01-11-1993 City Council MinutesSTATE OF MN The City Council of the City of COUNTY OF WRIGHT Otsego met this 11 day of January, CITY OF OTSEGO 1993, at 7:30 PM. Norman F. Freske, Mayor, Doug Lindenfelser, Floyd Roden, Larry Fournier, and Ron Black, Council Members, Jerome Perrault, Clerk, James Barthel, Treasurer, Elaine Beatty, Deputy Clerk/Zoning Administrator, Judy Hudson, Secretary, Bob Kirmis, Planner, and Larry Koshak, Engineer, were present. The meeting was called to order by Mayor Norman F. Freske. Motion by Larry Fournier to approve the Minutes of the Lefebvre Watershed Public Hearing held December 14, 1992, at 7:00 PM. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Floyd Roden to approve the Minutes of the December 14, 1992, Council Meeting. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Larry Fournier to approve the Minutes of the December 28, 1992 Council Meeting. Seconded by Doug Lindenfelser, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to approve the Minutes of the December 30, 1992, Workshop Meeting. Seconded by Ron Black, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to adopt the following Resolution: Be it resolved that the City of Otsego designates the First National Bank of Elk River, the Bank of Elk River, Security Bank Northwest of St. Michael, First Bank Minneapolis, Norwest Bank of Minneapolis, Edward D. Jones & Co., and the Minnesota Municipal Money Market Fund as the City's official depositories of City Funds. The City Treasurer is authorized to deposit up to two million ($2,000,000) dollars in each of these depositories. Except as to deposits insured by the Federal Deposit Insurance Corp. or protected by collateral or a Corporate Security Bond, the depository shall give Bond to the municipality in at least double the amount to be deposited therein to be approved by the City Council. The City Treasurer shall deposit all or any part of the City's Funds into the depository and withdraw the same where directed by the City Council to do so. Other terms and conditions of deposit will be as decided by the City Council from time to time. Motion by Larry Fournier to adopt the following Resolution: Whereas, the Elk River Star News is a qualified newspaper of general circulation within the City of Otsego; and Be it resolved that the City of Otsego designates the "Elk River Star News" as the City's official newspaper effective immediately, CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993. Page 2 Be it further resolved that all Ordinances and any other matters which are required by law to be published in an official newspaper, and all other matters which the City Council shall deem advisable and in the public interest to be published, shall be published in the Elk River Star News. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Ron Black to appoint Doug Lindenfelser as Vice Mayor. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to appoint Ron Black as Council Representative on the Planning Commission. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to re -appoint Floyd Roden as Council Representative on the Parks Commission. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to re -appoint Ron Black to the District 728 Recreation Board. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Doug Lindenfelser to appoint David Chase as Assistant Weed Inspector for the City. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Ron Black to postpone Item 6.1 of the Agenda (Comprehensive Plan Amendment to include the new District 728 School and 5 acres in the Immediate Service Area) and Item 6.2 of the Agenda (Rezoning of District 728 Property from Ag to INS). Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Floyd Roden to request 75« Impervious Lot Coverage in the Wild and Scenic area West of Hwy 101 in the City of Otsego. Seconded by Ron Black. Ron Black questioned whether we should commit ourselves to any figure under 90% impervious lot coverage until we have got a response from the DNR. Floyd Roden withdrew his motion and Ron Black withdrew his second. Motion by Larry Fournier to table action on Agenda Item 6.3 (Amount of Impervious Lot Coverage in Wild & Scenic Area) until we receive a further commitment from the DNR. Seconded by Ron Black, all Council Members voted in favor of the motion. The Council discussed the Agricultural Land Preservation Program which can be adopted by the City or County. If a farmer signs up for the program, he is eligible for tax credits of $1.50 per acre but he must agree to keep the land in Agricultural use for a number of years and use sound farming practices. Doug Wise, Director of the Agriculture Preservation Program, has offered to come out and make a CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993. Page 3 presentation and explain the program to local farmers. The Council decided to wait until the new City Hall is in use and then request Mr. Wise to