City Staff recommends approval of Resolution 2014-20 Ordering a Public Improvement Hearing for
Jalger Avenue Street Improvement Project.

BACKGROUND/JUSTIFICATION:
A public hearing for the project was held last year on July 22, 2013 for the project and the council has
ordered preparation of plans and specs. According to MN Statute 429, a public hearing must be held
within 6 months prior to the start of the project; therefore we must hold a new public hearing to meet
the Statute requirements for assessed projects. We are requesting the approval of resolution ordering
the public hearing April 7th so that we can meet the requirements of advertisement and resident notice
period so a public hearing may be held on April 28tH. With that schedule the council may award the
project on May 26th for construction beginning in June and completion prior to August. 7 of 8 property
owners have signed the petition for the project and some have inquired as to how soon the project
might begin. If the Resolution is not approved on April 7tH, the public hearing would be held May 12tH
and construction will not begin until late June or early July with a completion deadline in mid-August.

RESOLUTION NO. 2014-20
A RESOLUTION ORDERING A PUBLIC HEARING FOR THE IMPROVEMENT
OF JALGER AVENUE AND 100TH STREET — NORTH OF 95TH STREET
WHEREAS, the City Council ordered the preparation of a feasibility study
for the improvement on the 13th day of May 2013; and
WHEREAS, such feasibility study was prepared by Hakanson Anderson
Associates, Inc. and presented to and accepted by the Council on the 24th day of
June 2013 and declares the improvement feasible, for an estimated cost of
$128,331;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OTSEGO, MINNESOTA:
1. Such improvement is necessary, cost—effective, and feasible as detailed in
the feasibility report.
2. A public hearing shall be held on such proposed improvement on the 28th
day of April, 2014 in the council chambers of the city hall at 7:00 p.m. and the clerk
shall give mailed and published notice of such hearing and improvement as
required by law.
4. The council will consider the making of such improvement in accordance
with the report and the assessment of benefiting property for all or a portion of the
cost of the improvement pursuant to Minnesota Statutes Chapter 429 with the
estimated total cost of the improvement being $128,331.
