RESOLUTION NO: 2022-08
ACCEPTING PUBLIC IMPROVEMENTS FOR
RIVERBEND NORTH
WHEREAS, the City Council approved the final plat of Riverbend North (the "plat");and
WHEREAS, the City and Developer entered into a DevelopmentAgreement onJanuary 28, 2019 for Riverbend
North and recorded with Wright County as Document No. A1389279 regarding approval of the plat and
installation of required public improvements within the plat; and
WHEREAS, all public utility improvements, including watermain and services, sanitary sewer main and
services, and storm sewer have been completed; and
WHEREAS, all public improvements were constructed in accordance with City standards, Code and approved
plans within the plat; and
WHEREAS, an initial acceptance inspection of the public improvements within the plat was conducted on
August 11, 2020 with City staff and the Developer, and all remaining items have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA:
1. The City accepts all public improvements, other than streets, within the plat as of August 11, 2020
thus commencing the one (1) year warranty period from this date.
2. Upon conclusion ofthe warranty period and completion of a final acceptance inspection by City staff
and satisfaction ofanyconditions ofsaid final inspection, improvements lyingwithin public easements
and public right-of-way shall be come City property without further notice or action.
