12-16-1985 Town Board MinutesState of Minnesota County of Wright Town of Otsego Treasurer; Lani Will, present. The meeting was called to order by Chairman Floyd Roden. The minutes of the December 2, 1985, Town Board Meeting were approved as read. Loren Merges appeared to request a split of 1 acre with a house from a 20 acre parcel of Ag land with the remainder to remain Ag land. Motion by Douglas Lindenfelser to approve the request of Loren Merges, Seconded by Norman Freske, passed unanimously. Dennis Taylor, Surveyor, appeared to present the completed Town Road Map to the Town Board. Supervisor Norman Freske introduced and moved the adoption of the following resolution which was seconded by Supervisor Douglas Lindenfelser -.,& unanimously adopted by the Town Board. Whereas, Otsego Township in Wright County, Minnesota, contains a number of township roads, and Whereas, Nearly all of the township roads have been established by use and/or prescription or by dedication and there may or may not be a record of said roads recorded in the office of the Wright County Recorder of Wright County, Minnesota, and Whereas, The Township Board of Supervisors has determined it to be in the best interest of the Township, the public and all parties concerned to determine and record the centerline location of said duly established town roads, and Whereas, The Town Board has caused to be prepared a road map indicating the location of said town roads contained in the township, & Whereas, the Town Board held a public hearing on the proposal on the 2nd day of December, 1985, at 8:00 p.m., and that notice of said hearing was provided to by the law, Now, therefore, be it resolved that the township roads as shown on the road map are deemed to be established as town roads, the author- ity by which the various roads are deemed established is as follows: A. Platted roads (MN Statutes, Chapter 505) B. Roads established by deed (MN Statutes, Chapter 164.02-2) C. Roads established by use, prescirption or dedication under one or more of the following means of establishment: By use or presciption (MN Statutes 160.02-6)(see affidavit of Supervisor Floyd Roden as part of this road map). By dedication (MN Statutes 160.05-1). By common law dedi- cation and/or common law prescirption. The town roads shall be deemed 66 feet wide pursuant to and in accordance with MN Statutes 160.04. All town roads which lie upon and follow the boundries of this township are deemed to lie in equal proportion in the township and the abutting political unit unless expressed shown otherwise. After the recording of this road map any subsequent purchaser of real property shall be deemed to take such property subject and entitled to the benefits of the town roads shown thereon. The rights and the duties of the township as to the roads shown on this road map shall not be increased, decreased or modified by the recording of this map. The Town Board of the Township of Otsego met this 16 day of December, 1985, at 8:00 p.m. Floyd Roden, Chairman; Douglas Lindenfelser and Norman Freske, Supervisors; Lewis Pouliot, Deputy Clerk, and Jerome Perrault, Clerk, were State of Minnesota Continuation of December 16, 1985 Meeting County of Wright Page 2 Town of Otsego Tom Hayes, attorney representing the Martha Valerius family, appeared before the Board to request the approval of the Town Board to annex 61 acres of the Valerius farm to the City of Albertville as a potential buyer of the farm would like to develop the land and get utility service from the City of Albertville. Mr Hayes said at this time he is not sure what type of development that the buyer has in mind but he would assume it to be some type of urban development. The potential buyers name is Peter Stalland. The Board advised him they would like more time to consider the proposal and requested that he and the Valerius family meet with the Otsego Planning Commission to get their opinion of the proposal. Wayne Kessler appeared before the Board to request rezoning 35 acres from a 57.09 acre parcel of Ag land to platted residential in Section 34, Range 24. He wishes to make 2 - 15 acre lots and 2- 22 acre lots. The Board asked him to appear at the January 2, 1986, meeting of the Otsego Planning Commission to present his proposal to them for their consideration. Motion by Douglas Lindenfelser to approve Lani Will attending a Sewage Treatment Workshop in St. Cloud from January 14 thru January 16, 1986. Seconded by Floyd Roden, passed unanimously. Proceeding as a Board of Audit, the Town Board uadited and allowed vertified accounts numbers 336 to 347, inclusive. On motion, the meeting adjourned. SUPERVISORS: ATTEST: Jerome Perrault, Clerk
