02-22-1995 Special Workshop MinutesCITY OF OTSEGO CITY COUNCIL SPECIAL WORKSHOP MEETING OTSEGO CITY HALL FEBRUARY 22, 1995 6:30 PM 1. Mayor Norman F. Freske will call meeting to order. Mayor Freske called the meeting to order at 6:30 PM. Roll Call: Mayor Norman F. Freske, Councilmembers: Ron Black, Larry Fournier, Suzanne Ackerman, Vern Heidner. 2 Meeting turned over to Larry Koshak and Andy MacArthur to explain the Stormwater Drainage Policy. This meeting and discussion were based on the Stormwater Drainage Report dated February, 1995 by Hakanson Anderson Assoc., Inc. The City Attorney, Andy MacArthur went over policy issues that pertain to methods and approaches of how to set up the cost structure for the system. He also went over the proposed amendments and resolutions for Ordinance 24-1 and 12-1. Discussion: CM Black asked what would trigger the implementation of these. The attorney briefly went over the REP ( Residential Equivalent Parcel) and that the REP will be on every parcel and would be evaluated every time a use would change. Some of the PUDs and CUPS being approved could have more of an effect on the trunk system, like a lot of dirt being moved. The City Engineer said that most of the report was done on the Urban Service Area.. He also reviewed that in our Subdivision Ordinance, it already says we can put fees on developers, if there is a particular area that needs trunk improvements, a feasibility report would need to be done, those fees would be assessed through the developers agreement. The one acre splits are addressed in a Resolution Establishing City Policy. Mayor Freske asked if the fees would be different in each district. The Engineer stated that would have to be determined. CM Fournier asked who pays for a new project. Mr. Koshak stated the Impact Fees or development fees or assessments by 444 or 429. CM Fournier asked if there is a way of keeping all options available and both the Engineer and Attorney replied yes. CM Black asked if it would be possible in the future to have storm water runoff systems installed as part of the developers agreement with the City telling them where the pipes go. Mr. Koshak said yes, the City could put the money into a fund until appropriate time or bond and do the project. At times the City may have to complete a project first and then bond for it. Attorney said that the way the policy is written, a subdivision preliminary plat comes in, the Engineer looks at it, the developer enters into a developers Agreement, using a Letter of Credit. Mr. Koshak also stated that a developer can do things without providing the dollars, like ponding on site. It was also pointed out that the City can't assess anyone who has paid an impact fee. City of Otsego Special Workshop Meeting of February 22, 1995, cont'd Page 2 Engineer Koshak stated that they added two districts, the North Mississippi and the South Mississippi Districts, to the Report. The DNR gave the City permission to transfer the 4W Wetland into the Otsego Creek Watershed. The Halls Watershed taxing district basically follows the original District, except for the LuConnic Property, which is in two districts. The Lefebvre Watershed District: if a fraction of land was in the watershed, we went according to property lines. CM Black questioned Section 22, the quarter/quarter just East of Vasseurs Oak Grove, South of 85th, right now its all open, could it be conceivable that boundaries could change, or the reason to change the political boundaries it if became platted? Engineer John Harwood said it could change because of public water improvement going in a different direction. Mr. Koshak stated that there will be three districts that will be under the taxing district: a. Otsego Creek b. Halls c. 'Lefebvres Mr. Harwood pointed out that with the 101 construction the drainage could change somewhat. CM Black thought that the City could at least establish the districts and have the lines drawn for the residents questions and he would support the North and South Mississippi Districts. CM Fournier would also like to see the Rice-Foster Lake District done at the same time. Mr. Koshak went over the Lefevbre's Watershed, South Mississippi and North Mississippi Watershed Districts. Mr. Koshak also went over the new section added to the Proposed amendment to Ordinance 24-1 Regarding Storm Water. Mr. Koshak went over the Proposed Construction Policy , both New and Existing Developments Mr. Harwood explained the Stormwater Facility Planning Policy for Level of Service for Residential Uses, Commercial, Industrial and Institutional Uses and Existing Residential or Commercial Developments. The Resolution approving formulas and methods for determining equivalent areas and the residential equivalent parcel basis for storm sewer cost allocation.. The Council was in support of the additions. Mr. Koshak and Mr. Harwood went over the Letter of January 16, 1995 regarding Standard Unit Measurement of Runoff, a revision to the 12-20-94 Memo, giving the recommended policy. The attachments show examples of evaluations that the council had requested and Attachment A. Mayor Freske asked Mr. MacArthur how should the council proceed? Mr. MacArthur explained that the council can order the public hearing on each policy at the next City Council. The Council should refer to the timetable the attorney has prepared. At the February 27, 1995 City Council Meeting, the attorney recommends approval, and setting public hearings for the following: 1. Public Hearings Regarding Amendments to Fee Sections of Zoning Ordinance and Subdivision Ordinance at Planning Commission for March 15, 1995. 4. Public Hearing Regarding proposed Resolution Establishing Storm Water Drainage Fee for New Developments Including Plats, Minor Subdivisions, and Lot Splits for March 20, 1995. 5. Public Hearing Regarding Proposed Resolution Establishing A Storm water Drainage User Fee Throughout the City for March 20, 1995 Larry Koshak wanted to know how many districts to include. Discussion: The Council discussed the Lefebvre's, Hall's Pond, Otsego Creek, North and South Mississippi and Rice Foster Lake Watershed Districts. The new boundaries for Otsego Creek can be set at the hearing. The Council felt that the most westerly part of Otsego should be left out at this time. Mayor Freske asked about the New Industrial Area and Mr. Koshak said that site is in the Otsego Creek Watershed. CM Heidner asked how much is this utility fee? He also asked about farm land. Mr. Koshak said the average cost is $3 a month. He stated that on page 28, fees would be put on parcels 40 acres or less, a larger farm would be split up into how many 40 acres they have, the homestead should be one property and the farm property on one. CM Heidner stated that the homestead can be the same but has a tough time with the large acreage. Koshak replied that when the policy is passed the Council will have to decide the amounts. CM Fournier asked if the City can set different fees for different areas. Attorney said yes as long as its based on a rational basis and the fees would be a part of the hearing on March 20. The Engineer stated there should be a consensus and suggested a workshop prior to the hearing. CM Black wants to get the policy in place and not give out any number since it won't cost anything right now but the structure is there. CM Fournier stated the Public will want to know what the fee would be. Mayor Freske agreed with this. CM Black pointed out that at the Otsego Creek Hearing accepted the policy without knowing the fees and at the time when money will be spent the Public will be informed. Mayor Freske asked the Council if they need another workshop. Engineer thought that this would only be for discussion of fees. CM Black suggested to wait until the middle or late summer and then the Finance Officer will be on board. Mrs. Woods commented about an exemption for farms that have no tiling. 4. Any other Council Business Elaine Beatty and Council discussed the MRD Plat. The Council would ultimately like to see the surrounding land owners get together for development planning. Also discussed was staff meetings with the developer. Elaine Beatty suggested having David Licht set up a training session with all the commissions. The general feeling of the Council wasinsupport of this session. Mayor Freske directed Elaine Beatty to coordinate this with Carl Swenson. The Council said to tell Mr. Klus that the record is unclear as to what his application is. If he wishes a different drawing to be considered by staff that an amended application should be applied for and that upon receipt, staff will proceed.
