CITY OF OTSEGO surfacing of 87th St. and O'Brian
Ave. was held this 24 day of June,
1991, at 6:30 PM prior to the regularly scheduled Council
Meeting. Norman Freske, Mayor, Doug Lindenfelser, Floyd
Roden, Larry Fournier and Ron Black, Council Members, Jerome
Perrault, Clerk, Elaine Beatty, Deputy Clerk, Judy Hudson,
Secretary, Larry Koshak, Engineer, and Bill Radzwill,
Attorney were present.
The Informational Meeting was called to order by Mayor
Norman Freske.
Engineer Larry Koshak, addressed the meeting and said a
feasibility study on 87th St. and O'Brian Ave. was done in
1983 for a 22 ft. wide mat 2 inches thick with no allowance
for shoulders and the project was turned down at that time.
He said he has updated the feasibility study to a 32 ft. wide
subgrade with a 24 ft, wide mat 3 inches thick to make it a 9
ton road at an estimated cost of $116,350. There are 26 lots
affected and assuming an assessment of $2,500.00 per lot this
would be $65,000 with the City share of the project to be
$51,350. There are drainage problems along the South side of
87th St. and Mr. Koshak said he has allowed $15,000 to solve
the drainage problem. He said he would not recommend
rebuilding the road without solving the drainage problem. HE
also said the project could be started this fall with
subgrade and base gravel done this fall and the bituminous
mat put on next spring. Doug Lindenfelser commented that he
would prefer to wait until spring and do all the project at
one time.
Motion by Floyd Roden to table the 87th Street and
O'Brian Ave. project until more information is obtained on
drainage along 87th St. Seconded by Larry Fournier, all
Council Members voted in favor of the motion.
Donald Huss, a resident of 87th St. asked about the
possibility of getting dust control on 87th St. this summer.
Mayor Norman Freske said that according to figures he has
obtained it takes 3168 gallons of calcium chloride per mile
and by buying it by the tanker load it can be obtained for
.69 a gallon applied. According to these figures, it would
cost each resident of 87th St. between $60 to $65 to have the
calcium chloride applied. Mr. Huss was asked to contact his
neighbors to see if they were willing to pay for having the
calcium chloride applied as the City would like to have the
money up front before ordering the calcium chloride.
At this time (7:30 PM) the regular Council Meeting was
called to order by Mayor Norman Freske. Treasurer James
Barthel was now present.
Motion. by Doug Lindenfelser to approve the Minutes of
the June 10, 1991, City Council Meeting. Seconded by Floyd
Roden, all Council Members voted in favor of the motion.
Dave Montebello of the Wright Co. Highway Dept. appeared
before the Council regarding the Co. 42 -Co 39 intersection.

intersection complied by the Sheriff's Dept. since 1987. He
also said that wiring for signal lights was put in when the
intersection was rebuilt last year. He also had a letter
from MnDot recommending 45 MPH speed limits on Co. 39 in that
area with a 4 way stop at the intersection using 4 way
flasher lights, 12 inch red flasher lights above a 48" Stop
Sign.
Dave Montebello presented some figures on the estimated
cost of the flasher system as follows:
4 - 8" flasher heads @ $80.00 320.00
1 flasher controller.................. 285.00
Installation cost 1,500.00
TOTAL " 105 00
Other costs: Addition of 48# Stop Signs on East and West
Bound Co. Rd 39 and Stop ahead Pavement Markings
$1,000.00
He estimated the electric cost for the flasher system at
$25.00 per month.
The Wright Co Highway Dept is proposing a 50-50 cost
share with the City on the installation cost with the City to
pay the electric cost and upkeep.
Ron Black asked what the rationale was for the City to
pay half the installation cost when both of the highways at
the intersection were County Highways.
Dave Montebello said the reasoning was that alot of the
traffic is local, also the City is the one requesting the
stop lights and should expect to pay a share.
