05-13-1993 Special Meeting MinutesSTATE OF MN The City Council of the City of COUNTY OF WRIGHT Otsego held a Special Council CITY OF OTSEGO - Meeting this 13 day of May, 1993, at 7:30 PM. Norman F. Freske, Mayor, Doug Lindenfelser, Floyd Roden, Larry Fournier and Ron Black, Council Members, Jerome Perrault, Clerk, Elaine Beatty, Deputy Clerk/Zoning Administrator, Don Meinhardt, Construction Manager, and Bruce Podvin of Metro Builders were present. The meeting was called to order by Mayor Norman F. Freske. The purpose of the meeting was to discuss what still needs to be done to finish the City Hall and to address a list of extra charges submitted by Bruce Podvin of Metro Builders. Don Meinhardt addressed the meeting and advised the Council that. the Kitchen cabinets have been ordered and will be installed when they arrive. He then addressed No. 1 on Mr. Podvin's list of extra charges, the Council Room ceiling. The specs called for a smooth finish using clear pine. His original quote was,,$7,995.00 but since sheet rock was used, this should have cost less. Mr. Meinhardt said he would not approve the $1,650.00 extra charge on this. Bruce Podvin said his original understanding was that the ceiling was to be knotty pine which is cheaper. Mr. Meinhardt said he would like to see a detailed material list on this. Item 2 was the Council table which was approved in the amount of $2,300.00. Mr. Meinhardt said he doesn't know why it should be the $4,300.00 that Bruce Podvin is asking. Elaine Beatty will check previous Council Minutes on this item Item 3 was upgrading the wainscoting. Mr. Meinhardt said the product used met the specs but did not exceed them and he did not approve the $600.00 extra charge on this. Item 4 was an extra charge of $350.00 to put steel angle in the pent house. This was put in at Mr. Podvin's suggestion to straighten the walk and Mr. Meinhardt would not approve it because he considered it a job site error. Item 5 was a $3900.00 extra charge for penthouse plywood. This item has been already settled with the pent house facing system contractor. Item 6 was upgrading the front cabinets using maple drawers and 201 doors. Mr. Podvin was asking $2,400.00 for this and Mr. Meinhardt said he would approve $2,300.00 for thls , Item 7 was a $1,560.00 charge for installing plywood under the gypsum board for the sky lites to make the walls stronger. Jerry Olson suggested this and Mr. Podvin did provide the plywood, Mr. Meinhardt said he would like to see quantities, invoices, material prices and time slips before he could decide on this item. Item 8 was an extra charge of $480.00 for installing the folding door track. Mr. Meinhardt said that he questioned whether Mr. Podvin installed the track as the contract did not call for him to install it and that he would check CITY OF OTSEGO SPECIAL COUNCIL MEETING OF MAY 13, 1993. Page 2 invoices to see who did install the track. Item 9 was a $400.00 charge for installing the front closet with shelves. Mr. Meinhardt said he approved the $400.00 extra charge for this. Item 10 was an extra charge of $500.00 to build a deck in the kitchen and add more rods for the center beam_ Mr. Meinhardt said he approved this extra charge. Item 11 was an extra charge of $640.00 to repair exterior doors. Mr. Meinhardt said the panic hardware did not fit and once he was aware of this he had the supplier furnish and install new panic hardware. Mr. Meinhardt said he would contact K & K Sales about this before approving the $640.00 extra charge. Item 12 was a $640.00 extra charge to re -do the paper towel dispenser openings. Mr. Meinhardt said the rough openings were first made the same size as the dispensers and Mr. Podvin had to,move the stud over. He would approve a $150.00 extra charge for this. Item 12 & 14 was an extra charge of $400.00 or skylight repair. Mr. Podvin had to repair the gypsum board caused by a corner bead moving. Mr. Podvin had said the ceiling contractor caused the bead to move. As for as repairing the leak, Mr. Meinhardt said that was remedial work by the installer, Mr. Podvin. Mr. Podvin withdrew his request for an extra charge on these items. The sky light is under warranty for one year. Item 15 was an extra charge of $520.00 to put oak trim around the folding partition council room door openings. Mr Meinhardt said 1 hour of time plus material should have been sufficient and he would approve $200.00 extra for this. Item 16 was an extra charge of $470.00 to put oak corners in rooms 112, 113 & 114. Mr. Meinhardt said it was Mr. Podvin's choice to do this and he did not say he would charge extra for this. The Council approved $112.00 extra for material for this. Item 