BACKGROUND/JUSTIFICATION: Endeavor Development has submitted an application for development of an industrial distribution warehouse on 80 acres located east of Queens Avenue and south of 65th Street. The proposed development consists of one lot with a 401,544-square foot principal building. The submitted plans indicate potential for future expansion of the building by 343,200-square feet for a total building area of 744,744-square feet. The proposed development requires consideration of an Environmental Assessment Work Sheet, Zoning Map amendment, site and building plan review, and preliminary and final plat. A public hearing to consider the applications was held by the Planning Commission at their meeting on 7 March 2022. Ms. Maren Lampham of Endeavor Development was present as the applicant along with the project’s civil engineer Erik Hedman of Anderson Engineering. Minutes of the Planning Commission meeting are attached for reference. The public hearing was closed. The Planning Commission voted 7-0 to recommend City Council approval of the applications. The City Council at their meeting on 14 March 2022 adopted findings regarding the EAW that the development does not have potential for significant environmental effects. If the City Council approves the Zoning Map amendment, preliminary plat, and site and buildings plans as recommended by City staff and the Planning Commission, consideration of the final plat will occur at a future meeting. Zoning.  The subject site is zoned A‐1, Agriculture Rural Service District in accordance with the  Interim Land Use policies of the Comprehensive Plan.  The proposed development of the  warehouse distribution facility requires consideration of a Zoning Map amendment to rezone  the subject site to I‐1, Limited Industrial District.  The proposed Zoning Map amendment is to  be evaluated based upon (but not limited to) the criteria established by Section 11‐3‐2.F of the  Zoning Ordinance:  1. The proposed action's consistency with the specific policies and provisions of the Otsego  Comprehensive Plan.    Comment:  The 2012 Otsego Comprehensive Plan guides the subject site for future  industrial land uses within the East Sewer District in the form of large‐scale industrial  buildings to accommodate manufacturing, assembly, warehouse, and office uses.   Industrial development is a goal of the Comprehensive Plan so as to diversify the tax  base and lessen dependance on residential properties as well as to create employment  opportunities within Otsego and the proposed development advances the City’s efforts.    2. The proposed use's compatibility with present and future land uses of the area.     Comment:  The table below summarizes existing and planned land uses in the area  surrounding the subject site:    Direction Land Use Plan Zoning Map Existing Use West Industrial I‐2 District Gateway North Industrial Park     The proposed development is characteristic of the existing industrial uses developed to  the west within the Gateway North Industrial Park.  Additional development of this type  is planned to the north.  The primary compatibility concern with the proposed use is with  the Harvest Run neighborhood to the south, which must be addressed through site  design, landscaping, and screening.       3. The proposed use's conformity with all performance standards contained within the  Zoning Ordinance and other provisions of the City Code.    Comment:  The proposed development will comply with all requirements of the Zoning  Ordinance, Subdivision Ordinance, and Engineering Manual.      3 4. Traffic generation of the proposed use in relation to capabilities of streets serving the  property.     Comment:  The subject site will access to Queens Avenue, which the Transportation Plan  of the 2012 Otsego Comprehensive Plan designates as a Commercial/Industrial Collector  and is improved with two traffic lanes and a center turn lane.  The streets serving the  subject site have adequate capacity to accommodate the traffic generated by the  proposed development.     5. The proposed use can be accommodated by existing public services and facilities and  will not overburden the City's service capacity.     Comment:  The subject site is located within the East Sewer District established by the  2012 Otsego Comprehensive Plan.  Sewer and water utilities are available at the subject  site with sufficient capacity to accommodate the proposed use.  The City has the ability  to provide all other required municipal services to the subject site within the East Sewer  District.     EAW.  The developer, at the direction of the City as the Responsible Government Unit,  prepared an EAW in accordance with Minnesota Rule 4410.4300, Subp. 14 to evaluate the  potential environmental effects of the proposed development.  