05-23-22 City Council MinutesOTSEGO CITY COUNCIL MEETING MONDAY, MAY 23, 2022 7:00 PM OTSEGO PRAIRIE CENTER Call to Order. Acting Mayor Tom Darkenwald called the meeting to order at 7:00 PM. Roll Call: Acting Mayor Tom Darkenwald; Councilmembers: Jeff Dahl, Tina Goede, and Brittany Moores. Absent: Mayor Jessica Stockamp City Staff: City Administrator/Finance Director Adam Flaherty, Human Resources/Assistant City Administrator Sabrina Hille, City Attorney Dave Kendall; City Engineer Ron Wagner; City Planner Daniel Licht; and Deputy City Clerk Bethany Benting. Pledge of Allegiance: Acting Mayor Darkenwald led in the Pledge of Allegiance. 1. Open Forum: Kyle Kingsley from Vireo Health (formerly MN Medical Solutions, LLC) provided an update on their business and presented a $40,000 check to City of Otsego. The City Council thanked Mr. Kingsley for their continued partnership. City Administrator/Finance Director Flaherty told the City Council that the City has been experiencing internet problems all afternoon. At 7:07 PM the internet went down. City Attorney Kendall said the Council may move forward with the meeting, as broadcasting online was not a requirement. The Council continued the regular meeting and did not open the open forum until the end of the meeting in hopes the internet might come back on to give the residents a chance to speak. Acting Mayor Darkenwald opened the open forum at 7:37 PM. No comments made by the public. Acting Mayor Darkenwald closed the open forum at 7:38 PM. 2. Consider Agenda Approval. CM Moores motioned to approve the agenda as written, seconded by CM Dahl. All in favor. Motion carried 4-0. 3. Consent Agenda. 3.1 Approve Claims List. 3.2 Approve City Council Meeting Minutes. A. May 9, 2022 Meeting. B. May 9, 2022 Special Meeting. 3.3 Approve Hiring for Seasonal Parks Maintenance Position. 3.4 Approve Hiring for Seasonal Streets Maintenance Position. 3.5 Accept Quotes and Authorize the 2022 Crack Filling Project to Asphalt Concrete Solutions, Inc. 3.6 Accept Quotes and Authorize the 2022 Dust Coating Project to Central MN Dust Control, LLC. 3.7 Approve Increase of Authorized Hours to Full -Time for the Recreation Coordinator Position. 3.8 Accept Resignation and Appoint a Parks & Recreation Advisory Commission Member. 3.9 Adopt Resolution 2022-51 Approving the MnDOT Master Partnership Contract. Motion carried 4-0. 4. Administration: 4.1 Franchise Fees. A Presentation by City Administrator/ Finance Director. B. Consider Ordinance 2022-07 Electric Service Franchise Fee — Northern States Power Company. C Consider Ordinance 2022-08 Electric Service Franchise Fee — Elk River Municipal Utilities. D Consider Ordinance 2022-09 Electric Service Franchise Fee — Wright -Hennepin Cooperative. E Consider Ordinance 2022-10 Gas Service Franchise Fee — CenterPoint Energy. City Administrator/Finance Director Flaherty presented the franchise fees Ordinances. CM Dahl asked for clarification about the properties and fees for Heritage Hills. CM Moores also stated surrounding cities have franchise fees. CM Moores said besides Elk River Star News would staff also post on the City's website. City Administrator/Finance Director Flaherty said yes; city staff would place it on the City website as well as other locations per Council direction. Acting Mayor Darkenwald asked City Attorney Kendall about the draft Ordinance and the names that are on it. City Attorney Kendall said it was at the company's request to have those names on the ordinance. Acting Mayor Darkenwald wanted clarifications on 2022-08 of having the appropriate language. City Administrator/Finance Director Flaherty said yes. CM Dahl motioned to adopt Ordinances 2022-07, 2022-08, and 2022-09 implementing electric service franchise fees on Northern States Power Company, Elk River Municipal Utilities, and Wright -Hennepin Cooperative; to adopt Ordinance 2022-10 implementing gas service franchise fees on CenterPoint Energy; and to authorize staff to publish the summary ordinances, seconded by CM Moores. All in favor. Motion carried 4-0. S. Engineering: 5.1 Water Tower #4. A. Presentation by City Engineer. B. Consider Change Order #1. City Engineer Wagner presented the staff report. CM Moores asked if there was a way the City would have known earlier about the cost of item 2 and about what changed. City Engineer Wagner explained and said it was a common thing that happens. CM Moores asked if City staff foresees any other additional costs. City Engineer Wagner said no for the bulk of the work but possible paint. He also stated the water main is a hard item to find, so the zinc coated pipe might be four to five hundred dollars more. Zinc is a good thing to have but not a necessary upgrade. Due to this items scarcity they needed to purchase the upgrade in order to complete the project. CM Dahl asked if there have been security problems at the construction site. City Engineer said wells and water towers are secure and locked. CM Goede motioned to approve Change Order #1 with Landmark Structures, LLC in the amount of $83,348.30 for the Otsego Water Tower #4, City Project No. 20-08, seconded by CM Dahl. All in favor. Motion carried 4-0. 6. City Council Reports and Updates. 6.1 Commission Liaison Updates. A. Heritaae Preservation Commission Liaison CM Moores. B. Parks & Recreation Commission Liaison CM Moores. C. Planning Commission Liaison CM Darkenwald. D. Public Safetv Commission Liaison CM Goede. Council members gave updates. 7. Staff Reports and Updates. City Administrator/Finance Director Flaherty said there was a small garage fire last night. No injuries but detached garage is a loss. He also mentioned there is a groundbreaking ceremony for Dakota Supply Group that was sent out in the staff email. Last, City Hall will be closed for Memorial Day, May 30, 2022. Human Resources/Assistant City Administrator Hille said the intern started today and the street maintenance posting closed last Friday. City Engineer said a quarter of a mile on Kadler Avenue will be shut down in mid-June to September. Sergeant Oltmans talked about security and raw material that are being taken. Wright County Sherriff's are trying to keep their presence around as much as possible. He also addressed the engine breaking concerns from residents letting Council know WCS office is looking into how often this is happening and will address it. Over the weekend there were two "panic button" events that needed to be addressed. One was the garage fire, and the other was a three-year-old that went missing during the night. Sergeant Oltmans commented a resident named Kelly who made the fast right decision and commended her for doing so. He thanked the residents, fire department and all that responded. 8. Adjournment.
