Daniel Licht, AICP REPORT DATE: 28 April 2022 RE: Otsego — Utilities; W-WTF Capacity Expansion TPC FILE: 101.01 BACKGROUND The existing West Wastewater Treatment Facility (W-WTF), located at 7551 Lancaster Avenue east of Labeaux Avenue and south of 771h Street, has been in service since 2005 and is nearing its original rated capacity. In accordance with the 2018 City of Otsego Wastewater Master Plan, a project to expand the treatment capacity from 600,000 gallons per day to 1,750,000 gallons per day is proposed. This is an increase of 6,572 Residential Equivalent Connections (RECs). In addition to capacity expansion, it is the City's desire to reduce odors, traffic, and noise from facility operations experienced by the adjacent residential neighborhood and City park. This is being done through the design of a new treatment process and associated indoor waste solids loading facility, as well as relocation of an administration building and long-term site access. The design for the project includes an upgraded preliminary treatment building, a new fine screening building, upgraded secondary biological treatment process, membrane biological treatment, UV disinfection, and low energy cascade aeration of water before discharge to Otsego Creek. By utilizing membrane treatment, the discharge water quality will further improve. The waste solids storage tank, which had generated odors in the past was removed from operation in 2020 and is no longer needed for storage services with this upgrade. The waste solids loading will be enclosed within a building and additional odor control implemented to mitigate odors from loading operations. The proposed improvements require consideration of a Conditional Use Permit amendment to allow for the facility expansion. A public hearing to consider the CUP amendment has been noticed for the Planning Commission meeting on 2 May 2022 at 7:OOPM. The subject site is zoned INS, Institutional District, which allows wastewater treatment facilities as a conditional use as provided for by Section 11-90-6.N of the Zoning Ordinance. An amendment of the existing CUP is required for the proposed expansion and improvements for the W-WTF project. Lot Requirements. Section 11-90-7.A.8 of the Zoning Ordinance specifies that lots developed with WWTFs must have a minimum area of 15 acres. Lot 1, Block 1, Sunray Farms 3rd Addition upon which the W-WTF is developed has an area of 19.52 acres. The existing lot exceeds the requirements of the Zoning Ordinance. Setbacks. Section 11-90-6.N.2 of the Zoning Ordinance requires a minimum 75 foot setback from property lines for WWTF structures. The proposed W-WTF Administration Building is setback 80 feet from the south lot line and the Sludge Treatment Building is the closest structure at the northeast corner of the property approximately 90 feet from the lot line. The proposed buildings within the W-WTF comply with the setback requirement stated by the Zoning Ordinance. Building Exterior. Section 11-17-4.D.2 of the Zoning Ordinance requires principal buildings within the INS District have an exterior comprised of 65 percent materials defined as Grade A or precast concrete panels with a textures or formed surface. The exterior of the proposed W- WTF buildings consists primarily of precast concrete panels. There are translucent panels and glass windows used for the Administration Building. The proposed exterior finish for the proposed W-WTF buildings comply with the requirements of the Zoning Ordinance. Building Height. Section 11-90-8 of the Zoning Ordinance limits the height of principal buildings and accessory structures to 40 feet. The tallest roof of the proposed of the administration building is 28 feet, the Fine Screen Building is 31 feet from the lowest grade to I the roofline, the Blower Building is 14 feet in height, and the Membrane Treatment Building is 28 feet in height from its lowest grade to the roofline. All of the proposed buildings comply with the height limit established by the Zoning Ordinance. Landscaping. A landscape plan has been prepared for enhancement of the landscaping surrounding the W-WTF. Four trees are to be removed north of the existing facility and a cluster of 12 trees will be removed west of the existing facility to allow for the proposed improvements. Proposed landscaping includes installation of a significant number of white spruce and river birch trees to the northwest, north, and east of the MTB building. Shade trees are also to be added south of the proposed administration building. The majority of the area will be planted with native grasses and forbs consistent with green initiatives at City facilities and to minimize maintenance needs. The types of proposed plantings are appropriate for the subject site and the sizes of the plantings comply with the requirements of Section 11-19-2.B.3 of the Zoning Ordinance. Access. The W-WTF is currently accessed from 77th Street, which is local residential street, via a shared driveway with Beaudry Meadows Park. To avoid conflicts with residential traffic and park users, the site plan has been developed to anticipate accessing the W-WTF from the west via 73rd Street. The change in access will also accommodate the long-term needs of the facility to utilize larger volume trucks for the removal of biosolids for transport to the East Waste Water Treatment Facility (E-WTF). The change in access is contingent upon the City being able to reach an agreement with the property owner of the parcel between the W-WTF lot and 73rd Street to acquire the necessary easement or development of that parcel that would include dedication of right-of-way and construction of a street by the developer that would be required to access at the south line of the W-WTF lot. The existing