12-27-1993 Special Hearing MinutesSTATE OF MINNESOTA The City Council of the City of COUNTY OF WRIGHT Otsego called a Special Hearing CITY OF OTSEGO of the Odean Avenue NE and Co Road #37 Intersection Improvement Project to order by Norman F Freske, Mayor on this 27TH day of December, 1993 at 8PM. Floyd Roden, Larry Fournier,and Ron Black, Council Members were present. Jim Barthel, Treasurer, Elaine Beatty, Deputy Clerk/Zoning Administrator, Judy Hudson, Secretary and Larry Koshak, City Engineer were also present. Mayor Freske asked if the proper notices of the Public Hearing had been posted, mailed and published. Elaine Beatty answered yes they had. At this point, the Hearing was turned over to City Engineer Larry Koshak to explain the project. Larry Koshak stated that this is a Public Hearing and that the process is that he will go over the project and estimated costs and turn it back over to the Mayor for questions. He noted that this is a joint City/County project and Dave Montebello, Assistant County Engineer was introduced. The history is that when we became incorporated, one of the first projects was that the County of Wright traded with the City of Otsego. #122 was changed to #37 and the County put their CSAH funds on #37. #37 was changed to Odean Avenue NE and taken over by the City. The City put Odean on their MSA road system. (From #37 to #39). #37 is designated thru #101 to #42 CSAH. One issue is to delineate between the City and the County streets and eliminate the unsafe curve where there has been numerous accidents and people sliding off the road. It is a major safety issue. (Co #37 and Odean Ave NE intersection) For one quarter mile on each side, the intersection will be corrected and the existing curve and entrance will be obliterated. The proposal is to provide turn and exhilaration lanes at the intersection. Odean will have two 12' lanes and two 10' lanes. Larry explained the island delineation painted on the highway to delineate the turn lane from Odean and also to go thru. Coming the other way there will be the same delineations. There is proposed four lanes on the East side of the intersection. The existing cattle pass on the Kolles property will be replaced with a new cattle pass. 84' of cattle pass will be installed from a salvaged county project. There will be some tree removal along the existing road by Yhanke's property. The dark line on the map represents the new right-of-way line by the Pouti property on Odean. We met with all the property owners at least twice, both the County representatives and Larry Koshak. At the meetings they described the project and alternatives and what they would provide to mitigate damages from construction losses. They put a curve in the road by Pouti's because of the house being so close to the road. They didn't wish to have their landscaping disturbed. Their trees will be removed and placed where they wish. The road is designed for 40 MPH traffic. We will relocate the driveway. Cullinan's property (old school house), we will be removing a building and he will be compensated. We will place the driveway on Odean. The cable company will be required to have their driveway come out on Odean also. On the Kolles property, we will restore accesses as they are. We will have to relocate fencing and do some drainage for the cattle pass. We will allow them an entrance on #37. For Yhanke we talked to them about removing their driveway and giving them a new entrance onto Odell. It will be curbed with no ditch. For the Northrup property there will be some trees removed in the ditch line N of the driveway. There will be a catch basin. The North side of Willie Lindenfelser property, Odell will be paved past Yhanke's entrance to improve site distance. They will cut 6' at the intersection so there are slopes and site distance meets requirements. The road plat will be filed to show the property taken and the property returned. Issues will be addressed with appraisals. Right- of-way plat will be prepared and filed at the County. The appraiser will make an appraisal of the cost of acquiring easements. There is no proposed assessment to property owners. The project cost will be taken out of CSAH and City MSA funding. $210,000 CASH, $101,000 Odean and overhead of $84,000 for $276,124.00 total, with $130,785.00 for the City of Otsego's share. An addendum was prepared. The cost share program would be different than above. The City would have to acquire all right-of-way and pay for a portion of the construction cost. The engineering would be split 50/50 $260,166.00 for Wright Co. and the City would pay $136,744.00. There is not much difference in the two construction break downs. We are looking to continue the project and approval from the Council to take it to the County Board. 