02-28-1994 Special Meeting MinutesSTATE OF MINNESOTA A SPECIAL COUNCIL MEETING COUNTY OF WRIGHT ON THE CITY'SPERSONNEL E 6:30 CITY OF OTSEGO POLICY was called to PM this 28TH day of February, 1994 by Mayor Norman F Freske. Doug Lindenfelser, Floyd Roden, Larry Fournier, and Ron Black were also present. The City Employees present were Elaine Beatty, Judy Hudson, Carol Olson, from Administration and Duane Fiedler from the Public Works Department. It was agreed that for 1.6.11 and 1.6.12 cross off "In the current year position classification plan", since we don't have a plan. 4.5. Appeals and Hearings (Leave it out) Page 3, Sec 1.8.2 Change August 1, 1987 to "January 1, 1991" Duane Fiedler questioned 3.2.28, Page 6 : One week vacation. This is covered in, 3.2.26 above. Ron noted that the numbering was off. Judy will check it out and change where appropriate. Mayor Freske brought up payday and we get paid the same Friday as we work. He felt there should be a one week delay. It was discussed. RON BLACK MOTIONED THAT EFFECTIVE APRIL STE99 , T THE PAY WILL BE RECEIVED THE FOLLOWING FRIDAY YOU WORK. (ONE WEEK FOLLOWING THE PERIOD OF WORK. LARRY FOLRNIER SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY. Ron Black said he believes if someone is sick they shouldn't be working. He objects to sick leave as vacation, and it should ant be tion. If a accumulated forever. He felt there is abuse when person is gone two days, the third day a Doctors excuse is needed. Larry Fournier said five sick days (accumulated to 15) and paid for if over 15 days he would agree with. He would like to call them Personal Leave Days. Ron Black said if a person goes in for surgery and a person is on bed rest for six weeks, on the sixth day, pay stops. Doug Lindenfelser asked why should the City be responsible sick leave. Ron Black said home rest under Doctors orders should beA pattern of absences would be brought to the Council's attention by the supervisor. Duane Fiedler said if you limit the amount of sick days, you can acrue, it is feasible that you could be under Doctors care and on pain medication and go back to work, and work on heavy equipmentdrugged. RON BLACK MOTIONED TO ADOPT SEC. 3.11 SICK LEAVE WITH MODIFICATIONS 3-11.1 . AMOUNT: EVERY PROBATIONARY AND PERMANENT EMPLOYEE IS ENTITLED TO SICK LEAVE AS NEEDED. SEC 3.11.2: DELETE THE LAST SENTENCE. SEC 3.LL.6 VACATION LEAVE. CROSS OFF THE REST OF THE SENTENANCE. NORMAN F FRESKE SECONDED THE MOTION. MOTION WAS DEFEATED FOUR TO ONE. RON BLACK APPROVED. NORMAN F FRESKE, DOUG LINDENFELSER, FLOYD RODEN AND LARRY FOURNIER OPPOSED. Doug Lindenfelser said "as needed" He feels you should have something more there. It could go on for months. Duane Fiedler said if you give yourself as a good servant for so many years, you shouldn't deprive that person and put them under pressure. that's where the accumulation part comes in. Ron Black asked what happens if a person has been here for a long time and they have saved up the accumulated time and can't return to work because of illness? Larry Fournier is against the motion we should have a set number of days and it is tied in with long term and short term disability. RON BLACK MOTIONED TO TABLE THIS DISCUSSION ON THE PERSONNEL MANUAL. Duand Fiedler said if you are entitled to five sick days a year you should be able to accumulate to a certain number. LARRY FOURNIER MOTIONED TO TABLE THIS PERSONNEL MANUAL UNTIL WE GET INFORMATION ON SHORT TERM AND LONG TERM DISABILITY INSURANCE. FLOYD RODEN SECONDED THE MOTION AND ADDED TO IT WITH LARRY FOURNIERS APPROVAL THAT THE EMPLOYEES COME UP WITH A EXACT PLAN THAT THEY WOULD LIKE TO SEE REGARDING THESE ISSUES, WRITTEN DOWN FOR THE COUNCIL. RON BLACK, DOUG LINDENFELSER AND NORMAN F FRESKE OPPOSED THE MOTION. MOTION DID NOT CARRY. RON BLACK MOTIONED TO PUT THIS PERSONNEL POLICY ISSUE ON AGAIN FOR THE MARCH 28, 1994 at 6:30PM MEETING. FLOYD RODEN SECONDED THE MOTION AND SAIL) EMPLOYEES SHOULD GET A NUMBER TOGETHER THEY AGREE WITH. DOUG LINDENFELSER SAll) WE SHOULD UPGRADE THIS ONCE A YEAR. DOUG LINDENFELSER OPPOSED AND NORMAN F FRESKE, FLOYD RODEN, LARRY FOURNIER AND RON BLACK AGREED. MOTION CARRIED 4 TO 1. RON BLACK MOTIONED TO ADJOURN THE SPECIAL MEETING. No. 94-72 RESOLUTION CITY OF OTSEGO A Resolution supporting increased protection from liability for private landowners who make their land available for public recreation without charge. WHEREAS, Tourism is important to the economy of Minnesota, ranking as one of the top 5 industries, and WHEREAS, Recreational use of lands and waters (hunting, fishing, swimming, boating, camping, hiking, bicycling, snowmobiling, skiing, etc.) plays a primary role in making Minnesota a tourism destination, and WHEREAS, State and local government and for profit enterprises alone cannot provide adequate outdoor recreational opportunities for the public, and WHEREAS, it is necessary to utilize nongovernmental lands in order to have complete recreational trail systems, and WHEREAS, A growing fear of liability and loss of property rights is discouraging landowners from opening up their land for recreational purposes, and WHEREAS, Legislation has been written which would limit liability of private landowners who, without charge, allow recreational use of their property and will be introduced in the 1994 legislative session as H.F. 1757, and RESOLUTION CITY OF OTSEGO - PAGE 2 - WHEREAS, H.F. 1757 would bring Minnesota more in line with at least 30 other states which have recreational use statutes, NOW THEREFORE, BE IT RESOLVED BY THE CITY OF OTSEGO That recreational use of private lands and waters is important to the economic well being of the CITY OF OTSEGO area and That, we do, hereby, support H.F. 1757 which increased protection of landowners who, without charge, allow public recreational use of their lands Adopted this 28th day of February, 1994 ATTEST: CITY OF OTSEGO: 2)- 0,,-j Norman F Freske, Mayor laine Beat,1Deputy C1/ k, Zoning 'Administrator (C1TY,'SE
