10-17-1988 Town Board MinutesState of Minnesota The Town Board of the Town of Otsego County of Wright met this 17th day of October, 1988 Town of Otsego at 8:00 P.M. Norman Freske, Chair- man, Floyd Roden and Douglas Lindenfelser, Supervisors, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk and Jerome Perrault, Clerk were present. The meeting was called to order by Chairman Norman Freske. Minutes of the October 3, 1988 Town Board Meeting were approved as read. 4-H leader Glenn Benson brought three (3) members of the local 4-H Club to speak to the Town Board. Tom Berning thanked the Town Board for giving the 4-H Club the opportunity to participate in the recycling project for the Township. Kathy Berning said that the 4-H Club appreciated all the work that had been done to improve the Town Hall and voluntered the assistance of the club members in any other ways to improve the Town Hall. Glenn Benson's son displayed a book containing the awards the 4-H club members have won a the County and State Fairs and asked permission of the Board if they could display some of their awards on the wall of the Town Hall. The Board thanked the 4-H members for appearing at the meeting and expressed their appreciation for the efforts of the 4-H members in assisting with the recycling project. They suggested the 4-H members meet with Elaine Beatty and arrange for a place to display their awards. Richard Wolters and Ron Bray from the Minnesota DOT office in Brainerd addressed the meeting concerning the progress of the Cold Region Test Facility they plan on building on the North side of 1-94 starting about one mile (1) West of Albertville. They plan on building two test strips, the first of which will be about three and one half miles (3-1/2) long and West bound 1-94 traffic will be routed over this strip from time to time. The second and shorter strip will be built just North of the first strip and will be used for specialized testing. The purpose of the testing is to determine which materials are best to repair and maintain highways in the cold regions of the country. Plans are to begin construction in 1989 and be ready for use in 1990. Cost of the project will be $5,000,000.00 at least 90% Federal funded. Because they will need a service road for the test area, their plans are to rebuild 70TH Street from County #19 to Kadler Avenue and from this point on Kadler Avenue to build a new road through the test area connecting with Jalger Avenue. This road will be turned over to the Township after completion. As the construction will be affecting drainage in the area, their plans are to build five holding ponds in the area. Because of the decision to build the holding ponds, they will be purchasing more land than originally planned, including 20 acres from the Archie Lindenfelser farm. Attorney William Radzwill and Engineer Peter Raatikka appeared to discuss the levee in Otsego Township which was built by the Army Corps of Engineers along the Mississippi River juist across the bridge from Elk River. The levee was built as an emergency flood control measure in 1969 and because it was not engineered sufficently, the Army Corps of Engineers no longer wants to assume responsibility for the levee. They now want the Township to take over maintenance and responsibility for the levee or remove it. As the levee is situated on private property, the Army Corps. of Engrs has suggested that the Township purchase the land from the property owners if they wish to leave the levee in place. The Board will meet at the levee with the land owners to do a site inspection to see what should be done and what alternative they have. Engineer Peter Raatikka advised the Board that the streets that were overlaid need shouldering work done and that Buffalo Bituminous would do the shouldering at $7.00 per yard. Because it is late in the season, the Board decided to postpone the shouldering until Spring. Roman Svoboda of 10604 95TH ST NE, Monticello, Minnesota appeared to request a variance to build a pole building (36' x 54') on his two (2) acre lot. The land is zoned Ag but he would like a variance for R-1 setbacks for rear and side lot. Motion by Douglas Lindenfelser to grant Roman Svoboda a variance and Conditional Use Permit to construct a 36' x 54' pole building with 12' side walls and a 25' rear lot line setback and a 20' side lot line setback. Seconded by Norm Freske, all Board Members voted in favor of the motion. Kent Nielson, of 3030 St. Albens Mill Road in Minnetrista, owns Lot 11, Block 7 in Island View Estates and appeared before the Board to request a variance to make this a buildable lot as it is 700 Sq. Ft. short of one acre. Motion by Floyd Roden to approve a variance for Kent Nielson to make Lot 11, Block 7, Island View Estates a buildable lot as it is a platted area. Seconded by Douglas Lindenfelser. All Board Members voted in favor of the motion. Jerry Smith has purchased the Burdick property (PID 214- 000-0164101 and PID 214-000-164200) in Section 16, Range 23, on the North side of County #39 and appeared before the Board to request rezoning from Ag. to R-1, 48 acres of land. He brought in a preliminary plat with 40 lots. His preliminary plat has the streets tied in with the streets in Mississippi Shores. Motion by Douglas Lindenfelser to approve the request of Jerry Smith to rezone 48 acres of land from Ag. to R-1. qp.rnnAF.A by Flnyd Roden. all Board Members voted in favor of State of Minnesota County of Wright Town of Otsego Town Board Meeting October 17, 1988 - Page 3 - A resident of 96TH Street in Mississippi Shores stated that he was opposed to extended 96TH Street into the development planned by Jerry Smith as it would increase the traffic on 96th Street. Clem Darkenwald appeared before the Board to request rezoning from Ag. to R-1, 94 acres in Section 16, Range 213 (PID 214-000-1631 and PID 214-000-164200). He has prepared a preliminary plat with fifty (50) one acre (1) and two (2) acre lots and a park area close to the Mississippi River. Motion by Norman Freske to approve the rezoning request of Clem Darkenwald to rezone 94 acres from Ag. to R-1. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the Motion. The Board suggested to Mr. Darkenwald that he tie in the streets in his development with the streets in Jerry Smith's development just East of his development. Mr. Darkenwald said he would prefer not to have the streets connected as he would like the park area he is planning to be for the exclusive use of the residents of his plat. James Peterson brought in his plat of the Kolies Property (PID 214-000-222200 in Sec. 22, Range 23) for approval. He has revised the street on the North part of the plat to tie in with 88th Street in Halls Addition. Motion by Norman Freske to approve the plat of James Peterson known as the James Addition containing 48 lots. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the motion. Joe Radjenonvich appeared before the Board to complain about the Dog Catcher holding his dog for five (5) days when the dog had a tag on it with his phone number on it and the Dog Catcher did not call him. Motion by Douglas Lindenfelser to refund $45.00 of the dog fine to Mr. Radjenonvich. Seconded by Floyd Roden, all Board Members voted in favor of the motion. Motion by Norman Freske to send a second notice to John Karnes of 8360 Oakwood Avenue (Lot 5, Block 1, Vasseur's 3RD Addition) to remove the old cars and mow the weeds and grass on his lot. Seconded by Floyd Roden, all Board Members voted in favor of the motion. Motion by Floyd Roden to grant the Wright County Highway Department permission to use the Town Hall on November 10 at 7:30 P.M. to present an update on County 42 and County 130 construction plans. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the motion. Proceeding as a Board of Audit, the Town Board audited and allowed verified accounts Nos. 406 to 423 inclusive.