1994 construction of the project is hopeful. At this point the meeting was again turned over to Mayor Freske. Mayor Freske stated that he thought the City's share of the cost was a little high. He asked for comments from the audience. DALE KOLLES: How much land on the Kolles Farm are you taking about? Trees on the South will be removed and the appraiser will be out said Koshak. Mr Kolles said shouldn't the land be close to the Industrial Park Land in price? How does it work? Larry Koshak didn't have exact numbers. How much is Cullinan gaining? Larry Koshak showed how much he would gain. MARK KOLLES: On the South side of the school house, we use the ditch for a drive. Will we get a driveway back? LOURI POUTI: I thought we discussed a four way stop. We have a lot of traffic and speeding. Mayor Freske agreed. DAVE MONTEBELLO: Said that the volume of traffic and number of accidents predict that. LOURI POUTI: There will be an Industrial Park in my back yard. Are you thinking of only now. You are'not planning for the future. Larry Koshak said the lanes and turn lanes will speak to the future traffic volumes. If the intersection warrants a 4 -way stop, we would follow Mn/DOT standards. A lighted stop also would be considered when the conditions warrant it in the future. LOURI POUTI: How will you tell people you have a stop sign on Odean and #37. Larry Koshak said the intersection will be lighted, signed and striped. GENE KOLLES: On my dad's property, will the road be downgraded so he can see the traffic. Larry Koshak said we will try to fill MARK KOLLES: Will the cattle pass be now? This is only the preliminary drainage plan. Is there any chance of eliminating the cattle pass? More discussion of the cattle pass and replacing property across the road. MARK KOLLES: On the South side there is a drive to the cow pasture and one drive 50' west of that. Are you giving us that one back? DAVE MONTEBELLO: We look at each one individually and we would like to minimize the ones by the intersection. The field access a lot of times are not used as much as a residential access. JEROME BAUER: Any traffic studies on #37 and Odean to see what the traffic count is now? It seems there should be a study done now to see what the traffic is. DAVE MONTEBELLO: Said he has 1992 traffic counts. It is close to 2,000. Those numbers are factored up to the current year. There is 550 or 600' site distance. KOLLES: The Kolles's have collectively 13 children and they feel a stop sign is warranted. Sadowski's on 85TH has a 4 -way stop. What about loss of trees and how much right of way will be taken? Larry Koshak said no loss of trees there. CONNIE BAUER: Said she is concerned with #37 traffic. She feels someone coming off of Odell onto #37 will have problems getting into the traffic lane. We have that problem on 101 and we are concerned with it here said Bauer. Koshak assured her that the site line would be improved. LOURI POUTI: How many exits need to be considered off of #101. Larry Koshak asked Mr Montebello if there were any projections of #37 to 101? It is being discussed And County wide projections are being done for twenty years into the future. In the next nine months there will be opportunities to address concerns. BAUER: What is the criteria for a 4 -way stop? Answer: 5 -accidents in one year life span said Montebello. They consider that fatalities can happen anywhere. He explained further how it works. Ron Black: With respect to 4 -way stop and safety, 39 & Parrish intersection was completed in the fall of 1989 and the County and City has monitored it and when the need was demonstrated, the four way stop went up. We can assure you the City and County will work together and we can resolve a problem. GENE YHANKE: You have to set on the corner and watch to understand what goes on. The stop sign seems such a small item. You hate to see somebody get hurt. Floyd Roden - If I was engineering the road there would be a stop sign. KOLLES: Why not put the sign in now? Ron Black: We rely on State money and the State says no stop sign. We have to listen. CHAS KOLLES: You eliminated the corner for safety. Why not put in a stop sign. DAVE MONTEBELLO: If you put in a 4 -way stop without a lot of volume, it can be more dangerous than not having one. If the County put one in, there it would be a liability issue Larry Koshak - There will be a remarkable improvement in site distance. Larry Fournier motioned to close the Hearing.
