09-13-21 City Council MinutesOTSEGO CITY COUNCIL MEETING MONDAY, SEPTEMBER 13, 2021 7:00 PM OTSEGO PRAIRIE CENTER Call to Order. Mayor Stockamp called the meeting to order at 7:01 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Tom Darkenwald, Tina Goede, Jeff Dahl, and Brittany Moores. City Staff: City Administrator/Finance Director Adam Flaherty, Human Resources/Assistant City Administrator Sabrina Hille, Parks and Recreation Director Ross Demant; City Attorney Dave Kendall; City Engineer Ron Wagner; City Planner Daniel Licht; and City Clerk Audra Etzel. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7:02 PM. Bruce Ness, 8254 O'Brian Avenue NE lives in Heritage Hills and would like to ask a question regarding the drainage from gutters with the new project. Engineer Wagner will contact Mr. Ness and the contractors to discuss the drainage further. Mayor Stockamp closed the Open Forum at 7:05 PM. 2. Consider Agenda Approval. CM Moores motioned to approve the agenda as written, seconded by CM Goede. Roll Call: Voted in favor; Darkenwald, Goede, Stockamp, Moores and Dahl. Voted against; none. Motion carried 5-0. 3. Consent Agenda. 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. August 23, 2021 Meeting, B. August 23, 2021 Special Meeting. C. August 30, 2021 Special Meeting, 3.3 Approve City Council Special Compensation for August 2021. 3.4 Accept Quotes for City Hall Janitorial Services and Approve Maintenance Agreement. 3.5 Approve Hiring for the Mechanic Position. 3.6 Approve Pay Application #16 for the East WWTF Biosolids Project. 3.7 Approve Pay Estimate #5 for the Water Tower #4 Project. 3.8 Approve Pay Application #1 for the 2021 Trail Improvement Project. Motion carried 5-0. 4. Public Hearing: 4.1 Assessment for 2021 Street Renewal Project — Heritage Hills. A. Presentation by Administrator/ Finance Director Flaherty. B. Public Hearing Page 1 of 3 C. Consider Resolution 2021-69 Adopting an Assessment Engineer Wagner reviewed the 2021 Street Improvement Project. There are three streets and 35 lots in the Heritage Hills Street Renewal Project. Prior to the project the original pavement is 24 years old (put in 1997) with 3.5" asphalt over 10" of Class 5. There were two seal coats applied in 2004 & 2010, the seal coat process was halted due to the deterioration of the streets. The streets were 34' wide with bituminous curb and storm sewer. The bituminous curb deteriorated beyond the point of repair; replacing with concrete. Engineer Wagner reviewed the scope of the improvements showing before and after photos. The project included reclaiming the pavement and mixed with the gravel below and added 3 1/2" of asphalt and repairing the storm sewer. Concrete curb was installed to allow for much better drainage. Installation of 3 1/2" and two lifts have been completed and to the point of restoration to bring the top soil to seed. Lastly the final lift of asphalt will be put on and the project will be almost completed with a few punch list items remaining. Staff has been working the home owners regarding access and the project is going well. City Administrator/Finance Director Flaherty explained the assessment policy. The estimated total project cost is $681,276 with the policy outlines 20% of total project cost will be assessed to each individual property up to a maximum of $1,000, which is the estimated assessment. The funding sources are the 35 properties, each at $1,000 for a total of $35,000 and the remaining funds come from the City's pavement management fund. The assessment roll lists out the 35 properties. Staff published in the Star News and noticed the property owners as required by State Statute. The assessment terms were reviewed, residents have a couple different options to pay in full up to November 15th without accruing interest or sent to Wright County on their property taxes amortized for 10 years with a 2.4% interest rate in accordance with the assessment policy; an estimated amortization schedule was presented showing annual payments. The project is on track and within the budget. Staff recommends the City Council approve a resolution adopting the assessment roll. Mayor Stockamp opened the Public Hearing at 7:12 PM. No one from the public spoke. Mayor Stockamp closed the Public Hearing at 7:13 PM. CM Dahl asked about the driveway entrances. Engineer Wagner said the driveways turned out nice, about 12 were replacing the apron and their entire driveway at the same time. CM Darkenwald said the total assessment costs under the old policy would have passed 50% of the expense to the benefiting property owners, that would have been about $9,732 cost under the old policy. The new policy is $1,000 per lot, this is a great reduction for the residents. CM Darkenwald asked how long this improvement should last? Engineer Wagner said about 30 years before a micro surface project, the new concrete curb should allow the road to last longer. CM Darkenwald motioned to adopt Resolution 2021-69 adopting an assessment roll as presented, seconded by CM Goede. Roll Call: Voted in favor; Darkenwald, Goede, Stockamp, Moores, and Dahl. Voted against; none. Motion carried 5-0 S. Planning: 5.1 Hunter Hills 3rd Addition: A. Presentation by City Planner Licht. B. Consider Approval of Final Plat. C. Consider Resolution 2021-70 Approving a Development Contract. City Planner Licht presented the staff report. Page 2 of 3 Dan Willenbring, 400 Tanglewood Lane, Marina on St. Croix, MN a partner with Tamarack Land Development was present to answer any questions. Mr. Willenbring said they have executed the Developer Agreement and provided securities for the project. Looking forward to starting this week and the final approval. CM Darkenwald asked what is the price point of the homes? Mr. Willenbring said he would need to ask Lennar, but he thought around $360,000-$420,000. CM Darkenwald asked about working with city staff. Mr. Willenbring said they have had a lot of projects and is concerned about the weather, hoping to start this week. Mayor Stockamp motioned to approve the Hunter Hills Third Addition final plat subject to the conditions state by the Findings of Fact and Decision and presented and adopt Resolution 2021-70 approving a Development Contract, seconded by CM Moores. Roll Call: Voted in favor; Darkenwald, Goede, Stockamp, Moores, and Dahl. Motion carried 5-0. 6. City Council Reports and Updates. None. 7. Staff Reports and Updates. City Clerk Etzel said the photo contest submission closed today; photos will be uploaded to the website to vote once a day thru October 13tH Engineer Wagner gave an update on the trail project: Odean was paved this past weekend, the rest of the pedestrian ramps will be poured this week and then opened to traffic, 70th Street will start this week. The contractor has lined up sub -contractors to help with the project. They need to move the hydrants on 70th Street back towards the right-of-way to make room for the trail and the storm sewer is being installed, then the trail can be built over. The completion is projected for the end of September, at that time staff can discuss the missed deadlines and action needed regarding the liquidated damages. CM Goede asked if Mr. Steiner has been contacted? Engineer Wagner will reach out to Mr. Steiner. City Attorney Kendall has sent a courtesy notice to the contractor advising them they are past the deadline and they are subject to liquidated damages, this does not mean the City Council has to impose, but putting the contractor on notice. Planner Licht said he attended the ISD 728 School Board meeting to give a development update, they were impressed with the growth within Otsego and look forward to keeping communication open. 7.
