The property owner and applicant, Mr. Ted Beebe was not present. Mr. Dennis Gatenby spoke at the public hearing in opposition to the request. Mr. Gatenby is concerned that allowance of detached accessory buildings and driveways directly from City streets will lead to an increase in home extended businesses. Mrs. Margaret Gatenby also spoke in opposition to the request stating that only one driveway should be allowed. Finally, Mr. Richard Wilt spoke in opposition to the application has he had previously been denied a similar request. In response to these comments, City staff explained that the Zoning Ordinance allows for detached accessory buildings, but that use for business purposes is prohibited and enforced on a complaint basis. City staff further explained that allowance of second driveways is based on the specific criteria established in May 2004 that protects the City's primary goal in regulating driveways of traffic management, access spacing and minimizing improvements within the public right-of-way. As part of their discussion, the Planning Commission asked about the process for approval in locating a single family home and potential detached accessory building. City staff said that as the City has grown, City staff is able to provide more direction to builders and home owners regarding the location of buildings on their lot to be consistent with established policies and regulations. The criteria set forth in the Zoning Ordinance for allowance of a second driveway within the one acre subdivisions accommodate properties with difficult physical conditions or preexisting building locations. There is no ability to prohibit construction of a detached accessory building that does not have access to a single driveway to the property, but City staff would be unlikely to recommend approval of a second driveway for a property that was advised of the City's policies for access to a public street. The Planning Commission concurred indicating that they are sympathetic to situations similar to that of Mr. Beebe but would be less so for a property owner advised before construction to avoid the need for a second driveway. The Planning Commission closed the public hearing and voted 6-1 to recommend approval of the application. Findings of fact consistent with the recommendation of the Planning Commission are attached for review and possible action at the City Council meeting on 11 August 2008 at 6:30 PM. POSSIBLE ACTIONS A. Motion to approve a CUP allowing construction of a second driveway, subject to the following conditions: 1. The second driveway shall be constructed and paved within one (1) year from the date of approval. 2. The construction of the second driveway within the public right-of-way shall comply with Standard Plate #706. B. The subject site is guided by the Comprehensive Plan for Low Density Residential land uses within the Long Range Urban Service Area. C. The subject site is zoned R-3, Residential Long Range Urban Service District. D. The applicant is proposing construction second driveway from a public street accessing the property; the proposed second driveway is allowed a conditional use in accordance with Section 20-21-4.1-1.1 1.d of the Zoning Ordinance. E. Consideration of the application is to be based upon (but not limited to) the criteria set forth by Section 20-4-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: A goal of the Comprehensive Plan is to accesses onto public streets for proper traffic management while providing adequate access to property. Allowance of a second driveway to the subject site is consistent with the Comprehensive Plan and criteria established by the Zoning Ordinance as there is a demonstrated need related to the location of the existing single family home on the propert. 2. The proposed use's compatibility with present and future land uses of the area. Finding: The subject site is surrounded by other existing one -acre single family development and no compatibility issues are anticipated as a result of connecting the existing concrete slab accessing the existing detached accessory building to the public street. 3. The proposed use's conformity with all performance standards contained within the Zoning Ordinance and other provisions of the City Code. Finding: The proposed second driveway will comply with all applicable performance standards. 4. Traffic generation of the proposed use in relation to capabilities of streets serving the property. Finding: The allowance of a second driveway to access a detached accessory building will not result in additional traffic generation that would negatively effect public streets. 5. The proposed use can be accommodated by existing public services and facilities and will not overburden the City's service capacity. Finding: The proposed driveway will not effect the City's service capacities. E. The Planning Report dated 30 July 2008 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. F. The Otsego Planning Commission conducted a public hearing at their regular meeting on 4 August 2008 to consider the application, preceded by published and mailed notice; upon review of the application, and other evidence, the public hearing was closed and the Planning Commission recommended by a 6-1 vote that the City Council approve the request based on the findings outlined above. DECISION: Based on the foregoing information and applicable ordinances, the application is hereby APPROVED subject to the following conditions: The second driveway shall be constructed and paved within one (1) year from the date of approval. 