Dave Montebello was asked what a full signal system for
the intersection would cost and he replied an estimated
$80,000.00
The Council requested Dave Montebello to obtain more
complete cost figu7-nn on the flasher system.
Joy Swenson appeared before the Council regarding the 14
month Historical Calendars the Vision Committee is planning
on having made to sell at River Fest Days. She said Kraemer
Associates has agreed to make the calendars at less than
$2.00 per calendar.
On behalf of the Vision Committee she requested a loan
of $1,200.00 from the Council to cover the cost of the paper.
She estimated they would have to sell 700 calendars to break
even.
Motion by Floyd Roden to loan the Vision Committee
$1,200.00 to have calendars made. Seconded by Doug
Lindenfelser.
Ron Black asked who would repay the loan if the calendar
sales failed to materialize. Mrs. Swenson said the Vision
Committee was optimistic that sales would go well,Mrc_1,(,

themselves from being sued individually in case of misfortune
at River Fest Days.
All Council Members voted in favor of the motion. Linda
Kadlec has not responded to repeated requests to appear
at the City Hall, to sign the Animal Control Contract with
the City of Otsego.
Motion by Ron Black to rescind the agreement with Linda
Kadlec. Seconded by Doug Lindenfelser, all Council Members
voted in favor of the motion.
Larry Corson, who owns River View Kennels on Kadler Ave.
was present and said he would be willing to let the City use
the Kennel for an animal shelter for dogs picked up until
Kathy Roberts could take them to the Humane Society. Mr.
Corson said that because both of them work they would not be
able to pick up dogs. He would charge the City a flat rate
of $25.00 for boarding dogs and $7.00 per day for dog owners
who re-claimed their dogs. He said he would be willing to
work with the City under this arrangement until the City
could hire a Dog Catcher.
Mindy Ellison was present and said she would like to
apply for the Dog Catcher position. She has an 11 acre hobby
farm and would like to build Kennels and house the dogs at
her place. In the meantime, until she has the kennels built,
she would like to work with River View Kennels.
Pam Novatony, who lives on a small farm on Co. 39 was
present and said she is also interested in the Dog Catcher
position. She has a barn on her place that she would covert
into a kennel.
Copies of the Animal Control Contract were given to the
applicants.
Motion by Larry Fournier to employ River View Kennels
for the present at a flat rate of $25.00 for boarding ($7.00
per day for dogs redeemed and paid for by the dog owners)
with proof of insurance to be provided and to interview - the
2 applicants for the Dog Catcher position. Seconded by Doug
Lindenfelser, all Council Members voted in favor of the
motion.
The Council will interview the 2 applicants prior to the
next Council Meeting on July 8.
Larry Koshak reported to the Council on the MSA meeting
he had attended in St. Cloud. He presented the Council with
a listing of all the MSA Cities in the State and how the MSA
Funds were apportioned to each of them. The City of Otsego
will lose $26,608.00 in MSA Funds next year because the 1990
Census was lower than the projected population. The funds
can only be used for MSA streets and some changes have been
made in the standards such as reduced curbed street width
from 32 ft to 28 ft. Larry also said that the State is going
to start penalizing Cities who do not use their MSA Funds.
The City will need a contract on the Nashua Ave project by

committed projects, the State can take MSA money away from
the City. Larry also said they gave him a unit price listing
to be used when preparing the Needs Study.
Larry Koshak said he also discussed the Wright Co.
Highway Dept. Cost Sharing Policies with the Engineers from
Buffalo and Monticello. There seems to be a possibility that
Wright Co. is getting State Funding on some projects and then
requesting the Cities to cost -share the same projects. He
suggested that the City Council set up a meeting with the
Administrators of Buffalo and Monticello to discuss this
problem.
