08-01-1988 Town Board Minutes$tate of Minnestota The Town Board of the Town of Otsego County of Wright met this 1st day of August, 1988 at Town of Otsego 830 P.M. Norman Freske, Chairman, Floyd Roden and Douglas Lindenfelser Supervisors, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk, and Jerome Perrault, Clerk, were present. The meeting was called to order by Chairman Norman Freske. Minutes of the July 18, 1988 Town Board Meeting were approved as read. Attorney Andy MacArthur reported on the progress of the project to vacate street for Elaine Speaker in the Otsego Townsite area. The Attorney General has advised him orally, that the Township does have the power to vacate the streets and will be issuing him a written opinion to that effect in the near future. Mr. MacArthur said that he will need a more exact description of the lots involved in the vacation proceedings and will need to know if Elaine Speaker is the owner of all the lots involved. She was present and advised him she is the owner of all the lots and will furnish him the necessary information he needs. A Public Hearing on the proposed street vacation will be needed before the Town Board can proceed to vacate the streets. Motion by Douglas Lindenfelser to postpone the Town Board Meeting scheduled for Monday, September 5th until Wednesday, September 7th, as September 5th is Labor Day, a legal Holiday. Seconded by Floyd Roden, all Board Members voted in favor of the Motion. Dr. David Gilgenback appeared before the Board to request approval to vacate the Drainage and Utility Easements on the North end of Lot seven (7) and the South end of Lot two (2) , Mississippi Shores Sixth Addition and transfer the easements to the South end of Lot Seven (7) and the North end of Lot Two (2). The present easements would interfere with his plans to build a Veterinary Clinic on the two lots. The Board advised him that a Public Hearing will be required, with Published Notices thereof, .in order to vacate the easements. Motion by Floyd Roden to set September 7, 1988 at 7:45 P.M. as it's date for the Public Hearing on the proposed vacation of the Drainage and Utility Easements on the North end of Lot Seven (7) and the South end of Lot two (2), Mississippi Shores Sixth Addition. Seconded by Douglas Lindenfelser, all Board Members voted in. favor of the Motion. Motion by Floyd Roden to place the balance of the residents protesting the Storm Drain Assessments onto the Assessment Roll, and extend the Assessment one year (1) to prevent a double assessment for one year. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the Motion. Mr. MacArthur presented the Board with a letter of understanding between Mr. James Peterson and the Town of Otsego regarding the settlement agreement on the Storm Drain Assessments fax the Flora Kolles Estate Property. As Mr. State of Minnesota County of Wright Town of Otsego „loop 13oard Meeting August 1, 1988 - Page 2 Peterson was not present, action on the letter was postponed at this time. Mr. MacArthur also presented the Board with a Revised Ordinance to Regulate Open Burning Within The Township. The Board will study the Ordinance and postponed adoption at this time. John Weight appeared before the Board to request permission to install culverts the full width of the front of the lot by the new Day Care Center. The Board questioned whether there could be maintenance problems caused by freezing or plugging with a culvert of that length. Motion by Floyd Roden to approve driveway culverts up to fifty feet (50') in length for the Day Care Center and if the Day Care Center wishes to use a full lot width culvert, they will assume maintenance and upkeep of the full width culvert. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the Motion. Linda Synder appeared before the Board to say she was interested in applying for the position of Dog Catcher. The Board advised her that at the present time the position was not open, but they would keep her in mind, She said she does not have an outside job and would have time to devote to the position. She was given an application blank and a copy of the Dog Ordinance. Jim Vorderbruggen appeared before the Board to discuss the Insurance coverage on the contents of the Town Hall. As they now have a computer in the Town Hall, the Board requested Mr. Vorderbruggen to increase the coverage on the contents of the Town Hall from $10,000.00 to $20,000.00. The Board will take an inventory of the contents of the Town Garage before deciding what coverage is needed for that department. Ingolf Roskaft reported to the Board that James Talbot has erected a building on the island he owne5 in the Mississippi River that he purchased from the Bouley Family. He feels the D.N.R. should be notified of the enistence of the building as this would be considered flood plain area and should not have a permanent structure on it. Elaine Beatty reported to the Board that Allen Croteau of 1.7335 NE 65TH Street has not complied with the notice to clean up the junk on his lot. Motion by Norman Freske to send a second notice to Allen Croteau to clean up the junk on his lot within thirty (30) days and if he fails to comply the County Zoning Administrator will be requested to take Legal Action to have the junk removed. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the Motion.
