11-23-09 CCITEM 3-7 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL NOVEMBER 23, 2009 7:00 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 7 PM. Roll Call: Mayor Jessica Stockamp; Councilmembers: Vern Heidner, Dan Scharber and Tom Darkenwald. Staff: Mike Robertson, City Administrator; Tami Loff, City Clerk; Gary Groen, Finance Director; Andy MacArthur, City Attorney; Dan Licht, City Planner; Ron Wagner; City Engineer. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. City Clerk Loff requested to add item 14.1 Riverwood National Request. City Planner Licht requested to move item 9.2 to 12.5. CM Scharber requested to add item 10.2 WaterTower #1 Discussion. Mayor Stockamp requested to add item 13.4 Letter from Harold Leonard. CM Heidner motioned to approve as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes. 3.1. November 9, 2009 City Council Meeting. CM Heidner motioned to approve as written. Seconded by CM Darkenwald. All in favor. Motion carried. 4. Ogen Forum: (5 minute limit) No one spoke. S. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Zimmer Farms Wetland Escrow Release. 5.3. Otsego Auto Care Escrow Release. 5.4. Short-term & Long-term Disability and Group Life Insurance. CM Heidner motioned to approve. Seconded by CM Scharber. All in favor. Motion carried. 6. PUBLIC HEARING. 6.1. Establishment a Special Service District. City Planner Dan Licht presented the Planner's Report. Mayor Stockamp opened the Public Hearing at 7:06 PM. Todd Rick, Denny's owner, said the amount is going down which is great. Mr. Rick also said there are some street light bulbs out on Quaday Avenue. City Planner Licht said that Mr. Rick should feel free to contact city staff with location of street lights that are out. City Engineer Wagner said that a new light has been ordered for the light that was hit by Holiday Gas Station and scheduled to be delivered December W. Mayor Stockamp suggested sending out letters to business owners to let them know to contact city hall if street lights are out. City Planner Licht said that a note can be added to the bottom of the utility bills. City Council Meeting November 23, 2009. Page 2. Mayor Stockamp closed the Public Hearing at 7:08 PM. CM Scharber motioned to approve Resolution 2009-45 establishing utility charges for a Special Service District for Above Standard Street Lighting for 2010 with updated insert. Seconded by CM Heidner. All in favor. Motion carried. 7. Unfinished Business. 8. Public Works. 9. Dan Licht City Planner. 9.1. Park and Trail Dedication Fee. City Planner Licht presented the staff report. The Planning Commission held a Public Hearing to consider changes in park and trail dedication fees for 2010. City Planner Licht this is a reduction due to a decrease in land values. CM Heidner motioned to approve Ordinance 2009-15 amending the Subdivision Ordinance of the City of Otsego pertaining to Park and Trail Dedication. Seconded by CM Scharber. All in favor. Motion carried. 9.2. 2010 Fee Schedule -moved to item 12.5 9.3. PUD -CUP for Riverbend. CM Darkenwald removed himself and will abstain. City Planner Licht presented the Planner's Report. CM Heidner asked how far apart the buildings will be. City Planner Licht said one will be 2 feet from the property line and there are none on the other side because it is a pond. CM Heidner motioned to approve a PUD//CUP subject to the three conditions listed in the Planners Report dated November 17, 2009. Seconded by CM Scharber. Motion carried 3-0. CM Darkenwald abstained. 10. Ron Wagner City Engineer. 10.1. Ohland Ave/96th St Traffic Issue. City Engineer Wagner reviewed Ohland Ave and 96th St signage and speeding issues. He recommends an increase in Wright County Patrol, ticketing and the speed wagon. He also recommends the center line and fog lines be striped at an estimated cost of $2,650. CM Heidner asked if this would be done yet this year. City Engineer Wagner said most companies have already cleaned up their machines for the year. City Planner Licht said it was discussed at the staff meeting waiting until spring. CM Darkenwald motioned to approve according to the City Engineers memo to be paid out of Capital Improvement Fund. Seconded by Mayor Stockamp. All in favor. Motion carried. 10.2. Water Tower #1 discussion. CM Scharber asked about staff notes from November 19th stating Water Tower #1 removal. City Planner Licht said it should read removal of graffiti from Water Tower #1. CSAH 36 was paved with the first lift last week and they are putting up barriers and it should be open Wednesday of this week for traffic. 