17 was an extra charge of $4,000.00 to clean up after other contractors. Contracts call for all contractors to clean up their own debris. Mr. Podvin said he kept track of the time his men spent cleaning up for others. Mr. Meinhardt said that we would have the right to withhold from .the other contractors by notifying them and withholding from the final payment. The Council approved $2,500.00 for this and will discuss it with the other contractor. Itern 18 was a $4„000 extra charge for helping unload material for other contractors. Mr . Podvin said his men helped unload doors, hardware toilet partitions, toilet accessories, light fixtures and electrical equipment. The Council approved $2,800.00 for this and will contact J. Becher & Assoc. Electric about unloading material for them. ILirn 19 was a $4,300,00 extra charge for upgrading LiA.hn cabin. The Council approved the $100.00 charge for this. Item 21 was an extra charge of $150.00 to put an oak counter top on the voting booths. Mr. Meinhardt said this was reasonable and the Council approved the $150.00 extra charge but advised Mr. Podvin that one place was damaged and needs to be repaired. Item 22 was to cancel the order for cabinets from Knapp Woodworking. Mr. Meinhardt said he would discuss this with Knapp. Item 23 was to cancel shop drawings frorn Knapp Woodworking. Mr. Meinhardt said he would talk to Knapp about this but he did not think the drawings were ever made. Item 24 was a $2,000.00 extra charge for using clear pine in the front entry and for routering. Mr. Meinhardt said he would not approve anything extra for routering and the clear pine cos.t. an estimated $638.00 more, so $2,000.00 extra would be too much. This item will be checked again by both Mr. Podvin and Mr. Meinhardt. Item 25 was a $450.00 extra charge for factory stained cabinets. This was included as part of the $2,300.00 approved for upgrading the cabinets. Item 26 was an extra charge of $45.00 for a gallon of stain from Pro -co. The Council approved this extra charge. Item 27 was an extra charge of $500.00 for special shop drawings from Pro -co for the Council desk and kitchen. Mr. Meinhardt said these were normal shop drawings expected by an Architect and he would not approve the extra charge. Item 28 was a $500.00 extra charge to repair the front walls by the coiling door area. Mr. Meinhardt agreed that extra construction was needed here and the Council approved the $500.00 charge. The Council also approved $100.00 extra for repairing the walls in the kitchen by the coiling door. Itern 29 was a $100.00 extra charge for cutting holes in the bathroom sink tops. The Council approved the $100.00 charge for this. Item 30 was a $250.00 extra charge for providing plywood backing for electrical panels. Mr. Meinhardt said the electrician provided the plywood and that Mr. Podvin had said he would install it for nothing. This extra charge was waved. Item 31 was a $500.00 extra charge for material price increases during the time the building was under construction. The Council said this was a normal part of business and did not approve the extra charge. As far as his $40 ,000 extra charge for damages on his project, Mr. Podvin said he preferred not to discuss it at this time. Motion by Ron Black to install coiling doors in the kitchen openings. Seconded by Larry Fournier. Mr. Meinhardt recommended getting cost estimates on this, -first and also check the fire rating on the coiling doors. All Council Members voted in favor of the motion. The Council discussed the repair of the windows in the Conference Room and in Elaine Beatty's office as the sills need to be repaired. It was decided to hire Roger Kirscht to do this. The skylight is leaking and a few ceiling tile need to be replaced. Regarding Kiffmeyer's cement work, the sidewalks have been repaired. Questions were raised about the handicap access to the women's bathroom. The disability inspector had recommended removing one stall, however, the Council was reluctant to do this. Don Meinhardt suggested that the wall could be moved 2 feet. There is also some question as to whether the newest handicap regulations apply this building as the building was already under construction when the regulations went into effect. Mr. Podvin presented the Council with a typed 2 page letter substantiating why he was claiming the $40,000 damages on this project citing in particular negligence on the part of the Construction Manager and construction schedule delays. The Council advised Mr. Podvin they would review his claim but would not respond at this time. Larry Fournier commented that any claims would have to verified by invoices and employee time cards.