The EAW document was posted  to the City website on 4 January 2022, noticed in the City’s official newspaper on 8 January  2022, and published by the Environmental Quality Board (EQB) on 11 January 2022.  The EAW  was also distributed for review and comment to stakeholders and agencies identified by the  EQB.   The mandatory 30‐day comment period for the EAW ended on 10 February 2022.   Comments were received from the Minnesota Pollution Control Agency (MPCA), Minnesota  Department of Natural Resources (DNR), and State Historic Preservation Office (SHPO).   The  City Council adopted findings of fact at their meeting on 14 March 2022 that the proposed  development does not have potential for significant environmental effects and that and  Environmental Impact Statement is not to be required.    Lot Area.  Section 11‐85‐7.A of the Zoning Ordinance requires lots within the I‐1 District to have  a minimum area of 1.0 acre.  The area of the property as shown on the preliminary plat is 78.5‐ acres.  The preliminary plat must be revised to indicate the area of Lot 1, Block 1 less the right‐ of‐way dedication for 65th Street.   The area of the proposed lot will comply with the  requirements of the Zoning Ordinance even after dedication of right‐of‐way.     Lot Width.  Section 11‐85‐7.B of the Zoning Ordinance requires lots within the I‐1 District to  have a minimum width of 200‐feet at the front setback line.   The proposed lot measures 1,200‐ feet at the setback line from Queens Avenue, which is the front lot line as defined by the Zoning  Ordinance.  The width of the proposed lot complies with the requirements of the Zoning  Ordinance.      4 Site Coverage.   Section 11‐85‐8 of the Zoning Ordinance establishes a maximum building  coverage limit of 50‐percent and maximum impervious surface coverage limit of 85‐percent for  lots within the I‐1 District.  The proposed Phase 1 building covers 11.7‐percent of the lot area,  which complies with the requirements of the Zoning Ordinance.  Total area and percentage of  lot area for all impervious surfaces must be identified.      Setbacks.  The table below outlines the setbacks applicable to the proposed building as shown  on the site plan.  The proposed building complies with the setback requirements of the I‐1  District established by Section 11‐85‐7.C of the Zoning Ordinance.        Queens  Ave.  65th   St. Building Materials. Principal buildings within the I‐1 District are to utilize exterior finishes that  comply with the requirements Section 11‐17‐4.E.1 of the Zoning Ordinance.  The submitted  building elevations for the proposed building indicate that the building is constructed with  exposed aggregate precast concrete panels with.  Changes in color, large glass area at the entry  and horizontal banding add detailing to the public.  The proposed exterior materials of the  principal building comply with the requirements of the Zoning Ordinance.    Building Height. The submitted plans indicate that proposed building, which has a flat roof, has  a height of 44 feet to the top of the precast panel wall.  Section 11‐85‐9 of the Zoning  Ordinance allows principal buildings within the I‐1 District to have a maximum height of 48‐feet  measured to roof line of a flat roof.  The proposed building complies with the allowed building  height within the I‐1 District.    Landscaping and Screening.  The submitted plans include a landscape plan to provide for  plantings along Queens Avenue and 65th Street and along the south property line abutting the  Harvest Run neighborhood.       The plantings along the south property line are upon a berm that is nine to 17 feet above the  floor elevation of the building and 15 to 25 feet above the rear line of the semi‐tractor parking  stalls.  The proposed trees provided for screening along the berm are Northern Pin Oak and  Common Hackberry.  City staff recommends that the proposed plantings be revised to  incorporate evergreen trees as a majority of the trees in the screening row.   We also  recommend that a 14‐foot screening wall be constructed along the south line of the semi‐ tractor/trailer parking stalls, which is the same condition required for R+L Carriers to the north.    The sizes of the proposed plantings included on the landscape plan comply with Section 20‐19‐ 2.B.3 of the Zoning Ordinance.      5 Section 5‐2‐3.B.4.b of the City Code requires an irrigation system be provided for maintenance  of the plantings, which is indicated to be installed on the landscape plan details.    Right‐of‐Way.  The subject site abuts Queens Avenue on the east and 65th Street to the north.   