2. The primary reason for the Transportation Plan map update is to include schematic reference to the preferred alignment of the proposed 1-94/Kadler Avenue interchange. Consideration of the amendment was initiated by the City Council as part of its planning efforts and pursuit of permit approvals from MNDoT and Federal Highway Administration for the interchange. Resident Pat Hilden of Lin -Bar Estates spoke in support of the proposed Transportation Plan update and specifically to the issue of needed improvements to CSAH 37 and the need for buffer yards for residential development abutting major roadways. City staff responded that the timing for improvement of the roadways on the Transportation Plan will primarily be development driven with Wright County responsible for construction of roads such as CSAH 37. City staff also noted that the Zoning Ordinance was amended in October 2002 to require installation of berms and landscaping along collector and arterial streets to buffer abutting residential development. The Planning Commission had various questions regarding specific roadways or segments of roadways but no major comments or concerns. The Planning Commission closed the public hearing and voted 6-0 to recommend City Council approval of the updated Transportation Plan map. A resolution consistent with the recommendation of the Planning Commission is attached for consideration at the City Council meeting on 11 August 2008. POSSIBLE ACTIONS A. The purpose of this memorandum is to outline these issues and suggest possible modifications to the Zoning Ordinance in response. The Planning Commission discussed these issues as outlined at their meeting on 7 July 2008 and held a public hearing on 4 August 2008 to consider a draft Zoning Ordinance amendment. Exhibits: A. Proposed Ordinance 2008-16 ANALYSIS Rear Yards Abutting Collector/Arterial Streets. The Zoning Ordinance requires a 65 foot setback from collector or arterial streets defined by the Comprehensive Plan. New subdivisions occurring within the east and west sewer districts are designed such that the lots abutting collector or arterial streets are double frontage lots with the front of the house accessed from a local residential street. In this scenario, the yard abutting the collector or arterial street is functionally the rear yard of the property, but the same 65 foot setback applies (versus a 20 foot setback for interior lots). It is common that these double frontage lots abutting collector or arterial streets are designed such that the house is located at the 65 foot setback line. Section 20-16-4.13 of the Zoning Ordinance does not exempt accessory structures on these lots from the 65 foot setback. Within the developed sewered subdivisions, play sets, garden sheds and other structures have been erected within these rear yards that do not meet the 65 foot setback. In order to address these existing lots and ensure usable yard space for accessory structures, the Planning Commission discussed the following amendment: 20-16-4.B.3: a. Attached accessory structures shall conform to principal building setbacks required for the zoning district in which the structure is located. b. Detached accessory structures may encroach into required side or rear yard setbacks when located in the rear yard of the lot, but shall not encroach into the required setback for a yard abutting a public street of a corner lot: 1. Detached accessory structures not exceeding one hundred fifty (150) square feet in gross floor area shall be setback at least five (5) feet from side or rear lot lines abutting other lots or ten (10) feet from a rear lot line abutting a ublic right-of-way in the case of a through lot. 2. Detached accessory structures with a gross floor area larger than one hundred fifty (150) square feet shall be setback at least ten (10) feet from side or rear lot lines abutting other lots or twenty (20) feet from a rear lot line abutting a public right-of- way in the case of a through lot. C. No accessory structure shall be located within a required buffer yard, drainage and utility easement or public right-of-way. Interior Lot Setbacks. A second setback issue related to detached accessory buildings larger than 1,000 square feet has been also been raised. Section 20-16-4.13.3 of the Zoning Ordinance currently requires that detached accessory structures larger than 1,000 square feet in all zoning districts conform to principal building setbacks. A similar provision is repeated for the R -C District in Section 20-60-8.C.2 to encourage clustering of buildings on a lot specifically within that district. Except within the A-1 and A-2 District on parcels larger than five acres, the maximum gross floor area of any single detached accessory building is 1,500 square feet. The principal building side and rear yard setbacks in districts other than the A-1 and A-2 District are 10 feet and 20 feet, respectively. The effect of this provision is to move the building 10 feet farther into the property from the rear lot line. Given that buildings with an area of more than 1,000 feet are only allowed on lots larger than one acre within A-1, A-2, R -C, R-1, R-2, and R-3 District and the difference in building mass between 1,000 square feet and 1,500 square feet on parcels this size is negligible, the Planning Commission saw minimal benefit to requiring the principal building setback (except in the R -C District). As such, the Planning Commission proposed that detached accessory buildings larger than 1,000 square feet would not required to meet principal building setbacks. Sewer District Detached Accessory Building