Traffic signal would be planned for sometime in the future, with underground installed now. 4 0 • I i L ` e b \i) ,)/ Draft DRAFT Draft DRAFT Draft 5 County State Aid Highway 19 Jul June 2006 Albertville, Wright County Background CSAH 19 is a Minor Arterial Highway serving as the major north -south roadway in northeast Wright County -- connecting Otsego, Albertville, St. Michael, and Hanover. The traffic volume on this roadway has steadily grown as this part of the County continues to develop. Counts taken in April 2006 indicate regional influences and higher than expected traffic levels. Congestion levels are currently experienced during peak hours at several intersections. While Wright County is experiencing significant population growth as a whole (31 % from 1990 to 2000; and an additional 19% from 2000 to 2004), it should be noted that northeast Wright County is growing at three times the County growth rate (109% from 1990 to 2000; and an additional 50% from 2000 to 2004). In actual population numbers these four cities make up more than 50% of the total Wright County population growth since 1990. What are challenges? • Traffic volumes are at (full) capacity levels for the current road design. The traffic volume at the St. Michael /Albertville border is 14,600 ADT, near I -94 is 16,500, and at the Albertville/Otsego border is 8,700. • Pedestrian crossings near the outlet mall is a growing concern. While the City of Albertville and Wright County have been addressing these issues to help encourage safety, long - range improvements are recommended to provide continued safe behavior. • The increases in volume are related to many factors including the regional growth. Albertville expects the continued demand for growth along the CSAH 19 corridor in adjacent Cities as well. The current traffic volumes can be seen on the attached map. • Funding the needed improvements is a challenge. The roadway improvements identified to "Th handle traffic include extending the four -lane divided section approximately from the Outlet Mall entrance through the 70' Street intersection into Otsego. Additionally, the traffic growth has indicated a need for improvements southerly to I -94. These costs are estimated to be $372,000 for the work between 1 -94 and the Outlet Mall entrance, $200,000 for widening the Outlet Mall I Entrance, and $2,200,000 for the extension northerly into Otsego. • While it is always an option to do nothing, the cities of Albertville and Otsego are recommending 410. that these improvements be made now to restore the mobility and safety along CSAH 19. The congestion noted this year has begun to affect the mobility of Wright County residents. There is a cost to the "do nothing" option. What is needed? • In order to provide for the pedestrian and bicycle activity, continuation of the off -road trail on the west side and a sidewalk on the east side is proposed. In order to increase the signal capacity and allow more green time for the CSAH 19 traffic, a double left turn lane is proposed at the signal at the Outlet Mall Entrance. This would also require widening the Outlet Mall entrance to the west. • The additional lanes will require revising the signal at the Outlet Mall entrance. • The four -lane divided road section is proposed to extend into Otsego. • Improvements to CSAH 19 are both important and urgent. It is already the highest traveled Wright County highway, and along with being in the highest population growth area of the County, CSAH 19 will likely experience rapid degradation of mobility and safety to this important growing area of the County. Albertville is willing to partner with the County to find a solution. The proposed amendment would clarify the language of this section to restrict issuance of building permits only for undeveloped parcels accessed only by a half street This amendment was initiated following approval of a variance to allow a building permit for a new home to be constructed in place of an existing dwelling on a lot accessed from 62 Street east of Oakwood Avenue, which is a half street. Mr. Keith Knutson spoke in favor of the proposed amendment. The Planning Commission had no comments, closed the public hearing and voted 7-0 to recommend approval of the proposed amendment This proposed amendment will be considered at the City Council meeting on 23 July 2007 at 6:30 PM. c. THE CITY COUNCIL OF THE CITY OF OTSEGO DOES HEREBY ORDAIN: Section 1. Section 21- 7 -7.1 of the Subdivision Ordinance is hereby amended to read as follows: J. Half streets: Half streets shall be prohibited except where it will be practical to require the dedication of the other half when the adjoining property is subdivided, in which case the dedication of a half street may be permitted. The probable time elapsing before dedication of the remainder shall be considered in this decision. All undeveloped lots, outlots or pare having access only from a half street are prohibited from being eligible for building permits except as may be allowed by the Zoning Ordinance. Section 2. CITY COUNCIL MEETING: 23 July 