Queens Avenue is an improved Industrial/Commercial Major Collector Street in accordance  with the Transportation Plan of the 2012 Comprehensive Plan.  No right‐of‐way dedication or  improvement of Queens Avenue is required with the preliminary and final plat.  The  Transportation Plan also designates 65th Street as an Industrial/Commercial Major Collector  Street, but it exists as a rural section gravel roadway within prescriptive easement.  The  preliminary and final plat provide for dedication of 50‐feet of right‐of‐way for the south half of  the roadway.  No improvements to 65th are planned with the proposed development.  All right‐ of‐way dedication is to be subject to review and approval of the City Engineer.    Access.  The Phase 1 building is proposed to be accessed via two driveways to Queens Avenue.   The location of the proposed driveways are aligned with existing driveways on the west side of  Queens Avenue to minimize conflicts from turning vehicles.  The south access is 110‐feet north  of 62nd Street, which is a local residential street.  The north access is 110‐feet south of the 65th  Street, which is a future Industrial/Commercial Collector Street.  The location of the driveways  complies with Section 11‐21‐6 of the Zoning Ordinance.    Off‐Street Parking.  Section 11‐21‐8 of the Zoning Ordinance requires 1 parking stall per 200  square feet of office and 1 parking stall per 1,000‐square feet of warehouse net floor area.  The  office portion of the building is 4,000‐square feet and the warehouse 397,544‐square feet.  The  number of required off‐street parking stalls is 376.  The site plan provides 126 passenger  parking stalls, plus 52 semi‐tractor/trailer parking stalls.   The ratio of proposed off‐street  parking is consistent with requirements imposed for similar large footprint distribution  warehouses in Otsego.      Parking stalls are shown to be 9‐feet wide by 18‐feet deep (with available two‐foot overhang)  accessed by 24‐foot wide drive aisles.  The dimensions of the off‐street parking stalls comply  with the provisions of Section 11‐21‐7.A and B of the Zoning Ordinance.     The off‐street drive aisles and parking areas are to be surfaced with asphalt and surrounded by  perimeter concrete curb as required by Section 11‐21‐7.C.3 and D of the Zoning Ordinance.  The  construction of the off‐street parking area is subject to review and approval of the City  Engineer.    The off‐street parking stalls, drive aisles, and loading areas are all setback more than 15‐feet  from public rights of way and more than five‐feet from the side lines as required by Section 11‐ 21‐5.B of the Zoning Ordinance.    Pedestrian Access. There is an existing trail on the east side of Queen Avenue abutting the  subject site.  A five‐foot wide concrete sidewalk should be added to the side of each of the  driveway accesses to Queens Avenue to provide for pedestrian access to the proposed building.  6 Exterior Lighting.  No information is included in the submitted plans regarding exterior lighting.   Section 11‐16‐6 of the Zoning Ordinance establishes performance standards for exterior  lighting.  All exterior light fixtures are to have a 90‐degree horizontal cut‐off and not cast more  than 0.4 foot‐candles of light at the property lines as required by Section 11‐16‐6.C of the  Zoning Ordinance.  An exterior lighting plan including photometric measurements of light  intensity and indicating the type, location, and height of all exterior light fixtures must be  submitted and is subject to review and approval of the Zoning Administrator.      Signs.  Information regarding proposed signs is indicated only generally on the submitted plans.   Section 11‐37‐5.C of the Zoning Ordinance allows one freestanding sign with an area not to  exceed 100‐square feet or height of 20‐feet and wall signs not exceeding 100‐square feet up to  15‐percent of the area of the walls facing public streets.  Installation of any signs upon the  subject site will require issuance of a sign permit subject to review and approval of the Zoning  Administrator in accordance with Section 11‐37‐7.A of the Zoning Ordinance.      Waste Storage. The site and building plans do not indicate either an exterior or interior area for  trash and recycling container storage.  Section 11‐18‐4.C of the Zoning Ordinance requires that  any outdoor storage of waste and recycling containers is to be enclosed within a solid wall with  minimum height of six feet constructed of materials complementary of the principal building.  If  any waste containers are to be stored outdoors, plans for the construction of the required  enclosure must be submitted to verify compliance the performance standards of the Zoning  Ordinance at the time of application for a building permit.  