04-16-1990 Town Board MinutesSTATE OF MINNESOTA The Town Board of the Town COUNTY OF WRIGHT of Otsego met this 16 day TOWN OF OTSEGO of April 1990, at 8:00 PM. Norman Freske, Chairman, Douglas Lindenfelser and Floyd Roden, Supervisors, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk, Judy Hudson, Secretary, Jerry Perrault, Clerk, Larry Koshak, Engineer, and Bill Radzwili, Attorney, were present. The meeting was called to order by Chairman Norman Freske. Minutes of the April 2, 1990, Town Board Meeting were approved as read. Robert Rogers appeared before the Board regarding the $1,350.00 Hall's Storm Drain Assessment he has on 1/2 of Lot 11, Block 2, Vasseurs Oak Grove Estates, 2nd Addition. He is requesting forgiveness of the assessment because it is a 1/2 lot and not buildable. The Board advised him that he should have been present at: the Assessment Hearing following completion of the Storm Drain project and requested removal of the assessment at that time instead of after the Assessment Roll was adopted. Motion by Floyd Roden to forgive the remaining assessment on the 1/2 lot of Mr. Rogers as of the clay he combines his full lot and 1/2 lot under one PID number. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the motion. Kathy Lewis and Glen Benson appeared before the Board in regard to re -cycling which the 4-H Club has been taking care of the Board said they appreciate very much the efforts of the 4-H Club but in order to increase the percentage of households participating, we might have to adopt the curbside collection method to reach the County. and State goals of 25% participation. The Board said they would like to keep the 4-H Club involved in the re -cycling. A 3 basket set for curbside would cost about $18.00 per household. Gil Darkenwald appeared before the Board in regard to the application of the Darkenwald Family Partnership for a Land Alteration & Mining Permit for an 8 acre site at the SW corner of the junction of Hwy 101 and County 122. They plan on removing about 94000 yds of fill and gravel to cut down a hill and make the site buildable. The Otsego Planning Commission has approved the permit request. Engineer Larry Koshak represented the Board with a list of recommendations that he felt should be followed when a Land Alteration and Mining Permit is granted. Included on the list are the following recommendations: 1. Site location plan. 2 Site topography map.. 3. Grading and drainage plan for completed site. 4. Staging plan if mining operation exceeds one year or more. 5. If Using Township Street, the proposer needs a STATE OF MINNESOTA COUNTY OF WRIGHT TOWN OF OTSEGO THE TOWN BOARD MEETING OF APRIL 16, 1990 - Page Two a street maintenance and traffic plan and post Bond to cover possible needed repairs to street. 7. Site and street dust control plan. 8. Turf establishment after final site grading. 9. Township shall have right of access to inspect site to determine compliance with conditions of approval. 10. Noise abatement plan. 11. Permittee shall also provide Township with the name of an individual who is in charge of the mining operation and is available on a 24 hour basis. Also hours of operation should be limited to at least County requirements and 30 day notice given to Township prior to closure of mining operation. Motion by Douglas Lindenfelser to approve the request of Darkenwald Family Partnership for a Land Alteration and Mining Permit to remove 94,000 yds of fill and gavel from PID 214-000-352201 contingent upon that they follow the recommendation of Engineer Larry Koshak for obtaining a Mining Permit, Seconded by Floyd Roden, all Board Members voted in favor of the motion. Nancy and Wilfred Duerr appeared before the Board to request a Conditional Use Permit for a Home Extended Business of Water Softening & Conditioning. They own 40 acres of Ag Land, PID 214-000-253400, at 11230 70th St NE. They have a building to house salt, water and conditioning supplies, have one employee and two trucks. Motion by Douglas Lindenfelser to approve the application of Nancy and Wilfred Duerr for a Conditional Use Permit for a Home Extended Business of Water Softening & Conditioning. Seconded by Floyd Roden, all Board Members voted in favor of the motion. Minnegasco has applied for a permit to install gas lines in Mississippi Parkwood. Motion by Floyd Roden to approve the application of Minnegasco for a permit to install gas lines in Mississippi Parkwood contingent upon if the gas lines interfere with future road maintenance or construction, and future sewer and water lines, the gas lines shall be moved at Minnegasco's expense. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the motion. Dennis McAlpine appeared before the Board in regard to his application for a lot line adjustment to add 2 more acres to his 1.3 acre lot PID 214-000-22401, in Sec 21, Range 23. Motion by Douglas Lindenfelser to approve the application of Dennis McAlpine for a lot line adjustment to add 2 acres to his 1.3 acre lot. Page Three Peggy Croteau appeared before the Board to request renewal of their Farm Accessory Mobile Home Permit (Tom and Peggy Croteau). She stated they are still operating the farm and his mother lives in the main house on the farm located in the SW 1/4 quarter of Sec. 36, Range 23. Motion by Floycl Roden to grant Tom and Peggy Croteau a year extension of their Farm Accessory Mobile Home Permit. Seconded by Doug Lindenfelser, all Board Members voted in favor of the motion. Motion by Floyd Roden to have Taylor Land Surveyors prepare a Legal Description of Otsego Township for presentation to the State Municipal Commission. Seconded by Norman Freske, all Board Members voted in favor of the motion. Motion by Douglas Lindenfelser to pay a fee of $600.00 to the State Municipal Commission in conjunction with the petition to grant the Town of Otsego the right to incorporate. Seconded by Norman Freske, all Board Members voted in favor of the motion. Attorney Andy McArthur presented the Board with a petition proposing Township enforcement of the State Building Code. A Public Hearing would need to be held before the State Building Code could be adopted and a 30 clay notice of intent to hold such a Hearing would be required to the State Commissioner of Administration and the Co. Auditor before the date of the Hearing. After the Hearing is held an Ordinance could be adopted providing for the Administration and Enforcement of the State Building Code. Mr. McArthur requested the board to consider the petition and make a decision at their next Board Meeting. Bill Radzwill reviewed the contract with Architect Don Meinhardt for the new Town Hall project. He recommended that the Architect not be the Construction Manager for the project. He also recommended that the contract call for the Architect to prepare the plans and specifications and advertise for bids on the project. He also recommended Builders Risk Insurance be in force when construction starts. Motion by Norman Freske to hire Don Meinhardt as Architect for the New Town Hall. Seconded by Floyd Roden, all. Board Members voted in favor of the motion. Randy Pouliot and Elmer Hagel applied for renewal of their Farm Accessory Mobile Home Permit. Motion by Douglas Lindenfelser to approve a 2 year extension of the Farm Accessory Mobile Home Permit of Randy Pouliot and Elmer Nagel. Seconded by Floyd Roden, all Board Members voted in favor of the motion.. Wayne White submitted an application for employment as Township Maintenance Man. The Board will keep his ;9onlication on file.