Area. The Zoning Ordinance was amended in 1998 to establish provisions for detached accessory buildings within the sewer service districts in anticipation of and prior to urban density development. Section 20-16-4.13.7 of the Zoning Ordinance limits the area of a detached accessory building to 150 square feet if there is an attached garage on the property and the total area of attached and detached accessory building area to 1,150 square feet. The following language was offered for consideration to allow detached accessory buildings larger than 150 square feet only within the R -4A and R-4 District, which require minimum lot areas of 18,000 square feet and 12,000 square feet respectively. The provisions would allow for a detached accessory building in combination with the area of an attached garage based on lot area. The current standards for the R-5, R-6 and R-7 District, which require only a 9,000 square foot minimum lot area for single family uses, were not proposed to change. Although some members of the Planning Commission favored allowing the larger detached accessory building area, after discussion the consensus was that there would not be a significant benefit or sufficient interest to warrant a change at this time. 20-16-4.B.7. St. Michael has adopted more detailed regulations that require stricter access controls for both above ground and below ground swimming pools. The Elk River and St. Michael ordinances also address behavior, which is more appropriately addressed as part of the City's nuisance ordinance than the Zoning Ordinance. City staff suggests that the City Council direct the Planning Commission to undertake an update of the Zoning Ordinance to amend the provisions related to swimming pool safety standards to address the following: Update the definition of pools subject to regulation consistent with the provisions adopted by St. Michael. Note that public and private stormwater drainage facilities would be exempt from these regulations. 2. Require a permit approved by the Zoning Administrator for any pool that is not required to obtain a building permit to verify appropriate security measures. 3. Revise Section 20-16-5.0 to specify fences or other structures are required for all below ground pools distinct from "screening", which may be interpreted to be landscaping. 4. Revise Section 20-16-5.D to require more specific access control measures for above ground pools. 5. Address security of hot tubs or similar devices by use of a secured cover. 6. Add provisions prohibiting the location of above and below ground pools within drainage and utility easements. CONCLUSION The City Council will discuss the summary of the City's pool regulations at the City Council meeting on 11 August 2008 at 6:30PM. City staff is requesting direction as to initiation of amendments to the Zoning Ordinance to update the pool regulations as outlined herein. C. As you know, Albertville had not planned for this expense at this time and does recognize the need to plan for future maintenance of this road. The Albertville Council made the following motion: Motion approving the City of Albertville entering into a Funding Agreement with the City of Otsego regarding improvement to 70th Street NE, between CSAH 19 and Kadler Avenue NE, by means of bituminous overlaying and related type work per the City of Otsego's 2008 Street Maintenance Project plans and specifications. Such agreement shall be structured that Albertville will reimburse the City of Otsego for Albertville's portion of the project costs, which are estimated to be approximately $57,000 subject to the City of Otsego entering into a CSAH 19 Agreement transitioning a four lane road in Albertville to a two lane road in Otsego. Motion carried unanimously. To further explain, the Albertville Council felt the CSAH 19 and 70th Street projects are somewhat similar in nature in that Otsego has the demand and need for improvements to 70th Street and Albertville does not. Conversely, Albertville has a more immediate need for CSAH 19 Improvements, whereas Otsego's CSAH 19 transportation needs are further out. Both projects require our two cities to work together. If this is not acceptable, I would suggest we bring this forward at our upcoming joint CSAH 19 meeting that we have planned for late this fall. The Developer had agreed to pay the City for a future fog seal. The fog seal will hide most surface damage to the streets that appears when asphalt wear course is placed prior to 75% build out. A separate escrow account of $7,000 for the fog seal has been established. The Developer was then allowed to place the wear course early. Some escrow is required to ensure the annual wetland monitoring reports continue until the wetland mitigation is approved. A minor additional escrow for administrative work will be required to follow the project to completion. We estimate wetland and administrative to be $4,800. This includes contingency escrow if wetland reseeding is required. Otsego Staff has also discussed the $15,000 owed by, the now defunct, Developer — Solid Ground. The $15,000 payment was amended to the Remington Coves Development agreement for consideration of the water and sewer connections provided for 7 lots within Remington Coves. Two homes have been connected to, so staff has agreed that the Developer of Otsego Preserves is owed 2/7 or $4,285.71. Lots 23, 26, 27, 28 and 29 of Block 1 shall not be allowed to obtain a building permit until 1/7 or $2,142.86 has been paid per each individual lot or the amount of $15,000 paid back to the City by the LOC and Warranty Bond combination.