Any exterior enclosure for waste  storage is subject to review and approval of the Zoning Administrator.     Utilities.  There are existing sewer and water utilities available to the subject site within Queens  Avenue.  The developer has submitted plans for connection of the proposed development to  sewer and water services for the proposed use.  The connection to sewer will require  installation of a temporary lift station until gravity sewer is extended to the subject site from  the east.  All utility plans are subject to review and approval of the City Engineer.  The  developer will be required to pay Utility Availability Charges with final plat approval and Utility  Connection Charges at the time a building permit is issued.     Grading.  The developer has submitted plans for grading of the subject site, including  information required regarding stormwater management and erosion control.  The proposed  development impacts wetlands within the subject site that are subject to review by a Technical  Evaluation Panel of agency staff.  All grading, drainage, wetland impacts, and erosion control  issues are subject to review and approval by the City Engineer.    Easements.  Section 11‐8‐12.A of the Subdivision Ordinance requires 10 foot wide drainage and  utility easements to be dedicated at the perimeter of Lot 1, Block 1, which are shown on the  final plat.  Additional drainage and utility easements are to be dedicated over portions of Lot 1,  Block 1 for wetlands, wetland buffers, public utilities, or stormwater management facilities  related to the site plan.  All drainage and utility easements are to be subject to review and  approval of the City Engineer.  7 Park Dedication.   The Parks System Master Plan does not identify acquisition of land from the  subject site for park purposes.  The City does not require payment of a cash fee in lieu of land  for park dedication for industrial uses in order to facilitate the economic development goals of  the 2012 Comprehensive Plan.    Development Contact.  A development contract is required with final plat approval by Section  10‐10‐4.A of the Subdivision Ordinance to provide for completion of public improvements,  establishment of required securities, and payment of applicable fees related to the subdivision  of the subject site.  Section 11‐9‐7 of the Zoning Ordinance also requires that the developer  enter into a performance agreement with the City to provide for construction of the project  improvements within the subject site.  The development contract and performance agreement  requirements will be combined with into a single document to be executed by the developer  prior to approval by resolution of the City Council and recorded with the property.         RECOMMENDATION    The proposed development is consistent with the 2012 Comprehensive Plan with regards to  land use and economic development. The proposed development further complies with the  requirements of the Zoning Ordinance and Subdivision Ordinance.  City staff recommends  approval of the applications subject to the conditions outlined below.      POSSIBLE ACTIONS    A. Motion to approve a Zoning Map amendment rezoning the subject site to I‐1 District;  and approval of a preliminary/final plat and site and building plans for Phase 1, subject  to the following conditions:     1. Approval of the preliminary plat shall not guarantee access to sanitary sewer  service.  The City shall only allocate sanitary sewer capacity to approved final plats  with signed development contracts to assure the City of timely development.    2. The landscape plan shall be revised to incorporate 8‐foot coniferous trees as a  majority of the trees in the screening row along the south property line, subject  to review and approval of the Zoning Administrator.    3. A 14‐foot screening wall shall be constructed along the south line of the semi‐ tractor/trailer parking stalls, subject to review and approval of the Zoning  Administrator.     4. The preliminary plat shall be revised to state the area of Lot 1, Block 1 less right‐ of‐way dedication.    8  5. Impervious surfaces within the lot shall not exceed 85 percent of the lot area.     6. Right‐of‐way dedication for 65th Street shall be subject to review by the City  Engineer.    7.  The design and construction of the off‐street parking area shall be subject to  review and approval of the City Engineer.     8. A five‐foot wide concrete sidewalk shall be constructed to the side of each of the  driveway accesses to Queens Avenue, subject to review and approval of the City  Engineer.     