact Mr. Begin prior to work occurring within the easement on his property. 11. Andrew MacArthur, City Attorney. 11.1. Closed meeting re: property acquisition. City Attorney MacArthur announced that the meeting would be closed to discuss possible purchase of 8600 Odean Avenue. Mayor Stockamp closed the meeting at 8:21 PM. CM Darkenwald motioned to open the meeting at 8:39. Seconded by CM Scharber. All in favor. Motion carried. CM Scharber motioned to direct staff not proceed further and to send a letter to Chris Wilson once the Parks and Recreation Commission has been updated. Seconded by CM Darkenwald. All in favor. Finance Director Groen presented an invoice from the workman's comp audit which is due on the 20"'. CM Heidner motioned to approve invoice for $8,500. Seconded by Mayor Stockamp. All in favor. CM Heidner said during door knocking a resident on 85th Street said that the garbage trucks are up and down roads every day. The City should look at having the garbage trucks run only one day. CM Heidner also suggested numbering the street lights so when people call to report lights out, City staff knows which street light. CM Schroeder motioned to adjourn. Seconded by CM Darkenwald.
