COUNTY OF WRIGHT of Otsego held a Special
TOWN OF OTSEGO Town Board Meeting this 30
day of August, 1989, at
2:00 PM. Norman Freske,
Chairman, Douglas
Lindenfelser and Floyd Roden, Supervisors, Jerome Perrault,
Clerk, and Bill Radzwill, Attorney, were present.
The meeting was called to order by Chairman Norman
Freske.
The purpose of the meeting was to discuss the Developers
Contract for Darkenwald's Mississippi Parkwood Development
and the letter received from Darkenwald's Attorney, Ed Boch,
in which he stated the Darkenwalds would agree to the
Developers Contract calling for a fee of $7,350, $150.
per lot for the 49 lots, an increase of $50.00 per lot over
their previous offer. They agreed to pay $50.00 per lot at
the time the contract was signed and $100.00 per lot at the
time the individual building permits were Issued. Mr.
Radzwill and the Board agreed the $7,350 would be sufficient
to recover most of the Township's costs during the plat
approval and construction costs but would not allow for
future Seal Coating costs and a share of Comprehensive
Planning expenses. The Board did agreed to accept this offer
with the understanding that the Darkenwalds be informed that
the agreement be for this project only and that there will be
changes in the future especially when the Township develops
its own Planning and Zoning Ordianance. One of the reasons
for accepting the Darkenwalds offer was that the Darkenwalds
had applied for plat approval prior to the time the Board
made the decision to require a Developers Contract.
The Board decided to require the $150.00 per lot be paid
up front at the time the Developers Contract is signed as one
of the conditions in agreeing to accept the Darkenwald's
offer, instead of $50.00 per lot when the contract is signed
and $100.00 when the building permits are issued, the reason
being the Township has already incurred most of the $7,350 in
enpenses connected with the plat.
The Board requested Mr. Radzwill to send a letter to
Darkenwalds Attorney explainingthe Township's position .in
agreeing to accept the offer.
On motion the meeting adjourned.