2007 FINDINGS: Based upon review of the application and evidence received, the City Council of the City of Otsego now makes the following findings of fact: A. The legal description of the property is PID 118 - 800233200, Section 23, Range 24, Township 121, City of Otsego, Wright County, Minnesota. B. The subject site is guided by the Comprehensive Plan for future age land uses within the Urban Service Expansion Area W3. C. The subject site is zoned A -2, Agriculture Long Range Urban Service District. Lots with an area less than 20 acres proposed after October 14, 2002 are allowed by conditional use permit subject to Section 20- 52 -5.H of the Zoning Ordinance. D. Consideration of the application is to be based upon (but not limited to) the criteria set forth by Section 20 -4-2.F of the Zoning Ordinance: 1. The proposed action's consistency with the specific policies and provisions of the Otsego Comprehensive Plan. Finding: The Comprehensive Plan guides the site for rural land uses. The proposed rezoning will allow for a one acre single family residential lot, which is consistent with the future land use plan. 2. The proposed use's compatibility with present and future land uses of the area. Finding: Surrounding land uses currently consist of primarily agnculturai-rvrnl service area uses and large lot single family uses. The surrounding area is guided for rural land uses. As such, the proposed use will be compatible with the existing and planned land uses surrounding the subject site. 3. The proposed use's conformity with all performance standards contained in the Zoning Ordinance (i.e., parking, loading, noise, etc.). Finding: The proposed use shall conform to all requirements of the Zoning Ordinance, Subdivision Ordinance and Engineering Manual as a condition of approval. 4. Traffic generation by the proposed use in relation to the capabilities of streets serving the property. 1 Finding: The proposed use is not anticipated to generate traffic that will overwhelm the capabilities of the streets serving the property provided that measures are taken to locate the lot and design the site access in such a way as to comply with access restrictions to Kadler Avenue and allow for logical extension of future local streets. 5. The proposed uses impact upon existing public services and facilities including parks, schools, streets, and utilities and its potential to overburden the City service capacity. Finding: The proposed use is not anticipated to have a negative impact to the City's service capacity. E. The Planning Report dated 17 July 2007 and Planning Report addendum prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. F. The Otsego Planning Commission conducted a public hearing at their regular meeting on 16 July 2007 to consider the application, preceded by published and mailed notice; upon review of the application, and other evidence, the public hearing was dosed a the Planning nd Commission recommended by a 7-0 vote that the City Council approve the request on the findings outlined above. DECISION: Based on the foregoing information and applicable ordinances, the application is hereby APPROVED, subject to the following conditions: 1. The proposed minor subdivision shall comply with all requirements of the Zoning Ordinance and is subject to review and approval by City staff. 2. The one acre parcel shall be deed restricted to prohibit further subdivision unless there is a change in the Comprehensive Plan or the property is rezoned to allow a more intensive use. 3. The 98 acre parcel shaft be deed restricted to not more than seven potential dwe ing units subject to necessary zoning and subdivision approvals unless there is a change in the Comprehensive Plan or the property is rezoned to allow a more intensive use. 4. The applicant shall satisfy applicable park and trail dedication requirements for one new development site in the amount of $3,230 as a condition of approval for the minor subdivision. 5. The applicant shad dedicate a 75 feet of right-of -way easement adjacent to Kadler Avenue as a condition of approval for the minor subdivision. 8. The proposed lot shall be shifted to a location 30 feet off of the south line of the NW % of the SW14 of Section 23 Range 24 Township 121. 7. WHEREAS, a study of the transportation needs of the north east quadrant of Wright County has been previously performed via a report dated June, 2004, which identified that the portion of CSAH 37 addressed in this Agreement has been identified as a candidate for turn back to Albertville and Otsego; and WHEREAS, improvements to Wright County State Aid Highway No. 37 ( "CSAH 37 ") are necessary in conjunction with the development of property in Albertville located on the south right of way line of CSAH 37, east and north of Interstate No. 94, and west of MacGiver/MacKenzie Avenues as shown on the attached Exhibit A (the "Morris Property "); and WHEREAS, the parties contemplate that future improvements will be necessary with the development of property in Otsego located on the north right of way line of CSAH 37, east and north of Interstate No. 94, and west of McGiver/MacKenzie Avenues as shown on the attached Exhibit A (the "Eide Property "); and WHEREAS, a Cooperative Agreement between the County, Albertville, and Otsego outlines the responsibilities and financial commitments related to the development of the Morris and Eide Properties. NOW THEREFORE, IT IS MUTUALLY AGREED AND UNDERSTOOD THAT: 1. Albertville shall, at its expense or at the expense of the owner of the Morris Property, construct or cause to be constructed the road improvements shown on the attached Exhibit B. Such road improvements shall be substantially completed by October 31, 2008. 