RESOLUTION NO: 2022-01
ACCEPTING PUBLIC IMPROVEMENTS FOR
MARTIN FARMS 4T" ADDITION
WHEREAS, the City Council approved the final plat of Martin Farms 4th Addition (the "plat");and
WHEREAS, the City and Developer entered into a Development Agreement on March 6, 2017, for Martin
Farms 4th Addition and recorded with Wright County as Document No. A1341281 regarding approval of the
plat and installation of required public improvements within the plat; and
WHEREAS, all public street improvements, including bituminous base and wear course paving, curb and
gutter, sidewalk, grading and erosion control have been completed; and
WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and
services, and storm sewer have been completed; and
WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved
plans within the plat; and
WHEREAS, an initial acceptance inspection ofthe public improvements within the plat was conducted on July
24, 2020 with City staff and the Developer, and all remaining items have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
1. The City accepts all public improvements, other than streets, within the plat as of July, 24, 2020 thus
commencing the one (1) year warranty period from this date.
2. The City accepts all public street improvements within the plat as of July, 24, 2020 thus commencing
the two (2) year warranty period from this date.
3. Upon conclusion of the respective warranty periods and completion of a final acceptance inspection
by City staff and satisfaction of any conditions of said final inspection, improvements lying within
public easements and public right-of-way shall be come City property without further notice or action.