9. A plan detailing the type, location, and height of all proposed exterior lighting  shall be submitted and is to comply with Section 11‐16‐6 of the Zoning  Ordinance, subject to review and approval of the Zoning Administrator.     10. All signs shall comply with Chapter 37 of the Zoning Ordinance and require a sign  permit approved by the Zoning Administrator prior to installation.     11. Any outdoor storage of waste and recycling containers shall comply with Section  11‐18‐4.C of the Zoning Ordinance, subject to review and approval of the Zoning  Administrator.     12. All utility plans shall be subject to review and approval of the City Engineer.      13. The developer shall pay Utility Availability Charges as provided for by the City  Code upon approval of the final plat.    14. The developer shall pay Utility Connection Charges in accordance with the City  Code at the time a building permit is issued.    15. All drainage and utility easements shall be subject to review and approval of the  City Engineer.    16. The developer shall execute development contract as drafted by the City  Attorney, subject to approval of the City Council.     B. Motion to recommend the application be denied based on a finding that the request is We recommend providing a separate pipe for to direct this water and bypass Pond 2 and separate the clean water from the parking/driveway area water and avoid the need for the larger pipe and pond size required to treat the already clean water. The drainage from wetland 4 shall be routed to bypass Pond 1 to avoid the need to treat clean water. 16. Wetland 3 drains to the north. An emergency overflow (EOF) shall be labeled for this wetland. The inlet pipe from the south into this wetland shall also be removed as it is not necessary. 17. The setback and right-of-way lines shall be labeled. 18. The plans propose to direct these drainages to a “beehive” storm sewer casting. It shall be verified that this will be sufficient to handle the existing drainage. Also, an EOF for this low are near the new casting will need to be identified as well as an overland overflow route. 30. A note to “see sheet C-18” shall be included next to both outlet control structures. The detail provides some information that is missing on sheet C-7. WATERMAIN PLAN AND PROFILE 31. All easement lines shall be shown. The easement label “10’ D&U Easement (TYP)” is shall be revised to 20’ wide. 32. Existing utilities along Queens Avenue and 65th Street shall be labeled (pipe sizes, types, inverts, etc). 33. Make the valve symbols larger in the plan view or provide a larger drawing scale. 34. Length of the watermain pipe shall be in the profiles. 35. The hydrants within the loading dock areas shall be protected with bollards. 36. All 12” valves shall be butterfly valves. 37. The two 45 degree bends at each corner of the building are labeled 135 degrees. 38. The storm crossing at station 8+00 is missing from the profile. 39. The watermain at the NE and SE corners of the building depict a pipe being stubbed to the east out of two 45 degree bends. We believe this should be done with a 12” x 12” tee in both locations for future expansion. Existing utilities along Queens Avenue and 65th Street shall be labeled (pipe sizes, types, inverts, etc). 41. This site is proposed to flow via gravity to a future lift station to the north of 65th Street and west of CSAH 42. Until this lift station is construction and gravity sewer is extended to service this property a small, privately owned and operated, lift station is proposed to discharge to the existing gravity sewer along Queens Avenue. For a future gravity connection, a 6” gravity sanitary sewer stub is being provided to the north out of the lift station. This stub ends at an elevation of 904.71 and this elevation still needs to be verified how it will fit with future gravity sewer per the Master Plan. 42. The storm sewer and watermain crossings shall be shown in the forcemain profile. 43. The 24” storm crossing at station 0+75 in the gravity sanitary profile is mislabeled 16”. 44. The forcemain appears to require a new sanitary sewer manhole be installed in Queens Avenue. This will not be allowed. The forcemain shall be directed to the existing manhole approximately 25’ south of the show new manhole. PAVEMENT PLAN 45. Soil borings or Geotechnical Reports have not been provided at this time. We recommend that the pavement section be based on a Geotechnical Engineers recommendation. 46. Based on the soils encountered while constructing Queens Avenue we recommend using a clean sand under the Class 5 aggregate for drainage. EROSION AND SEDIMENT CONTROL & SWPPP 47. Two rows of silt fence are required along the wetlands adjacent to the retaining walls. DETAILS 48. A detail of the lift station is required. 