02-05-1990 Vacation Hearing MinutesSTATE OF MN The River Road Vacation COUNTY OF WRIGHT Hearing was continued this TOWN OF OTSEGO 5 day of February, 1990, at 7:00 PM. Norman Freske Chairman, Floyd Roden and Douglas Lindenfelser, Supervisors, Elaine Beatty, Deputy Clerk, Judy Hudson, Secretary, Jerome Perrault, Clerk, Larry Koshak, Engineer, and Bill Radzwill, Attorney, were present. The Hearing was called to order by Chairman Norman Freske. Engineer Larry Koshak said he has researched the road and there is no other description of River Road between Page Ave. and Co. 42, other than that of Taylor Land Surveyors, Inc. when they recorded the Township roads. Minnegasco representative, Dave Henningsgaard, said that Minnesgasco has a 4 inch steel main line in place in the River Road right-of-way which he believed to be from 36" to 42" underground. He said they do not have an easement with the property owners. Attorney Bill Radzwill advised him that the Township would prefer that Minnegasco work out an easement agreement with the land owner as the Township does not plan to maintain any easements after River Road is vacated. A letter was received from NSP advising the Board that they are in the process of negotiating an easement agreement with the land owner and requested the Board to delay the final vacation order until their negotiations are completed. Mr. Oswald, who owns the lot next to Outlot A in Barthel Acres, said that he is purchasing Outlot A from Barthel. Motion by Douglas Lindenfelser to continue the River Road Vacation Hearing on April 2, 1990, at 7:30 PM.