access to the W-WTF via 77th Street would be adequate in the interim until the west access is obtained. Off -Street Parking. The proposed W-WTF Administration Building includes two interior bays one of which is designed for loading of biosolids. The other bay is large enough to accommodate a semi -tractor trailer with four light-duty vehicle parking stalls to the side for storage of Utility Department vehicles. Six off-street parking stalls are located to the east of the proposed Administration Building for Utility Department staff and there are 10 stalls west of the building intended for public use when the access to 73rd Street is obtained. The proposed stalls are designed to comply with the dimensions required by Section 11-21-7.B of the Zoning Ordinance and include one disability van accessible stall. The proposed interior and exterior off-street parking stalls are adequate for the W-WTF. Exterior Lighting. Any exterior lighting to be installed at the W-WTF is subject to Section 11-16- 6 of the Zoning Ordinance. Lighting must be downcast with a horizontal shield and the intensity of lighting cast to property lines cannot exceed 0.4 foot candles. The plans for the W-WTF include new LED fixtures with 90 degree horizontal shields and the illumination field is within the limits established by the Zoning Ordinance. 91 Signs. Section 11-37-5.13 of the Zoning Ordinance establishes sign allowances for uses within the INS District. No plans are indicated on the submitted plans and can be reviewed at a later date subject to review and approval of the Zoning Administrator. Grading. A grading, drainage, and erosion control plan has been developed for the W-WTF improvements. All stormwater management issues are to be subject to review and approval of the City Engineer. Utilities. The proposed W-WTF Administration Building will be connected to City sewer and water utilities. All utility issues are subject to review by the Utilities Department and Building Official. Criteria. The proposed conditional use permit amendment is to be evaluated based upon (but not limited to) the criteria outlined in Section 11-4-2.F of the Zoning Ordinance: The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Comment: The Comprehensive Plan establishes that expansion of wastewater utilities is to be phased to accommodate service demands for development to ensure the financial stability of utility operations. The City has adopted the Wastewater Master Plan to coordinate and phase expansion of WTFs to provided needed capacity and improve operational efficiency. The W-WTF improvement project is included within the Wastewater Master Plan and is proposed for implementation based on established trigger events. 2. The proposed use's compatibility with present and future land uses of the area. Comment: The subject site is surrounded by existing low density residential land uses. The required setback from property lines for the W-WTF buildings and proposed landscaping will create separation and a buffer from surrounding residential dwellings. The construction of the proposed W-WTF improvements will also reduce odor generating operations improving compatibility of the facility with the surrounding area. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Comment: The proposed W-WTF improvement project complies with the appliable requirements of the Zoning Ordinance and Engineering Manual. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. In Comment: The subject site is currently accessed from 71 th Street, but the W-WTF improvement project is based upon long term acquisition of access to 73rd Street. Interim use of 77th Street is adequate for the facility until the frequency and type of vehicles required for operations necessitates the change in access to 73rd Street. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Comment: The proposed W-WTF improvement project is necessary to provide utility capacity for forecast development, increase efficiency in operations for the City's wastewater treatment system, and improve compatibility with surrounding residential uses. Neighborhood Meeting. City staff hosted a neighborhood meeting 22 March 2022 to provide information and answer questions regarding the W-WTF improvement project. Notice of the meeting was sent to property owners within 350 feet of the W-WTF lot consistent with a public hearing notice. The meeting was attended by one property owner from SunRay Farms whose lot is located south of the Administration Building and a member of the family that owns the rural parcel between the W-W-WTF lot and 73rd Street. RECOMMENDATION Completion of the W-WTF improvement project will allow the City to continue to meet the wastewater treatment needs as planned residential and business growth continues. The upgraded facility will also provide the ability to meet current and future regulatory requirements, make operations more efficient, and improve land use compatibility. City staff recommends approval of the CUP amendment subject to the conditions outlined below. POSSIBLE ACTIONS A. Motion to recommend approval of a Conditional Use Permit amendment for the W-WTF improvement project, subject to the following conditions: All signs shall be subject to review and approval of the Zoning Administrator. 2. All drainage and utility easements shall be subject to review and approval of the City Engineer. 3. All stormwater management issues shall be subject to review and approval of the City Engineer. 4. All utility issues shall be subject to review by the Utilities Department and Building Official. 5 B. Motion to recommend the application be denied based on a finding that the request is inconsistent with the Comprehensive Plan and requirements of the Zoning Ordinance. C. Motion to table.