Bill Radzwill introduced Stan Elison, a new employee in
his office who has been working on the Solid Waste Ordinance
for the City of Otsego. Mr. Elison presented the Council
with copies of the proposed Ordinance and comment sheets
explaining the Ordinance. He said the Ordinance states the
Council's intent to conform the Ordinance to the requirements
of the Minnesota Solid Waste Management Act and to provide a
safe and healthy environment for Otsego. It also establishes
the Ordinance assigns the responsibility for the storage and
collection of waste to the generator and contracted collector
and removes the City as a participant in the waste handling
process. The Ordinance regulates waste generators, sets
standards for containers and also regulates the waste
collectors. Collectors are licensed by the State and County
and are issued permits by the City to operate within the
City. To obtain a license the Collector must be bonded and
be covered by Liability and Workmens Comp. Insurance. The
Ordinance also requires Collectors to charge fees an a volume
basis rather than a flat rate and also make Collectors
responsible for any damage caused by their actions. The
Ordinance establishes mixed municipal waste, yard waste and
recyclable materials as the only waste acceptable for regular
collection and also governs the collection and disposal of
yard waste as well as hazardous waste. The Ordinance also
governs recycling, requires collectors of recyclables to
obtain a City Waste Collectors license and provide curbside
pickup. Disposal of mixed municipal solid waste originating
from domestic use and deposited on the same property where it
originated is exempt from the Ordinance. Yard waste
composting facilities are allowed by the Ordinance and
standards are set for their operation and licensing as well
as land spreading of yard waste.
The Ordinance also governs the location of Waste
Disposal Facilities prohibits them from being located on a
flood plain or wetland, and prohibits the location of any
Waste Disposal Facilities within the City with the exception
of yard waste composting facilities.
The Ordinance is written so that it can be revised by
F;ections without re -doing the entire Ordinance. Planner Dave

Motion by Larry Fournier to adopt the Interim Ordinance
extending the moratorium on the construction of certain
accessory buildings within the R-1 residential areas of the
City. Seconded by Doug Lindenfelser, all Council Members
voted in favor of the motion.
Motion by Floyd Roden to approve renewal of the Off-Sale
Liquor License of Riverview Liquorette (Warren Phillips).
Seconded by Ron Black, all Council Members voted in favor of
the motion.
Motion by Ron Black to approve Renewal of the Wine
License for Riverwood Conference Center. Seconded by Larry
Fournier, all Council Members voted in favor of the motion.
Motion by Doug Lindenfelser to approve renewal of the
Beer License (non-intoxicating malt liquor) of Tom Thumb,
Inc. Seconded by Floyd Roden, all Council Members voted
in favor of the motion.
The Council discussed dust control on the graveled City
roads. Calcium chloride is available for .69 a gallon in
tanker loads and is spread at the rate of 3168 gallons per
mile for a cost of $2,185.92 per mile. The Council felt the
property owners should pay for dust control and would prefer
the money up front before ordering the calcium chloride
applied. The Council decided to wait until the July 8
Council Meeting to sec how much interest there is in dust
control before making a decision on ordering the application.
Insurance Agent Bruce Gagnelius has requested the
opportunity to present the Council with a quote to provide
insurance coverage for the City of Otsego. The Council
okayed his request.
Motion by Doug Lindenfelser to approve purchase of a New
Holland No. 442 Disc Mower from Bergstrom Bros. Inc. of
Buffalo, MN for $3,000.00 plus trade-in of the old mower.
Seconded by Larry Fournier, all Council Members voted in
favor of the motion.
Motion by Larry Fournier to appoint Norman Freske and
Doug Lindenfelser as Otsego Council Representatives on the
Sewer Study Committee in conjunction wit the City of Elk
River. Seconded by Floyd Roden, all Council Members voted in
favor of the motion.
Larry Fournier commented that the thought the Council
should pursue hiring a Building Inspector for the City. Ron
Black and Norman Freske have been appointed a Committ
pursue this.
Proceeding as a board of audit, the City Council audited
and allowed verified accounts Nos. 523 to 555 inclusive.
