COUNTY OF WRIGHT Otsego met this 8TH day of July,
CITY OF OTSEGO 1991 at 7:30PM. Norman F Freske,
Mayor, Doug Lindenfelser, Floyd
Roden, Larry Fournier and Ron Black Council Members, Jerome
Perrault, Clerk, James Barthel, Treasurer, Elaine Beatty,
Deputy Clerk, Judy Hudson, Secretary, and Larry Koshak,
Engineer, were present.
The meeting was called to order by Mayor Norman Freske.
Motion by Larry Fournier to approve the Minutes of the June
24, 1991 City Council Meeting. Seconded by Floyd Roden, all
Council Members voted in favor of the motion.
Kevin LaFeber, of Business Records Corp, appeared before
the Council to discuss and demonstrate the Optech 111-P
Automated Voting Machine. He demonstrated how the voted
ballots are fed into the machine and how the machine will
reject any ballot not properly marked. The ballots are
tabulated the instant they are placed in the machine and the
tape with all the totals tabulated on it is removed after the
polls close just by turning a key. The machine has to be
programed before each election and also has to have a public
accuracy test before each election. They have an office in
St Cloud that will provide service for this area and could
have a backup machine available within an hour if for any
reason the machine would malfunction. The machine is
certified by the State as an approved Voting Machine, Mr
LaFeber advised the Council they have used machines available
at this time for $4,900.00 and are warranted the same as a
new machine. This offer will be good until Sept 1, 1991.
Ron Black asked how long the technology of the machine had
been in existence and he was advised for six years. The
Council will consider the offer and make a decision before
September 1, 1991.
Elk River Fire Chief Russ Anderson and Finance Director
Lori Johnson appeared before the Council to discuss the Fire
Dept Protection Contract between the City of Elk River and
the City of Otsego. Mr Johnson explained that Otsego's
percentage of the Fire Dept's total fire calls for the
previous year is used as the percentage figure to determine
the Otsego Fire Protection Contract fee for the current year.
This percentage figure is applied to the yearly operating
budget plus the firemen's turn out gear with a five year
depreciable life plus the firemen's individual equipment
(radius) with a depreciable life of ten years plus the fire
trucks, tankers and other equipment with a depreciable life
of twenty years, plus the Fire Dept buildings with a
depreciable life of twenty years, plus the Administrative fee
which is calculated at ten percent of the operating budget.
Only fifty percent of the Fire Chief's salary is used when
calculating Otsego's share of the budget. If, at the end of
the year, Otsego's share of the total fire calls is less than
the percentage used to calculate the contract fee, a refund
will he given and applied to the contract fee for the
following year. By the same token if the percentage figure

following year. By the same token, if the percentage figure
is too low, the additional fee will be added to the contract
fee for the following year. The cost of the new ladder truck
and the building to house it are not figured in when
calculating Otsego's share, Larry Fournier asked what the
percentage of fire calls was so far for this year? Russ
Anderson explained that the figure was not available at this
time, but he did say the number of calls for accidents on
Highway #101 has dropped sharply this year, possibly because
of the new signal lights at Highway #101 and County Road #42.
Motion by Ron Black to approve the 1991 Fire Dept
Protection Contract with the City of Elk River. Seconded by
Floyd Roden, all Council Members voted in favor of the
motion,
Larry Corson of River View Kennels was present to say
that he wanted to advise the Council that he had a visit from
the Deputy Sheriff on July 4 in response to calls from some
of his neighbors complaining about dogs barking in his
kennel.
Pam Novotny appeared before the Council to apply for the
Dog Catcher Position, She lives on a small farms on County
#39 and plans to convert the barn into a kennel. She has
very few close neighbors. She requested an hourly rate of
$8,00, mileage at $.26 per mile and has a Suburban Van she
will use to pick up dogs, Larry Fournier asked her if she
had any experience and if she was committed to doing the job.
She replied that she has cared for her own dogs, but has not
had experience as a Dog Catcher and if hired, she will stick
to the job. The Council advised her they will consider her
application and advise her of their decision.
Larry Koshak was present and showed the Council maps
which indicated the additional fourteen feet of right-of-way
needed to rebuild Nashua Avenue as an MSA Street. His plans
are to acquire the additional fourteen feet on the West side
of Nashua and while Nashua does not follow the quarter line
very consistently, it would be difficult to change it now.
After the rebuilding of Nashua is completed, he will file a
plat of the road which will supersede the way Nashua Ave is
now registered. The hill on 85TH ST as it approaches Nashua
Ave needs to be cut down and Mr Koshak recommended curb and
gutter on that portion of 85TH ST after the hill is cut down.
He recommended that the Council set up a Public Hearing on
the rebuilding and bituminous surfacing of Nashua Avenue
from Co 39 to 83RD ST and also to consider what assessment
policy the Council plans to use for MSA streets.
Motion by Floyd Roden to hold a Public Hearing on the
proposed reconstruction and bituminous surfacing of Nashua
Avenue from Co 39 to 83RD ST on August 19, 1991 at 730 PM.
Seconded by Ron Black, all Council Members voted in favor of

the motion.
Larry Koshak also reported that the Packard Ave project
has still not been started and he is pressing the Contractor
to get started as there is a time limit on the contract.
Larry Koshak also discussed with the Council the
possibility of doing a Storm Drainage Study in the West and
Southwest areas of the Halls Pond Watershed which would
include 87TH ST and 85TH ST. He said the study would be
limited to a concept design, locating ponding areas, pipe
sizing, and to provide elevations to identify flow direction.
He estimated the cost of the study and concept plan to be
about $4,000.00. The Council will consider the Drainage
Study plan and make a decision on ordering it at a later
date. Larry Fournier asked if there was any Grant Money
available from the State or DNR for Watershed and Drainage
Studies and Larry Koshak advised him there was none
available.
Donald Huss has advised the Council that none of his
87TH ST neighbors were interested in paying for dust control.
Motion by Douglas Lindenfelser to increase the
Cigarette License Fee from $12.00 to $25.00 per year.
Seconded by Ron Black, all Council Members voted in favor of
the motion.
Motion by Ron Black to apply to the DNR for a Grant to
adopt a Shoreland Management Ordinance consistent with State
wide standards. Seconded by Floyd Roden, all Council Members
voted in favor of the motion.
Under a new Federal Law, elected Council Members and
also the Treasure, are required to pay Social Security and
Medi -Care or else have the option of paying into a PERA
retirement plan and Medi -Care on earnings after July 1, 1991.
The Council chose to pay Social Security and Medi -Care.
Motion by Doug Lindenfelser to approve the request of
Dave Chase and Duane Fiedler to rent a Hydro -Hoe from
Ziegler, Inc for one month for approximately $3,500.00.
Seconded by Floyd Roden, all Council Members voted in favor
of the motion.
Motion by Larry Fournier to commit to the District Wide
Recreation Program of District $1728 (Elk River) which
includes paying a share of the salary of the Recreation
Director, with the understanding that the Council would also
commit to similar Recreation Programs if offered by the
School Districts of Monticello and St Michael -Albertville.
Seconded by Ron Black, all Council Members voted in favor of
the motion.
Proceeding as a Board of Audit, the Council audited and
allowed Verified Accounts Nos. 556 to 603 inclusive.
