RESOLUTION NO. 2014-44
RESOLUTION VACATING CERTAIN DRAINAGE AND UTILITY EASEMENTS
WITHIN
GATEWAY NORTH AND GATEWAY NORTH 2ND ADDITIONS
WHEREAS, the City Council of the City of Otsego, upon request of Duke Realty
Partnership, initiated a public hearing to consider vacation of easements within the Plats
of GATEWAY NORTH AND GATEWAY NORTH 2ND ADDITION; and
WHEREAS, the easements to be vacated shown on attached Exhibit A and are
legally described as:
All drainage and utility easements dedicated within Outlot F, GATEWAY
NORTH.
2. All drainage and utility easements dedicated within Outlot A, GATEWAY
NORTH 2ND ADDITION.
3. All drainage and utility easements dedicated within Outlot A, GATEWAY
NORTH 3RD
ADDITION.
WHEREAS, the City Engineer has determined that the above described drainage
and utility easements dedicated with GATEWAY NORTH and GATEWAY NORTH 2ND
ADDITION are no longer required upon approval and recording of GATEWAY NORTH
3rd ADDITION, which will dedicate all necessary drainage and utility easements to the
public.
WHEREAS, the City Engineer has determined that the above described drainage
and utility easements dedicated with GATEWAY NORTH 3RD ADDITION are no longer
required upon approval and recording of GATEWAY NORTH 4T" ADDITION, which will
dedicate all necessary drainage and utility easements to the public.
WHEREAS, Otsego Planning Commission held a public hearing at their regular
meeting on 16 June 2014 to consider the application, preceded by published and mailed
notice. Based upon review of the application and evidence received, the Otsego
Planning Commission closed the public hearing and recommended by a 6-0 vote that
the City Council approve the request.
NOW, THERFORE BE IT RESOLVED by the City Council of the City of Otsego,
Wright County, Minnesota that:
That the drainage and utility easements as set forth herein within GATEWAY
NORTH and GATEWAY NORTH 2ND ADDITION are no longer needed and are
hereby vacated, contingent upon recording of the Final Plat of GATEWAY
NORTH 3RD ADDITION.
2. That the drainage and utility easements as set forth herein within GATEWAY
NORTH 3RD ADDITION are no longer needed and are hereby vacated,
contingent upon recording of the Final Plat of GATEWAY NORTH 4T"
ADDITION,
3. That the City Council specifically finds that there is no damage to the affected
property resulting from the vacation and thus no damages are awarded.
MOTION TO APPROVE the Resolution was made by Council Member Heidner and
seconded by Council Member Schroeder,
