08-11-08 CCITEM 3-7 OTSEGO CITY COUNCIL MEETING OTSEGO CITY HALL AUGUST 11, 2008 6:30 PM 1 Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 6:30 PM. Roll Call: Mayor Jessica Stockamp; Councilmember's: Vern Heidner, Dan Scharber, Tom Darkenwald and Mark Thorsted. Staff: Mike Robertson, City Administrator; Dan Licht, City Planner; Ron Wagner, City Engineer; Tami Loff, Deputy Clerk; and Brad Belair, Public Works Supervisor. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2 Consider agenda approval. Mike Robertson requested to pull item 9.1. CM Heidner motioned to approve agenda as amended. Seconded by CM Scharber.All in favor. Motion carried. 3 Consider the following minutes. 3.1. July 28 2008 City Council Minutes. CM Heidner motioned to adopt the minutes as written. Seconded by CM Thorsted. CM Scharber abstained. Motion carried. 4 Open Forum: (5 minute limit) Dominic Palmer, 8246 Packard Avenue, regarding noise ordinance, has a complaint with a neighbor playing radio too_ loud during the day. He said that he has contacted the Sheriffs Department numerous times and was told by them there is nothing they can do. Mr. Robertson will contact the Sherriff department and make sure they are aware that the City Ordinance covers this. Mayor Stockamp told Mr. Palmer about the Police Commission meeting tomorrow night at 6:30 PM. Mr. Palmer also asked about hooking up to city sewer and water. Mr. Licht said that he and his neighbors would have to petition for it. CM Heidner said that a study was done in this specific location and it would be quite expensive. 5 Consent Agenda (Non -controversial items). 5.1. Approve Claims List. 5.2. Adopt Resolution 08-50 setting a Public Hearing on proposed assessment for unpaid administrative fines. 5.3. Adopt Resolution 08-51 setting a Public Hearing on proposed assessment for unpaid administrative fines and service charges related abatement of property maintenance violations. 5.4. Approve Pay Estimate #7 (FINAL) for Well #3 Redevelopment, Well Pump Replacement and Electrical Revisions at Pump house #2 to E.H. Renner & Sons, Inc. in the amount of $6,085.38. 5.5. Approve Pay Estimate #6 for Well #8, Raw Water Line and Pump house #2 Improvements to Rice Lake Construction in the amount of $54,370.78. 5.6. Approve Pay Estimate #1 for 75ti' St. to Hardrives, Inc. in the amount of $217,231.37. City Council Meeting August 11, 2008. Page 2. CM Heidner motioned adoption of the Consent Agenda. Seconded by CM Scharber. All in favor. Motion carried. 6. Unfinished Business. 6.1. Extension Request for Crimson Ponds North Final Plat. Mr. Licht went over the letter requesting extension. They are asking for a 100 day extension. CM Heidner asked if they have a developer's agreement yet. Mr. Licht said no. Mr. Licht said they can still submit their application as they have 30 days before it expires. CM Scharber motioned to deny the request. Seconded by CM Darkenwald. All in favor. Motion carried. 7. Public Works. No items. 8. Dan Licht, City Planner. 8.1. Ted Beebe: A CUP for a second driveway to a single family lot within an R-3 District. Mr. Licht presented the Planner's Report. Applicant was not present. CM Darkenwald asked how big the lot is. Mr. Licht said 1 acre. CM Heidner motioned to approve a CUP allowing construction of a second driveway, subject to the two conditions listed in the Planner's report dated August 5, 2008. Seconded by CM Scharber. All in favor. Motion carried. 8.2. Resolution 08-52 amending the Comprehensive Plan to adopt an update to the Transportation Plan map. Mr. Licht presented the resolution updating the Transportation Plan map. CM Scharber motioned to approve the Resolution. Seconded by CM Heidner. All in favor. Motion carried. 8.3. Ordinance 08-16 amending the Zoning Ordinance of the City of Otsego related to residential accessorybuildings. Mr. Licht presented the resolution. CM Scharber said there is a typo on page 4, in section A, it should read one thousand one hundred and fifty. CM Heidner asked about larger than 1 acre lots. After Discussion, the Council agreed to increase the amount slightly for the larger sewered lots. CM Heidner motioned to approve the Ordinance including a revised table with corrections. Seconded by CM Thorsted. All in favor. Motion carried. 8.4. Review of Pool Ordinance. Mr. Licht presented the Planner's Report. Mr. Licht compared our Ordinance with St. Michael's and Elk River's. CM Scharber motioned to send to the Planning Commission for review. Seconded by CM Heidner. All in favor. Motion carried. 9. Ron Waaner, Citv Engineer. 9.1. 70th Street Maintenance — Albertville Letter. -REMOVED 9.2. Otsego Preserve Escrow Refund. Ron Wagner presented a request from the developer. CM Darkenwald asked what is wetland monitoring. City Council Meeting August 11, 2008. Page I Mr. Wagner said that under state law for the first five years a report must be put together to make sure that the site meets the wetland requirements. CM Heidner motioned to approve payment of $42,174.57 to the Developer. Seconded by CM Thorsted. All in favor. Motion carried. Mr. Wagner said that 75th Street was paved with the base lift Friday and 77"' Street was done today. 10 Andrew MacArthur, City Attorney. 11. Council Items. 11 1 Review Draft Career Development Plans. Mike Robertson said staff is looking for input. CM Heidner said that he has not had time to go over and would like time to review it. Council will bring to a future Workshop. 112 Set meeting with Sheriff Miller. Council selected three possible meeting dates September 29"', at 5:30 PM; October 6"', at 5:30 PM or October 2r, at 5:30 PM. 12 Mike Robertson, City Administrator. No items. 13. Judy Hudson, City Clerk. 14. Adjourn by 10 PM. CM Darkenwald said that the stop lights at Cty Rd 42 and Highway 101 have extremely short intervals. Mr. Wagner will notify MNDOT. Mayor Stockamp talked about a volunteer recognition program. CM Scharber motioned to adjourn. Seconded by CM Darkenwaid. All In favor. Motion carried. Adjourned at 7:55 PM.