explain the program. Ron Black advised the Council that the Otsego Planning Commission would like to become members of the State Planning Association. Motion by Larry Fournier to approve the Planning Commission joining the State Planning Association and to pay their dues to the State Planning Association. Seconded by Doug Lindenfelser, all Council Members voted in favor of the motion. Larry Koshak then discussed 96th Street West of O'Brian Avenue in Hylo Acres. He said the original survey was in error except for the middle lot which was apparently corrected and 96th Street does not follow the road easement except for the middle lot. Also the street only shows a 33 ft wide easement and it should be 66 ft. wide if you would want to improve the street. According to the plat, O'Brian Avenue also has only a 33 ft. wide easement. The City is now maintaining 96th Street. Ron Black commented that we should do more research on the easements for O'Brian Avenue and parts of 96th Street so that we know what the situation is before any real estate sales occur in the area. Larry Koshak said that he and Malcolm Watson had appraised John Lefebvre's property for the 85th Street ROW. The appraised valuation for the ROW is $5,460.00. He said that John Lefebvre would like to have 2 driveway approaches and a fence along the North side of 85th Street. Larry Koshak said that MnDOT has only offered to pay $11,146 to repair 85'th Street, 80th Street and Kadler Avenue for damages sustained by hauling heavy road machinery over them to get to the MnDOT Test Facility Site. Mr. Wasnie, District 3 Materials Engineer, was the person who arrived at this figure. Council requested Larry Koshak to contact MnDOT and advise them this amount was totally unacceptable and to set up a meeting with MnDOT officials as soon as possible to discuss this problem. Larry Koshak said he had been contacted recently by a firm doing some research and planning for the City of Elk River wanting to know if the City of Otsego is still interested in purchasing sewer plant capacity from the City of Elk River. The Council advised him to inform them we are still interested and to keep the lines of communication open with the City of Elk River on this matter. Larry Koshak also discussed whether the City of Otsego should put itself on the MPCA Needs List. Ron Black said he would be reluctant to be on a Needs List when there is little chance of any Grant money being available. Motion by Doug Lindenfelser to table being placed on the MPCA Needs List until further developments. Seconded by Ron Rlack , all Council Members voted in favor of the motion. CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993. Page 4 Larry Koshak advised the Council that the Wright County Board has recently approved a Water Management Plan for Wright County. The Council advised Larry to notify Wright County Planning & Zoning that the City of Otsego is preparing its own Water Management Plan. Motion by Larry Fournier to have the Otsego Planning Commission study the Wright Co. Water Management Plan and begin preparation of on Otsego Water Management Plan. Seconded by Doug Lindenfelser, all Council Members voted in favor of the motion. Larry Koshak advised the Council that there are 2 bad spots, one on Ogren Avenge and one on O'Dell Avenue, where the road is sinking. Gammon Bros. have a test boring rig that could do the soil borings but an engineer would have to analyze the results. Motion by Doug Lindenfelser to hire Gammon Bros. to do soil borings on Ogren and O'Dell Avenue and to have Hakanson Anderson Association, Inc., analyze the soil borings. Seconded by Ron Black, all Council Members voted in favor of the motion. Ron Black discused the 1992 Budget for the District 728 Recreation Program. HE said their income for 1992 was $39,317.86 and their expenses were $29,696.64 leaving a year end balance of $9,671.22. However the director would prefer to have a cash surplus on hand and would prefer to keep the assessments for the participating Cities and townships the same for 1993 as for 1992. Motion by Doug Lindenfelser to table the Recreation District Budget until the next Council Meeting. Seconded by Larry Fournier, a 11`Council Member voted in favor of the motion. Motion by Ron Black to enter into a maintenance agreement with the Wright Co. Highway Department to have the Wright Co. Highway Department maintain O'Dean Avenue (from Co.37 to Co. 39) for the year 1993. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Ron Black to have a Special Meeting with the City maintenance men on February 4, 1993, at 7:30 PM. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Ron Black to table consideration of compensation rates for the Mayor and Council at this time. