10-28-1991 City Council MinutesSTATE OF MN The City Council of the City of COUNTY OF WRIGHT Otsego met this 28 day of Oct. 1991 CITY OF OTSEGO at 7:30 PM. Norman Freske, Mayor, Doug Lindenfelser, Floyd Roden, Larry Fournier, and Ron Black, Council Members, Jerome Perrault, Clerk, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk, Judy Hudson, Secretary, Larry Koshak, Engineer, and Mike Couri, Attorney, were present. The meeting was called to order by Mayor Norman Freske. Motion by Floyd Roden to approve the Minutes of the Oct. 14, 1991, Council Meeting. Seconded by Doug Lindenfelser, all Council Members voted in favor of the motion. David Foster, of Polka Dot Recycling, appeared before the Council in regard to renewal of the Recycling Contract with the City of Otsego for 1991. Mr. Foster said the people of Otsego have been doing a great job recycling with the participation rate very high compared to other communities. Norman Freske asked Mr. Foster of his opinion of less frequent pickups such as every 3 weeks or every month instead of every 2 weeks. Mr. Foster said it would not be much cheaper as it would require more trucks and men on the day they did the pickups because of the greater quantities on those days, probably about $200.00 per month less. Mr. Foster also said that people prefer more frequent pickups. Larry Fournier asked him what it would cost to recycle plastic and Mr. Foster replied about $495.00 more per month because plastic is so bulky. Elaine Beatty asked him if he would accept plastic if people brought it to his place of business and MR. Foster said he would for the small charge of 5 cents a pound. Norman Freske asked what his price would be for 1992 and Mr. Foster replied the same as this year, $1,500.00 per month for every 2 weeks pickup. Larry Fournier asked him about the possibility of having plastic pickup every 6 months and Mr. Foster replied having people drop plastic off at his place would probably work out best. Clerk Jerome Perrault again asked Mr. Foster to provide the City with a Certificate of Insurance to show he was covered for Workmens Compensation Insurance as his failure to do so had cost the City an additional $1,616.00 in Workmens Comp. Ins. premiums for the past year. Mr. Foster promised to provide the certificate within a few days. Motion by Larry Fournier to approve a contract with Jerry Olson of Big Lake, MN to provide Building Inspection Services to the City of Otsego until Dec. 31, 1992. Seconded by Ron Black, all Council Members voted in favor of the motion. Motion by Ron Black to adopt the following Resolution: Be it resolved that the City of Otsego hereby requests Wright CO. to transfer all Wright Co. Planning & ZONING records regarding Otsego to the City of Otsego. The motion was seconded by Floyd Roden, all Council Members voted in favor of the motion. Larry Koshak reported on the progress of the Packard Ave. Construction project. He said the bituminous has been laid and it look like a very good job. Buffalo Bituminous hauled more base gravel than the Contract called for but the City is liable for only the Contract amount. There is still driveway work, replacing top soil and dormant seeding to be done. Larry Koshak also reported that he attended the MSA Screening Committee Meeting in St. Cloud. He said Otsego will received $24,583.00 less in MSA funds in 1992 than in 1991 because the 1990 Census was less than the estimated population of Otsego. Larry Koshak also said he would like to have a Work Session Meeting with the Council, preferably before December, to discuss how to plan for the use of MSA funds for next year. IT is possible to draw up to 25% of the MSA Funds for maintenance and the maintenance money can be used for any City streets. We also need to discuss road standards, driveway standards and drainage problems. Motion by Larry Fournier to have a Workshop Meeting with Engineer Larry Koshak on Wednesday Nov. 6, 1991, at 3:30 PM. