No No BACKGROUND/JUSTI Fl CATION: Boondox Bar and Grille is proposing to have an outdoor music event in the outdoor patio area of the property on 26 July 2014 from 8:OOPM to 12:0013M. Details regarding the event are attached for reference and indicate the stage would be west of the building. The narrative indicates that the event is to be accommodated by existing staff and with parking on site and at the adjacent multiple tenant commercial property occupied by AmVet and a church. Documentation for permission to park and the adjacent commercial property must be submitted for City staff review. Boondox is not proposing to have Wright County Sheriffs Deputies on site for the event. Last year, the City did require two licensed deputies to be present and there were no issues. In accordance with the updated provisions of the City Code regarding special events, Boondox will be required to obtain a mailing list of properties within 350 feet of the subject site and provide notice of the event. CITY COUNCIL MEETING: 9 June 2014 FINDINGS: Based upon review of the application and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. Requests for special event permits are subject to the provisions of Chapter 7, Section 5 of the City Code. B. The event application dated 15 May 2014 submitted by Boondox Bar and Grille is incorporated herein. C. The Request for Council Action prepared by the City Planner, The Planning Company LLC, is incorporated herein. DECISION: Based on the foregoing information and applicable ordinances, the application is hereby APPROVED subject to the following conditions: 1. The outdoor music shall be allowed only on 26 July 2014 from 8:OOPM to 12:OOAM. 2. Any modifications to the submitted site plan for activities on and off site shall be subject to review and approval of City staff. 3. Event security, traffic control and emergency medical service shall be subject to review and approval of the Wright County Sheriff and City staff. 4. On -sale liquor shall comply with Chapter 7, Section 3 of the City Code and any violations thereof shall be enforced subject to Section 7-3-11 of the City Code. 5. The applicant shall provide a mailing list obtained from the Wright County Auditors Office of all properties within three hundred (350) feet of the subject site and provide for mailing of notice of the special event in accordance with the City Code. 6. The applicant shall provide documentation from the property owner of 15670 90th Street allowing off-street parking upon the premises for the event. 7. All event signs shall comply with Section 37 of the Zoning Ordinance including issuance of a sign permit.