11. Andrew MacArthur City Attorney. City Council Meeting November 23, 2009. Page 3. 11.1. Proposal for I & C Services for Water & Wastewater Control Systems. City Attorney MacArthur reviewed contract. He said he only has a couple changes, delete item 5.6 and item 10. Simplify to say -all documents prepared or furnished by AE25 are the property of the client and after of that should be deleted. Kurt Neidermeier, PeopleService, looking for a different service provider. CM Darkenwald asked if there is any information on costs on those items and how many hours. Mr. Neidermeier said he can get cost for this. Mr. Neidermeier said they can add a recommend not to exceed time and material. Mayor Stockamp said she would like to see costs before approving. City Council said to get quotes and bring back to the next City Council meeting. CM Darkenwald asked if item 4 the last two words, upon request, can be deleted. City Attorney MacArthur said yes. 12. Council Items. 12.1. Parks and Rec Appointment. City Planner Licht presented. Mayor Stockamp commented that it was good for the commission to do the interviews and she thinks it worked out well. Mayor Stockamp motioned to appoint Kayla Block-Togerson as alternate to the Parks and Rec Commission. Seconded by CM Heidner. All in favor. Motion carried. 12.2. Scharber & Sons invoice. CM Darkenwald motioned to approve. Seconded by CM Heidner. Motion carried 3-0. CM Scharber abstained. 12.3. Approve Hiring Process for Otsego Building Official. City Administrator Robertson said that Loren Kohnen from Metro West has been on vacation and he has only been able to talk with his assistant. They are asking for 30% of the building permit and 30 day out clause. City Administrator Robertson suggested a per hour rate. City Administrator noted a memo from Building Official Harold Leonard with suggestion for temporary Building Official. CM Heidner said the City of Ramsey has a contract per hour rate and he is not in favor of giving percentage of the building permit fees. City Council agrees to work on a contract with Metro West at a per hour rate. CM Scharber suggested getting a draft of the contract to the City Attorney to review and then to City Council before the next meeting. CM Scharber said we need something in place before the end of the year. 12.4. Water & Sewer Utility Rates. Finance Director Groen is recommending a $2.00 sewer base increase and a $15 minimum monthly sewer bill. CM Scharber said thank you to the Utility Department for noticing the problem with snowbirds. The Council has always had the policy that users pay and all users were not paying. CM Scharber motioned to approve the memo from Gary Groen dated November 18, 2009. Seconded by Mayor Stockamp. All in favor. Motion carried. 12.5. 2010 Fee Schedule. City Planner Licht presented and this would include the sewer rate that was just approved. Mayor Stockamp motioned to approve Resolution 2009-16 establishing a fee schedule for City Services, Permits and Licenses for 2010 with addition of updated sewer rate. Seconded by CM Scharber. All in favor. Motion carried. 13. Mike Robertson, City Administrator. 13.1. Set Informational meeting for Council Candidates. City Council Meeting November 23, 2009. Page 4. CM Scharber said he doesn't feel it is needed. City Council will interview all applicants on Dec 7tn City Attorney MacArthur will write a memo on what the applicants can and cannot be asked. 13.2. Set Final Bud et Workshop. City Council set December 76, workshop schedule of 5:30 PM Aflac, 6 PM Budget and 7PM City Council Candidate Interviews. 13.3. Set Otsego Creek Meeting. Council said to set for February or March. 13.4. Letter from Bldg Official Harold Leonard. City Administrator Robertson reviewed Harold's request. City Council said to stick with the original date of December 30th. 14. Tam! Loff City Clerk. 14.1. Riverwood National Request. City Clerk Loff updated City Council on letter received from Chris Bulow. CM Scharber said staff should send a letter to let Mr. Bulow know they can hold class right at his facility. CM Darkenwald asked if we have done payment plans in the past. Finance Director Groen said no. Mayor Stockamp motioned to keep as is with no payment plan. Seconded by CM Darkenald. All in favor.
