COUNTY OF WRIGHT Council of the City of Otsego was
TOWN OF OTSEGO held this 7 day of February, 1991,
at 3:00 PM. Norman Freske, Mayor,
DouglasLindenfelser, Floyd Roden, Larry Fournier, and Ron
Black, Council. Members, Jerome Perrault, Clerk, Elaine
Beatty, Deputy Clerk, Judy Hudson, Secretary, Larry Koshak
and Pete Raatikka, Engineers, and Andy McArthur, Attorney,
were preSent.
The meeting was called to order by Mayor Norman Freske.
Andy McArthur discussed the proposed Ordinances
concerning the Licensing and Regulation of the sale of Non -
Intoxicating Malt Liquor (beer) within the City of Otsego.
He said the provisions of Minnesota Statute 340A.101 would
he adopted by the City of Otsego and made part of this
Ordinance. This Statute relates to the licensing,
consumption, sale, hours of operation, insurance requirements
and any other matters pertaining to the sale, distribution
and consumption of beer. The City could exclude certain
stores such as drug stores from having Off -Sale licenses.
Licenses could expire on the date set by the Council, however
at the present time County licenses expire at the end of June
each year. License fees would be set by the Council, the
present County fees are $50.00 for an Off -Sale License,
$75.00 for an On Sale License and $25.00 per day for a
temporary license. Refunds of license fees would be made on
a pro -rata basis if the business ceases during the year.
The Ordinance to license, regulate and control the sale
and consumption of Intoxicating Liquor was then discussed.
The provisions of Minn. Statutes 340A will be adopted and
made part of this Ordinance. There will be four kinds of
Liquor License, On -Sale, Off -Sale, Temporary On -Sale, and
Wine Licenses. On -Sale licenses could be issued to hotels,
restaurants, and exclusive liquor stores. An exclusive liquor
store would be required to sell food if it has a combination
On and Off -Sale License. Off -Sale Licenses are issued only
to liquor stores. Wine Licenses can be issued to a
restaurant with a seating capacity of over 25 people and must
be approved by the State Liquor Control Commissioner. Wine
Licenses authorize the sale of wine 7 days a week unless the
City chooses to prohibit Sunday sales. A referendum approval
vote by the City voters is required to permit restaurants to
sell liquor on Sunday.
The licensee is required to provide a Certificate of
Insurance to show proof of coverage for General Liability and
Bodily Injury. The Council agreed to require $1,000,000
coverage for bodily injury to any one person in any one
occurrence, $1,500,000 coverage for 2 or more persons in any
one occurrence, $100,000 because of injury to or destruction
of property, $100,000 coverage for the loss of means of
support of any one person in any one occurrence and $100,000
for the loss of means of support of two or more persons in
any one occurrance.
The Council agreed to set the annual On -Sale Liquor

License fee at $4,000.00. The Off -Sale License fee is set by
the State of $150.00. the Wine License was set at the same
as the County rate but not more than $2,000.00. If the
voters approve Sunday liquor sales, the maximum Sunday
license fee if $200.00. All licenses will be for a period of
one year and will expire on June 30. Licenses are for the
licensee and for the premise indicated on the application
only and are not transferable. All applicants are required
to be investigated as to their qualifications to have a
license and will be required to pay a $500.00 investigation
fee at the time of application. All investigations will be
conducted by the Wright Co. Sheriff's Dept or another
designated investigative agency. A ten day written notice of
suspension or revocation must be given to the licensee and
must contain the time, date and place of the hearing and the
charges against him or her.
All employees of a place with a liquor license must be
at least 21 years old. All employees must be off the
premises by one hour after sales are closed and cannot re-
enter the premises before 6:00 AM the following day.
Larry Koshak and Pete Raatikka discussed MSA Funds.
Larry said he has received notification from MnDot that
Otsego will receive $344,390.00 for construction and
$12,795.00 for maintenance in 1991. Part of the maintenance
apportonment should be coming this month and another 40% in
July.
Needs are based on grading, storm sewer and special
drainage, gravel base, bituminous base, bituminous surfacing,
shouldering, street and signal lights, right-of-way purchase
and Engineering up to 10% of the project cost.
As the City of Otsego will draw $1,700,000 for MSA
Street construction in the next 5 years, the City needs to
develop a 5 year capital improvement program and submit it to
MdDot. Possible projects to consider in the next 5 years
are:

Nashua Ave. from Co. 39 to 85th St
Nashua Ave. from 85th to 77th St
Quaday Ave. to Co. 42 -----
Packard Ave from Co. 39
to Miss. Shores 5th Add. --

Right of way purchases and traffic lights can be
included in the construction cost. Nashua Ave. from CO. 39
to 85th St. could be considered as an MSA construction
project for this year.
Larry advised the Council there is a possiblity that the
construction of Hwy 101 could be delayed another 2 years and
he thinks the City should apply for funds to construct the
access roads and submit the application this year.
Motion by Ron Black to submit an application

to MnDot for funds to construct access roads for Hwy 101.
Seconded by Floyd Roden, all Council Members voted in favor
of the motion.
The Otsego Town Board agreed on Oct. 18, 1990, during a
meeting with Wright Co. Engineer Wayne Fingalson to take over
Co. 37 from Co. 39 to Co. 122 and make it a City Street.
Motin by Floyd Roden to adopt the attached Resolution which
formalizes the takeover of that part of Co. 37 making it a
City of Otsego St. Seconded by Larry Fournier, all Counci]
Members voted in favor of the motion.
On motion the meeting adjourned.