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Ron Black to pay Clerk Jerome Perrault $1,750.00 per month, $25.00 each for Special Night Council Meetings, $300.00 per month Medical Insurance Allowance, mileage at the IRS rate, and Workers Compensation coverage, FICA and PERA for 1993. Seconded by Larry Fournier, all Council Members voted in favor of the motion. CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993. Page 5 Motion by Larry Fournier to pay treasurer James Barthel $364.00 per month, $25.00 each for Special Night Council Meetings and Seminars, mileage at the current IRS rate, Workers Compensation Coverage and FICA for 1993. Motion by Ron Black to pay Elaine Beatty $15.30 per hour, (retro -active to January 1) 40 hours per week, 8 hours per day, time and one-half for over time, double time on Sundays and Holidays, 10 paid holidays, 5 sick days per year accumulate to 10, 2 weeks paid vacation, Doctor's report required after 3 consecutive sick days, $150.00 per month Medical Insurance, $50.00 per meeting for Council Meetings, $25.00 per meeting for Planning Commission and other Special Meetings, mileage at the current IRS rate, Workers Compensation coverage, FICA and PERA for the year 1993. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Larry Fournier to pay Judy Hudson $13.10 per hour (retro -active to January 1) 40 hours per week, 8 hours per day, time and one half for overtime, double time on Sundays and Holidays, 10 paid holidays, 5 sick days accumulative to 10, Doctors report required after 3 consecutive sick days, $150.00 per month Medical Insurance, $50.00 per meeting for Council Meetings, $25.00 per meeting for Planning Commission and other Special Meetings, 2 weeks paid vacation, mileage at the current IRS rate, Workers Compensation coverage, FICA and PERA for the year 1993. Motion by Ron Black to ay Duane Fiedler $13.10 per hour (retro -active to January 1) 40 hours per week, time and one half for overtime, double time on Sundays and Holidays, 5 sick days accumulative to 10, Doctor's report required after 3 consecutive sick days, 10 paid holidays, $150.00 per month medical insurance, uniforms furnished, Workers Compensation coverage, FICA and PERA for the year 1993. Seconded by Doug Lindenfelser, all Council Members voted in favor of the motion. The Council will be checking the employee point system in the near future to determine if they are in compliance with the payroll equity requirements. A letter was received from the Albertville City Council indicating they would like to meet with the Otsego City CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993. Page 6 Council to discuss providing Fire Department Protection to part of Otsego in 1993. Complaints have been received about the slow ambulance response time to medical emergencies of both Alvin Vetsch and Kenneth Zachman. We do have a signed contract with the City of Monticello for Fire Department Protection for 1993, however it can be revised with a 6 month notice by either party. Ron Black said he thought we should have something in mind when we meet with the Albertville Council. We need to give some thought to long range planning, ie are we interested in a joint venture with the City of Albertville, a jointly owned Fire Department. Larry Fournier suggested we send a letter to Albertville Council indicating we are interested in discussing Fire Department Protection issues with a suggestion that we meet this spring to discuss these issues. Motion by Larry Fournier to have a Special Council Meeting on February 11, 1993, at 7:30 PM to discuss Fire Department Issues. Seconded by Ron Black, all Council Members voted in favor of the motion. Ron Black suggested sending a letter to the new City Council in Elk River and invite them to meet with us some time. Motion by FLoyd Roden to accept the quote of Lefebvre Carpeting to put new carpeting in the Peavey House for $620.86. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Motion by Floyd Roden to accept the quote of the Phil Hutchinson Co., 8902 Wentworth Avenue South, to furnish bathroom accessories for the new City Hall for $1,287.00. Seconded by Ron Black, all Council Members voted in favor of the motion. Competing quote was from Nystrom Contracting at $1',891.00. Motion by Doug Lindenfelser to accept the quote of Mahin Walz Inc. to furnish and install Modernfold Soundmaster #12 Series Folding Partitions with #7 track in Room 111/113 for $6,715.00 and Room 113/114 for $9,960.00. Seconded by Ron Black, all Council Members voted in favor of the motion. The above price does not include the #7 ceiling contact guard. This can be furnished for $472.00, material only, not installed. Competing quote was from W. L. Hall Co. at $21,059.00 for the 2 folding partitions. Floyd Roden gave a progress report and building cost update on the new City Hall. James Barthel presented a Treasurer's report for the month of December, 1992. Proceeding as a board of audit, the City Council audited and allowed verified accounts Nos. 1349 to 1356 and 1 to 65 inclusive. CITY OF OTSEGO CITY COUNCIL MEETING OF JANUARY 11, 1993.
