City staff recommends approval of an ordinance regulating Mobile Food Units.

BACKGROUND/JUSTIFICATION:
The City Council adopted an ordinance providing for regulation of Mobile Food Units (food trucks), which
includes licensing, within the City on 13 June 2022. Based on conversations with mobile food unit
businesses, City staff believes it is necessary to clarify that the license requirement does not apply to City
sponsored events upon City properties. The City through oversight of its events on its properties will
ensure protection of public health, safety, and welfare including proper State licensing and insurance. The
proposed amendment was discussed by the Administrative Subcommittee at their meeting on 10 August
2022 and they recommend approval.

CITY OF OTSEGO
COUNTY OF WRIGHT, MINNESOTA
AN ORDINANCE AMENDING THE CITY CODE REGARDING MOBILE FOOD UNITS.
THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN:
Section 1. Section 4-12-3.B of the City Code is hereby amended to read as follows:
B. Exceptions:. No license shall be required for operation of a mobile food unit either when:
1. Located upon a private property or parked on a public street in accordance with Title 7,
Chapter 2 of this code abutting a private property on which a strictly private event is held.
2. Located upon a city property for a public or private event held by the city.
Section 2. This Ordinance shall become effective immediately upon its passage and publication.
