BACKGROUND/J USTI FICATI ON:
The City Council accepted a Feasibility Report at their meeting on June 24, 2013 for improvement
of Jagler Avenue and 100th Street. The City Council also ordered the City Engineer to prepare
plans and specifications and has called for a public hearing for residents to be presented project
scope and possible assessment costs. However, City staff has obtained waivers for individual
assessments up to $14,259 from each of the ten owners of property proposed to be assessed as
part of the improvement project, which eliminates the need for an improvement hearing.
The City Engineer has prepared the plans and specifications for the project. The project includes
shaping and paving of Jagler Avenue and 100th Street. Due to significant encroachment issues
within existing ROW, we have had to modify the street to best provide access while still providing
room for maintenance. The estimated construction cost of the project is $108,538.50.
A conditional use permit will need to be initiated by the City after the contract for the project is
awarded to allow vacation of a portion of existing right-of-way for the east 100th Street cul-de-
sac. The vacation of the existing right-of-way as proposed will result in an existing lot of record
having less than the minimum 150 feet of frontage to a public right-of-way, although the lot will
maintain direct access to a public street. The $1,500 cost of processing the conditional use
permit and right-of-way vacation will be included as part of the overall project.
The lowest responsive bidder is Knife River of Sauk Rapids, MN with a bid of $121,343.50. This is
$12,805.00 higher (12%) than the engineers estimate. An additional lot has signed an
assessment waiver which increases the total amount waived for assessment to $142,590. Also,
due to the waiving of assessment appeal, some soft costs have been eliminated. One additional
cost saving measure can also be pursued. 400 CY of top soil borrow is proposed to be used to
finish the shoulder along the newly paved street. The City has approximately 3000+ CY of topsoil
in its old boneyard near the ball fields that will need to be moved for park expansion that may
occur someday. Rather than move this material to behind public works, some of this could be
offered to the contractor saving the cost of the top soil and possibly saving the contractor some
hauling distance. We anticipate this change to save the project up to $4000. The project costs,
with or without the negative change order, is projected to end up between the original estimate
of $128,331 and the current waived assessment amount of $142,590. Therefore we recommend
awarding the contract to Knife River of Sauk Rapids

RESOLUTION ACCEPTING BID
WHEREAS, pursuant to an advertisement for bids for the construction of City of
Otsego, Jalger Avenue and 100th Street Improvements, bids were received, opened and
tabulated according to law, and the following bids were received complying with the
advertisement:

AND WHEREAS, it appears that Knife River Corporation of Sauk Rapids,
Minnesota is the lowest responsible bidder,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO
MINNESOTA:
1. The mayor and clerk are hereby authorized and directed to enter into a
contract with Knife River Corporation of Sauk Rapids, Minnesota in the name of the City
of Otsego for the Jalger Avenue and 100th Street Improvements, according to the plans
and specifications therefore approved by the city council and on file in the office of the
City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all
bidders the bid bond made with their bids, except that the bid bond of the successful
bidder and the next lowest bidder shall be retained until a contract has been signed.