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Larry Koshak said he is also planning on having an Information Meeting at the City Hall with landowners involved in the service road along Hwy 101. Ron Black asked Mr.Koshak when the construction of 85th St. from Page Ave. to Co. 42 fits into the MSA Street Plan as the Elk River School District is concerned about this. Larry replied that this was to be the second MSA Street Construction project beginning next year, however the City still does not have a signed Agreement to be assessed and a right-of-way easement from the Lefebvre Family. Mike Couri presented the Council with a draft of the Sewage Disposal Ordinance which the Radzwill Law Office has prepared for the Council to read over and discuss. The first paragraph in the Ordinance states that the design of sewage treatment and disposal systems shall comply with the minimum standards set forth in Minnesota Rules Chapter 7080, Minnesota Pollution Control Agency, Water Quality Division, Individual Sewage Treatments Systems Standards. The City Building Inspector is required to approve the site and location of and inspect the construction of residential on site systems. The City Engineer is required to renew plans for on site sewage disposal systems for commercial, industrial and residential cluster applicants. The City Building Inspector has the right to reject any application for an on-site disposal system that does not meet the regulations set forth in this Ordinance. The council needs CITY OF OTSEGO CITY COUNCIL MEETING OF OCTOBER 28, 1991 PAGE 3 to decide how often on-site residential systems will be required to be pumped. Mike Couri also presented the Council with a draft of the proposed Nuisance Ordinance for them to review and study. The Council advised Mr. Couri that a section will need to be added to the Ordinance to address the problem of junk cars sitting on residential lots. Doug Lindenfelser questioned Item D in Section 6-2-2 which in effect required all animal carcasses to be removed with 24 hours. He said this could present a problem for farmers because rendering trucks do not operate on weekends. Ron Black suggested leaving the 24 hour limit in the Ordinance and making an allowance for farmers confronted with a weekend problem when fining violators of this Ordinance. Lengthening the time limit would only encourage people to take advantage of it. Mike Couri also advised the Council that as far as he knows, no formal appeal of the Judge's decision has been filed concerning the Halls Storm Drain court case. Mike Couri also presented the Council with a draft of the resolution he has prepared which would encourage the Elk River and St. Michael -Albertville School Districts to modify their District boundaries which at the present time are very irregular and inconsistent. The modification would improve the efficiency of student transportation and reduce the duplication of bus routes. Motion by Larry Fournier to adopt the Resolution encouraging the Elk River and St. Michael -Albertville School Districts to modify their District boundaries. Seconded by Ron Black, all Council Members voted in favor of the motion. The full text of this Resolution is attached to these Minutes. Motion by Doug Lindenfelser to set the 1992 per unit assessment for Fire Dept Protection at $35.00 for the City of Albertville Fire Dept. service area. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to assess each unit in the City $10.00 per year for re -cycling, contingent upon MR. Radzwill's opinion that the assessment would be legal. Seconded by Larry Fournier, all Council Members voted in favor of the motion. John Anderson appeared before the Council in regard to his land on the South side of CO. 39 that the Council has indicated an interest in purchasing for a site for the new City Hall. He said he is asking $80,000 for the approximately 17 acres of land based on the assumption that he could get 8 residential lots on his property after the new segment of Nashua Ave is constructed. He feels he could get 8 lots because the land was platted as part of the original Otsego Townsite. Because the land has been used for farming. CITY OF OTSEGO CITY COUNCIL MEETING OF OCTOBER 28, 1991 PAGE 4 under the present Comp. Plan it is zoned one lot per 10 acres. The Zoning interpretation on this property will need to be resolved. John Anderson and the Council agreed that the MSA money received for the easement across his property to build the new segment of Nashua Ave. would go to the City if the City purchased his property prior to the finalizing of the easement purchase. Judy Hudson had a question for the Council concerning permit fees for the construction of garages. According to the State Building Code, the permit fee for a 1500 sq ft detached garage would be over $400.00 based on a Building Code rate of $15.00 per sq ft. The Council advised her to check with the Assessor to see what the per sq ft valuation rate he uses to determine the valuation of garages. The Council also advised her that a reduction in the Plan Review charge could be considered as Plan Review for a garage requires little time. Proceeding as a board of audit the City Council audited and allowed verified accounts Nos. 881 to 906 inclusive. On motion the meeting adjourned.
