05-25-1988 Special Meeting MinutesState of Minnesota A special Town Board Meeting was County of Wright held this 25th day of May, 1988 at Town of Otsego 8:OOP.M. to conduct a Public Hearing on the proposed vacation of Drainage and Utility Easements in Lots 1 and 8, Block 1, Mississippi Shores 6th Addition. Norman Freske, Chairman, Floyd Roden and Douglas Lindenfelser, Supervisors, Elaine Beatty, Deputy Clerk, and Jerome Perrault, Clerk, were present. The Public Hearing was called to order by Chairman Norman Freske. The easements to be vacated are described as the South Ten (10') of Lot one (1) and the North Ten feet (10') of Lot eight (8) Block one (1), Mississippi Shores 6th Addition. A Petition was received from Marvin George, who owns the property abutting Lots one (1) and eight (8), requesting that the Town Board vacate the existing easements. No one appeared at the Hearing to protest the proposed vacations. John Oliver and Associates, Inc., licensed Surveyors, have determined that new easements described as the North ten feet (N10') of Lot one (1) and the South ten feet (S10') of Lot eight (8) will satisfactorily drain the area. The Town Board has agreed to accept the proposed new easements. Motion by Douglas Lindenfelser to adopt the attached Resolution to Vacate the Drainage and Utility Easements therein described. Seconded by Floyd Roden. All Board Members voted in favor of the motion. On Motion, the Hearing Adjourned. CHAIRMAN; Norman Freske SUPERVISORS; Douglas Lindenfelser Floyd Roden ATTEST: Jerome Perrault, Clerk JP/eb ENCLOSURE FOLLOWS: STATE OF MINNESOTA COUNTY OF WRIGHT TOWN OF OTSEGO RESOLUTION TO VACATE PORTION OF DRAINAGE AND UTILITY EASEMENT At a regular meeting of the Otsego Town Board held on the 2nd day of May, 1988 at the Town Hall in said Town, Supervisor Douglas Lindenfelser introduced a motion for the adoption of the following resolution: WHEREAS, the Town of Otsego, located in the County of Wright, State of Minesota, has the authority pursuant to Minn. Stat. sec 368.01, subd. 25. to vacate by resolution any street,alley, public grounds, public way, or any part - Page 2 thereof, on its own motion; and WHEREAS, the Town Board has posted notice of a hearing and has held a public hearing on the instant date to determine whether it is in the best interest of the Town to vacate the following described portion of a town easement; and WHEREAS, the Town Board, after hearing the concerned residents and abutting property owners has determined that it is in the best interests of the public to vacate the portion of a drainage and utility easement legally described as follows: That part of the drainage and utility easement as dedicated in MISSISSIPPI SHORES 6TH ADDITION, Wright County, Minnesota described as the South 10.00 feet of Lot 1 and the North 10.00 feet of Lot 8 in Block 1, said MISSISSIPPI SHORES 6TH ADDITION which lies West of a line which is parallel with and distant 10.00 feet West of the East lines of said Lots 1 and 8, and which lies East of a line which is parallel with and distant 10.00 feet •East of the West lines of said Lots 1 and 8. NOW THEREFORE BE IT ROSOLVED, that the Town of Otsego ordains that the above described drainage and utility easement be and hereby is vacated by the Town of Otsego. BE IT FURTHER RESOLVED, that the Board Chair and Town Clerk be authorized to execute Quit Claim Deeds conveying the aforementioned described property to the abutting land owner, Marvin George. BE IT FINALLY RESOLVED, that copies of this resolution be forwarded to the Wright County Auditor and the Wright County Recorder for further action pursuant to statutory requirements. Supervisor Floyd Roden seconded the motion for the adoption of the above resolution, whereupon the same was put to a vote. Voting affirmatively: Douglas Lindenfelser, Norman Freske, Floyd Roden Voting negatively: None WHEREUPON said resolution was duly adopted. Dated this 2nd day Jerome Perrault of May, 1988.
