06-08-1993 Special Meeting MinutesSTATE OF MIN The City Council of the City of OTSEGO OF WRIGHT Otsego held a special City Council CITY OF OTSEGO meeting this 8th day of .lune, 1993, at 7:30 P.M. Norman F. Freske , Mayor, Doug Lindenfelser, Floyd Roden, Larry Fournier and Ron Black, Council Members, Jerome Perrault, Clerk, Elaine Beatty, Deputy Clerk/Zoning Administrator, Judy Hudson, Secretary, Dave Licht, Planner, and Neil McMillin, Economic Development Manager for Wright --Hennepin Coop Electric Association were present. The meeting was called to order by Mayor Norman F. Freske. Neil McMillin addressed the meeting and introduced Scott Martin, Business Development Manager for United Power Association (UPA) and Alvin Heinz, President of the Wright -- Hennepin. Mr. McMillin said that Wright -Hennepin is interested in the growth of Otsego and the part that they can play in it. Wright -Hennepin is offering a reduced rate to new businesses that use more than 75 KWH per month or to existing expanding businesses that increase their usage by 75 KWH per month. This is a temporary program and at the present time is available for 6 years. Scott Martin discussed the Business Financing Program available from Wright -Hennepin and UPA in addition to the rate reduction. They make loans (70% from UPA, 30% from Wright' -Hennepin) to businesses that may range from $5000 to $200,000 on condition that at least 50% of the loan amount must be provided by other lenders (Banks etc.) The interest rate will generally be the same as the participating lender and the use of funds and cash flow needs. Mr. Martin said that in the future REA may become the RDA (Rural Development Authority) and would then be in a position to finance sewer and water systems if there was any interest in the REA playing a role in that. He also said that the Anoka REA is considering using its computer software to do the sewer and water billing for the City of Ramsey. UPA is prepared to help out in whatever area Otsego and Wright --Hennepin would want assistance. Dave Licht asked if there were any Grants available for a demonstration sewer system which could be put in for the commercial area along Hwy 101 and expanded from that point. Mr. Martin said that there are very few Grants available now, not like it was 10 years ago. Mr. Licht said most of the development in Otsego has been concentrated in the N.E. area of the City and also the newer developments have been required to have a Sub -division plan so that the lots could be divided if sewer and water were put in. The new school being built in Otsego would like to have sewer and water available. The City has the need for new businesses and a place for expanding home occupation businesses to re -locate. Mr. McMillin said that Wright -Hennepin has the software to do billings for the City of Otsego which could include billings for garbage hauling. They also have the software to do mapping, which might be of interest to the City Engineer. Alvin Heinz said that, as an example, Wright -Hennepin made a loan to a business in Annandale that is now doing very well. He invited Vern Heidner, Chairman of the Otsego EDA Advisory Board, and anybody else interested to visit with this businessman and get his version of how the loan system is working. Motion by Larry Fournier to send a formal letter to UPA and to Wright -Hennepin indicating we are interested in co- operating with them to encourage economic development in the City of Otsego and obtain Grants if available. Seconded by Ron Black, all Council Members voted in favor of the motion. Duane Fiedler appeared before the Council to say he was interested in doing the maintenance work on the City Hall and other City buildings as an extra job in addition to his 40 hrs. per week doing street maintenance. The Council advised him they were reluctant to hire him in what would be an overtime situation at this time. They are hiring a third maintenance person soon whose duties will be both building maintenance and assisting with street maintenance and wish to see how this works out before hiring any more additional help. Motion by Floyd Roden to recess the Council Meeting. Seconded by Larry Fournier, all Council Members voted in favor of the motion. Mayor Norman F. Freske reconvened the Council Meeting following the recess of the EDA Meeting. Motion by Ron Black to adopt the "Lease Agreement" as presented which permits the City Council to lease City buildings and to lease office space in the new City Hall with approval of the Otsego EDA. Seconded by Floyd Roden, all Council Members voted in favor of the motion. Motion by Larry Fournier that Paragraph (Priorities for Facility Use) of the Facility Use Policy should read "City Activities are first", all other activities and groups are on a first come, first served reservation basis. Seconded by Norman F. Freske. Motion by Ron Black to adopt Paragraph 11 of the "Rules & Guidelines for use) with the addition of the City Attorney recommendations. (A licensed peace Officer is required to be present at all functions where alcoholic beverages are available). The motion was not seconded. Motion by Norman F. Freske to require a Peace Officer to be present whenever both liquor and music are provided (with addition of the Attorney recommendations). Seconded by Larry Fournier. Norman F. Freske, Doug Lindenfelser, Floyd Roden and Larry Fournier voted in favor of the motion. Ron Black was opposed, the motion passed. CITY OF OTSEGO CITY COUNCIL MINUTES OF JUNE 8, 1993 Page 3 Motion by Floyd Roden to adopt Paragraph 13 of the "Rules and Guidelines For Use" section which provides for the rental of City Facilities to churches. (With addition of the City Attorney recommendations). Seconded by Larry Fournier that additional fees apply to Peace Officer and Building Supervisor. Seconded by Floyd Roden. Norman F. Frske, Doug Lindenfelser, Floyd Roden and Larry Fournier voted in favor of the motion, Ron Black was opposed, the motion passed. Motion by Floyd Roden to leave Item D of the "Category Section" as is, which provides for "Category 11" rental rate for non-resident and profit making groups. Seconded by Ron Black. Ron Black, Larry Fournier and Floyd Roden voted in favor of the motion, Norman F. Freske and Doug Lindenfelser were opposed, the motion passed. Motion by Floyd Roden to approve Item E of the "Categories" section which provides for rental rates for athletic tournaments. Seconded by Larry Fournier all Council Members voted in favor of the motion. Motion by Larry Fournier to include in the Additional Fees section a damage deposit of $200.00, sound system fee of $25.00, Peace Officer fee of $90.00 for 4 hrs., $22.50 per hour additional over 4 hrs. Seconded by Norman F. Freske. Norman F. Freske, Doug Lindenfelser, Floyd Roden and Larry Fournier voted in favor of the motion, Ron Black was opposed, the motion passed. On the "City Hall Use Permit of Rental Agreement", Paragraph 4 add "The renter must also provide Dram Law Insurance. Motion by Doug Lindenfelser to adopt the "City Hall Use Permit & Rental Agreement" including the recommended changes and including the Attorney recommendation for Paragraph 8 to wit: "The renter/applicant agree to indemnify and hold harmless the City and Owner from any and all claims, demands, costs, damages, losses, causes of action or judgements arising out of the use of the premises and all costs and disbursements related to the enforcement of this provision, including reasonable Attorney fees. Further, renter/applicant agrees to indemnify and hold harmless the City and owner from any and all claims, demands, costs, damages, losses, actions, causes of action, or judgements arising out of the dispensation or use of alcoholic beverages on the premises and all costs and disbursements related to the enforcement of this provision, including reasonable Attorney's fees. The renter/applicant is responsible to pay for any clean up costs or damage in excess of the damage deposit. Seconded by Larry Fournier all Council Members voted in favor of the motion. Motion by Ron Black to have Mayor Norman F. Freske serve as a subcommittee to meet with organizations to plan the Open House for the new City Hall.
