10-27-08 CCITEM 3.2 OTSEGO CITY COUNCIL MEETING OTSEGO ZITY HALL OCTOBER 27, 2008 6:30 PM 1. Mayor Jessica Stockamp will call the meeting to order. Mayor Stockamp called the meeting to order at 6:30 PM. Roll Call: Mayor Jessica Stockamp, Councilmembers: Vern Heidner, Mark Thorsted, Tom Darkenwald and Dan Scharber. Staff: Mike Robertson, City Administrator; Judy Hudson, City Clerk/Zoning Administrator; Andy MacArthur, City Attorney; Ron Wagner, City Engineer; Dan Licht, City Planner; Tim Rochel, Building Official and Kurt Neidermeir, PeopleService. Council Candidates: Dave Thompson and Tony Skaalerud. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 2. Consider agenda approval. CM Thorsted requested to add 11.5 Otsego Festival Potluck Dinner and Administrator Robertson requested to add 12.2 Tax Rate Comparison. CM Heidner motioned adoption of the agenda as amended. Seconded by CM Scharber. All in favor. Motion carried. 3. Consider the following minutes. 3.1. October 13, 2008 Public Hearing Minutes. CM Heidner motioned adoption of the minutes as written. Seconded by CM Scharber. All in -favor. Motion carried.. 3.2. October 13, 2008 City Council Minutes. CM Scharber motioned adoption of the minutes as written. Seconded by CM Heidner. All in favor. Motion carried. 4. Open Forum: (5 minute limit) Mike Leuer, Long Lake, MN, regarding to his 5 acre lot at Kadler Ave and CSAH 39, the home is rented out and the septic is out of compliance. They are willing to pump every month. They are considering developing this lot into senior housing and don't want to install a new septic or hook up to city sewer at this time. He asked for a 12 to 18 month extension. CM Darkenwald asked Ron if pumping once a month is adequate. Ron doesn't know the amount of use and it probably would be difficult to pump during the winter depending on location of tanks. CM Heidner doesn't mind the pumping but has concern if it will be often enough. Dan Licht said they have six months to fix the problem per Ordinance and suggested an agreement between the City and property owner. Tim Roche[, Building Official was present, he said there was sewage ponding on the site at 4 to 5 inches which is not a good situation and he feels there are no tanks but just a cess pool. Chris Bulow, potential developer of senior housing development, he begged for pumping while they are trying to reach a deal. Mr. Rochel suggested having them install a tank with an alarm light. CM Heidner motioned for staff and applicant to work together on this. Seconded by CM Darkenwald. All in favor. Motion carried. 5. Consent Agenda. (Non -controversial items). 5.1. Approve Claims List. 5.2. Received September 9, 2008 Police Commission Minutes. 5.3. - Received September 10; 2008 Park & Rec Commission Minutes. City Council Meeting October 27, 2008. Page 2. 5.4. Approve Pay Estimate #1 to Omanh Brothers, Inc in the amount of $226,499.93 for 2008 Maintenance Project. CM Scharber motioned to approve Consent Agenda. Seconded by CM Darkenwald. All in favor. Motion carried. 6. Unfinished Business. 6.1. Consider requests of Bonestroo Gridor. Andy MacArthur reviewed this request. CM Scharber motioned to release $50,000 of retainage and not release any more until the punch list is completed and Bonestroo is paid. Seconded by CM Thorsted. All in favor. Motion carried. 7. Public Works. 7.1. No Parking on 72nd Street. Ron Wagner made a recommendation as outlined in Resolution 2008-66. Mike Robertson said the Association manager supported no parking signs. CM Scharber motioned to adopt Resolution 2008-66 relating to parking restrictions on 72nd Street NE. Seconded by CM Heidner. All in favor. Motion carried. 7.2. Consider revised 2008-09 Snow Plow Policy. Brad Belair went over his proposed changes to the Snow Plow Policy. CM Scharber motioned adoption of the 2008-09 Snow Plowing Policy. Seconded by CM Thorsted. All in favor. Motion carried. 7.3. Consider Hiring Part-time Seasonal Employees.. Brad Belair went over his recommendation. CM Heidner motioned to accept Brad Belaies recommendations. Seconded by CM Darkenwald. All in favor. Motion carried. 8. Dan Licht, City Planner. 8.1. Red Flag Policy. Dan Licht presented the planners report. CM Heidner motioned to adopt Ordinance 08-20 establishing an identity theft prevention program as required by the fair and accurate credit transactions act of 2003. Seconded by CM Scharber. All in favor. Motion carried. 9. Ron Waaner, Citv Enaineer. 9.1. Discussion on resettina Ouantrelle Ave. Assessment Heanna date. Ron requested to move the hearing date to November 24, 2008. CM Heidner motioned to amend the previous Resolution changing the Public Hearing to 11-24-08 at 6:30 PM. Seconded by CM Scharber. All in favor. Motion carried. 10. Andrew MacArthur, Citv Attornev. 10.1. Review of Personnel Issues. Andy recommended hiring Sherri Le for up to 30 hours to review personnel issues and the pay equity report. CM Heidner moved to approve the recommendation. Seconded by CM Scharber. All in favor. Motion carried. City Council Meeting October 27, 2008. Page 3. 11. Council Items. 11.1. Set Holiday Hours. CM Darkenwald motioned to approve Option's 1, 3 and 4. Seconded by CM Thorsted. All in favor. Motion carried. 11.2. Insurance Renewal. Gary Groen reviewed. CM Scharber would like to see what the City has spent on claims in the past few years. CM Scharber motioned to change the deductable to $5,000 and sewer backup to $25,000. Seconded by CM Darkenwald. All in favor. Motion carried. 11.3. Jim Stockamp Invoice. CM Scharber motioned to approve. Seconded by CM Darkenwald. Mayor Stockamp abstained. Motion carried. 11.4. Wright County ARMER 800Mhz radio project. Mike went over Wright County's letter. Council agreed to wait until next year and review. 11.5. Otsego Festival Potluck Dinner. CM Thorsted said the Otsego Festival committee wants to have a potluck dinner for all the volunteers at the Public Works Building. Council agreed that City Hall would be more appropriate. 12. Mike Robertson, City Administrator. 12.1. Discussion of File Retention Policies. Council agreed to follow the State's recommended retention schedule. 12.2. Comparison of Tax Capacity Figures. Mike reviewed the information. Otsego has the lowest tax rate of all adjacent cities and the second lowest in Wright County. 13. Judy Hudson, City Clerk. 13.1. Local Board Training.
