11-08-10 CCITEM 3-1 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL NOVEMBER 8, 2010 7:00 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Dan Scharber, Tom Darkenwald and Doug Schroeder. Staff: Mike Robertson, City Administrator, Tami Loff, City Clerk; Daniel Licht, City Planner; Ron Wagner, City Engineer; Andy MacArthur, City Attorney and Brad Belair, Public Works Supervisor. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. City Clerk Loff requested to add item 15.1. Resolution 2010-45 to canvass Election Results. CM Heidner motioned to approve as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes. 3.1. October 25, 2010 City Council Meeting. CM Darkenwald motioned to approve as written. Seconded by CM Scharber. All in favor. Motion carried. 4. Open Forum: (5 minute limit) 4.1. Certificates of appreciation to the Boy Scouts for their help with the Otsego Pumpkin Patch. Mayor Stockamp presented certificates of appreciation to the Boy Scouts. Pat Hilden, 7094 Odell Ave, Snowmobile Club President for River Riders, said there are 52 families registered so far. The Club meets monthly at Riverwood National Golf Course. They are asking the City Council's permission to use the Public Works Building again this year for youth training; they already have 36 Otsego youth signed up and have not advertised yet. The City Council agreed that it could be used. The club is looking at adding a new trail off Odean Avenue across from 75th Street to reduce some the calls in that area. CM Darkenwald said he heard good things about the Club while door knocking. Rose Cassady, Otsego Festival Chair, asked for permission to use the Public Works Building on November 19th to decorate the float for the Cambridge parade. CM Darkenwald asked Public Works Supervisor Belair if he sees any issues. Public Works Supervisor Belair said he sees no issue. Mayor Stockamp motioned to approve Rose Cassady use of the PW Building on November 19"'. Seconded by CM Heidner. All in favor. Motion carried. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Approve Final Pay Estimate to Pearson Bros for 2010 Street maintenance in the amount of $47,083.31 and Change Order #1. 5.3. Approve Letter of Credit Release for Ranch Acres (Phase 2). CM Heidner motioned to approve. Seconded by CM Darkenwald. All in favor. Motion carried. 6. Unfinished Business. City Council Meeting November 8, 2010. Page 2. No items. 7. Public Hearing: 7.1. PUBLIC HEARING: Establishment of a Special Service District. A. City Clerk attest to legal notice. City Clerk Loff attested that all the proper noticing, publishing and posting was completed. B. Comments by City Staff C. Presentation of proposed assessment roll. City Planner Licht presented the assessment. City Staff recommends the surcharge be increased to 50 percent to accumulate reserve funds for repair and replacement when needed. City Planner Licht said there are 1-2 streetlights a year that need to be replaced due to vehicle impacts or maintenance issues. D. Public comments. Mayor Stockamp opened the Public Hearing at 7:30 PM. Steve Smith, Otsego Mini Storage, said because they are in a Warehouse District, they didn't feel the extra lighting was needed. City Planner Licht said the Mini Storage fronts 85"' Street and all those properties are included in the district. CM Darkenwald said if the lights are not paid for thru this assessment then the General Tax Payers will have to pay. E. Close the public hearing. Mayor Stockamp closed the Public Hearing at 7:36 PM. F. Adopt Resolution 2010-43. CM Scharber motioned to approve Resolution 2010-43 re-establishing the Otsego above Standard Lighting Special Service District and approving special service charges for 2011. Seconded by CM Schroeder. All in favor. Motion carried. 8. Public Works. 8.1. Snow Plow Policy. Public Works Supervisor Belair reviewed the Snow Policy which has no major changes from last year. Mayor Stockamp asked for a copy of the map of the routes. Public Works Supervisor Belair said he will get one to the council. He also said it would be posted at City Hall and added to the website. Mayor Stockamp said also that a reminder should be added to the Otsego View regarding clearing of sidewalks and on planting in the roadway. CM Scharber motioned to adopt the Snow Plow Policy for 2011. Seconded by CM Schroeder. All in favor. Motion carried. 8.2. Hiring_of Seasonal Employees. Public Works Supervisor Belair is recommending Chris Abbas and John Demars for seasonal on call positions. CM Scharber motioned to approve. Seconded by CM Schroeder. All in favor. Motion carried. 9. Daniel Licht, City Planner. City Planner Licht said there will be a Planning Commission meeting next Monday November 15. CM Heidner said in Crimson Ponds there are road barricades, but there are three roads or so that does not have barricades and he noticed people have been driving off road. Also on the East side of MacIver Avenue. City Engineer Wagner said he will take a look. 10. Ron Wagner, City Engineer. 10.1. Consider Setting Workshop to Discuss MSA Balance and Potential Project Locations. City Council Meeting November 8, 2010. Page 3. City Engineer Wagner said the balance is going to be over 1 million on Jan 1'. Good time to review options. The City Council set December 9th, 2010 at 5:30 PM for a workshop. 11. Andrew MacArthur City Attorngy. 11.1. School Trail Agreement. City Attorney MacArthur reviewed the agreement with the School District for Otsego Elementary School. It splits the cost of construction and maintenance between Otsego and the School District. The city constructs and then sends the bills to the school. CM Heidner motioned to approve. Seconded by CM Scharber. All in favor. Motion carried. CM Scharber said at Se Street right by the park there is a big dip in the road. Do we have a warranty with Lennar? City Engineer Wagner said he will check on it. 12. Council Items. CM Darkenwald said the signal light on 101 North bound ramp to CSAH 42, was red for three or four minutes. City Engineer Wagner said he will check out. Mayor Stockamp said there are three lights out at 85th/42 and that we should add something to the Otsego View on calling City Hall for any street lights out. 13. Mike Robertson City Administrator. 13.1. Tax Information. City Administrator Robertson reviewed tax figures for surrounding cities noting that Otsego has the lowest city tax rate. CM Heidner said the tax capacity per capita we are low compared to some of these places. 14. Gary Groen Finance Director. No items. 15. Tami Loff. City Clerk. 15.1. Resolution 2010-45 to canvass results of the aeneral election. CM Darkenwald motioned to approve Resolution 2010-45. Seconded by CM Schroeder. All in favor. Motion carried. 16. Adjourn by 10 PM. CM Darkenwald asked City Engineer Wagner to find out about the $5.4 million state grant to Cty Rd 19 project. City Engineer Wagner said he will check it out. CM Scharber motioned to adjourn.