49. The top of the inlet pipes for both ponds shall be a minimum 12” below the NWL elevation to provide the required skimming. It appears that the filtration areas may need to be lowered or outlet pipes reconfigured to meet the requirements. 50. The pipe lengths, grades, and inverts shall be included in the details. Julie Winkelme, 6224 Quenroe Ave NE, is concerned about the change in zoning from Agricultural to Industrial, lighting and noise impacts, and loss of wildlife habitat. Matt Weaver, 16544 62nd Street NE, is concerned about wildlife and drainage. Mr. Weaver says his house value will be going down. Mr. Weaver is also concerned that there will be a lot more traffic due to the increase of cars, trucks and employees driving to and from the site. Mr. Weaver explained all of the rooms in his house face the property and the lights will be shinning right in his house. Nicki Mera*, 16850 62nd Street NE, added her concerns about traffic speed on Queens and potential stormwater drainage issues caused by the development. Steve Mera*, 16850 62nd Street NE, asked if the truck parking could be moved to the east side of the building to minimize noise, especially in winter. Chair Offerman closed the Public Hearing at 7:33 PM. City Planner Licht said that property value changes are not a criteria for zoning and subdivision applications. City Planner Licht explained exterior lighting performance standards and City staff recommendations regarding fencing and landscaping. City Planner Licht said that the truck parking is on the south side of the building due to the cross-dock operation and planned future expansion of the building to the east. City Planner Licht said that all urban development within the City will impact the wildlife but this entire area is within the East Sewer District. City Engineer Wagner explained how and why the wetlands are being impacted. Minutes of the Otsego Planning Commission March 7, 2022 Page 3 City Engineer Wagner addressed the concerns for traffic noting the design capacity of Queens Avenue is for up to 15,000 vehicles per day. City Engineer Wagner said that speed limits are an enforcement issue that the WSCO can be directed to. Eric Headman the Civil Engineer for the project explained the wetland mitigation and stormwater management requirements. Chair Offerman clarified that the lots adjacent to the proposed development are higher or lower than the proposed building depending on the location along the property line. Commissioner Foster asked City Planner Licht when Harvest Run and Harvest Run East were approved. City Planner Licht said the preliminary plat was approved in December 2017. Commissioner Foster also asked if all residents who spoke are located on the property line. City Planner said yes. Commissioner Foster asked what is being developed to the south east. City Planner explained that there is a current application for Fields of Riverpoint for additional residential development. Chair Offerman asked the developer what the hours of operation would be. Ms. Lapham said standard business hours. City Planner Licht explained there is not a restriction for hours of operation. Commissioner Foster asked the developer how the proposed building area compares with buildings they have constructed in other cities. Ms. Lapham said this building will be much larger than the typical buildings they are developing in other cities. Ms. Lapham also addressed the trailer parking and said there will be loading docks on both sides. Commissioner Stritesky asked about the maintenance of the trees and landscape. City Planner Licht explained the installation of the landscaping is guaranteed by the required performance agreement and that it’s the property owner’s responsibility to maintain. Chair Offerman commented the berm is not requirement of the Zoning Ordinance, but appreciates it being proposed by the developer to increase screening. Commissioner Foster asked if anyone else was interested in developing the site. City Planner Licht said no one has contacted City staff. Chair Offerman asked about the wetland impacts. City Engineer Wagner explained the proposed wetland impacts in more detail. City Planner Licht explained that the landscaping includes both evergreen and shade trees to include higher, faster growing species. City Planner Licht explained that there is an existing trail on Queens Avenue, a sidewalk between the building and a trail is recommended, and that the pedestrian access would not interfere with school bus stop to the south on 62nd Street. Commissioner Jones asked about the requirements for the lighting on/above the dock doors. City Planner Licht explained that the light fixtures must have a 90-degree horizontal shield.
