06-04-1990 Vacation Hearing MinutesSTATE OF MN A Road Vacation Hearing COUNTY OF WRIGHT was held this 4 day of TOWN OF OTSEGO June, 1990, at 7:30 PM. Norman Freske, Chairman, Floyd Roden and Douglas Lindenfelser, Supervisors, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk, Jucly Hudson, Secretary, Larry Koshak, Engineer and Bill Radzwill, Attorney, were present. The road to be vacated was Road D of the Otsego Townsite plat and lies between Block 76 and Block 77. The Hearing was called to order by Chairman Norman Freske. Engineer Larry Koshak explained what street was to be vacated. It lies between Block 76 and Block 77 of the Otsego Townsite and is about 320 ft. long. The Street was part of the Otsego Townsite platted many years ago and was never actually built and used as a street. Mario Giordano moved that the vacation of the street be postponed at this time. Attorney Bill Radzwill explained that only the Town Board can make a motion at this meeting. The residents can present facts pertaining to the street and its vacation at this time. Mario Giordano then presented the Town Board with letter signed by 9 Township residents requesting that the vacation of the street be tabled at this time because the sole purpose of the vacation is to reposition or modify the layout of land owned by the Township, and annexing additional land needed to build a new Town Hall and because it will prejudice the outcome of the Hearing with the Board of Adjustment and the Enviromental Assessment Board. Bill Radzwill explained that the title to the Township property has been researched and found that the Township has a clear title to the property. He also explained that the street in question' has never been used as a public road and basically the use of it will stay the same as it has been as the Township owns the property on both sides of the street. Motion by F].oyd Roden to close the Public Hearing. Seconded by Douglas Lindenfelser, all Board Members voted in favor of the motion. Motion by Douglas Lindenfelser to adopt the attached Resolution vacating Road D of the Otsego Townsite. Seconded by Norman Freske, all Board Members voted in favor of the motion. On motion the Public Hearing adjourned. , Norman Freske, Chairman uglas Lindenfelser, Supervisor loyd Roden, Supervisor Attest: Jerome Perrault, Clerk Request by residents to table street vaction in Minute Book RESOLUTION TO VACATE A CERTAIN TOWN ROAD filed .in Minute Book TOWN OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION TO VACATE A CERTAIN TOWN ROAD A a regular meeting of the Otsego Town Board held on the 4t. de, 1990 at the Town Hall in said Town, Supervisor introduced a motion for the adoption of the ollowing esolution. WHEREAS, the Town of Otsego, located in the County of Wright, State of Minnesota, has the authority pursuant to Minn. Stat. Sec. 368.01, Subd. 25 to vacate by resolution any street, alley, public grounds, public way, or any part thereof, on its own motion; and WHEREAS, the Town Board has posted and published notice of a hearing, according to law, and has held a public hearing on the instant date to determine whether it is in the best interest of the Town to vacate the following described portion of a dedicated town road; and WHEREAS, the Town Board, after hearing the concerned residents and abutting property owners has determined that it is in the best interests of the public to vacate the portion of the town road legally described as follows: That part of the dedicated street between Blocks 76 and 77, Townsite of Otsego, according to the recorded plat thereof, Wright County, Minnesota, lying between the extensions of the north and south lines of said Blocks 76 and 77. NOW THEREFORE BE IT RESOLVED, that the portion of the town road as described above be and hereby is vacated by the Town of Otsego. BE IT FURTHER RESOLVED that the Board Chair and the Town Clerk be authorized to execute any necessary instruments of conveyance, conveying the aforementioned described property to the abutting land owner. BE IT FINALLY RESOLVED, that the Town Clerk forward a Notice Of Completion Of The Proceedings to the Wright County Auditor and the Wright County Recorder for further action pursuant to statutory requirements.