2. The parties contemplate that at some point after development of the Morris Property commences a traffic control signal ( "Traffic Control Signal ") may be needed at the intersection of CSAH 37 and the 1 proposed Lymon Avenue shown on Exhibit B. Anytime after the issuance of an occupancy permit for any building on the Morris Property, Albertville or Otsego, upon concluding that installation of a Traffic Control Signal at CSAH 37 and Lymon Avenue would be in the best interest of the public, may request that Wright County require the construction of a three -sided Traffic Control Signal in substantially the configuration shown on the attached Exhibit C. In response to such request, or upon its own initiation, Wright County may, in its discretion, require Albertville to install said Traffic Control Signal, in which case Albertville shall install, at its expense or the expense of the owners of the Morris Property, said Traffic Control Signal in accordance with plans and specifications approved by the County Highway Department. 3. Upon construction of the three -sided Traffic Control Signal, Albertville shall be responsible for providing the necessary electrical energy for the operation of the Traffic Control Signals, and any electrical energy for street lights. In addition, Albertville shall be responsible, at its cost and expense, to (1) relamp the Traffic Control Signals; and (2) clean and paint the Traffic Control Signals and cabinets; (3) provide the maintenance on luminaries; and (4) reimburse the County for maintaining the EVP System. (Emitter units may be installed and used only on vehicles responding to an emergency as defined in Minnesota Statues Chapter 169.01, Subdivision 5 and 169.03). In the event said EVP System or components are, in the opinion of the County, being misused or the conditions set forth herein are violated, and such misuse or violations continues after the receipt by Albertville of written notice thereof from the County, the County shall remove the EVP System, at Albertville's expense. 4. The parties contemplate that at some point after development of the Eide Property commences, the fourth side of the Traffic Control Signal (controlling traffic to and from the Eide Property on the north side of CSAH 37) may be needed at the intersection of CSAH 37 and the proposed Lymon Avenue shown on Exhibit B. At the time of platting of the Eide Property or anytime after such platting of the Eide Property, Albertville or Otsego, upon concluding that the installation of the fourth side of a Traffic Control Signal at CSAH 37 and Lymon Avenue would be in the best interest of the public, may request that Wright County require the construction of such fourth side of the Traffic Control Signal. In response to such request, or upon its own initiation, Wright County may, in its discretion, require Otsego to install said fourth side of the Traffic Control Signal, in which case Otsego shall install, at its expense or the expense of the owners of the Eide Property, said fourth 2 side of the Traffic Control Signal in accordance with plans and specifications approved by the County Highway Department, and shall install, at Otsego's expense or the expense of the owners of the Eide Property, any road improvements to CSAH 37 or changes to the Traffic Control Signal which Wright County determines are necessary to allow the Eide Property to access CSAH 37 at the Lymon Avenue intersection. 5. Upon construction of the fourth side of the traffic signal, Otsego and Albertville agree to each be 50% responsible for providing the necessary electrical energy for the operation of the four -sided Traffic Control Signal, and any electrical energy for street lights on CSAH 37 east of Interstate 94 and west of Maclver/MacKenzie Avenue. In addition, Albertville and Otsego shall each be 50% responsible for the cost and expense to (1) relamp the Traffic Control Signals; and (2) clean and paint the Traffic Control Signals and cabinets; (3) provide the maintenance on luminaries; and (4) reimburse the County for maintaining the EVP System. (Emitter units may be installed and used only on vehicles responding to an emergency as defined m Minnesota Statues Chapter 169.01, Subdivision 5 and 169.03). Upon Completion of any portion of the Traffic Control Signal, it shall be the County's responsibility at its cost and expense to (1) maintain the signal controller, (2) determine the appropriate signal timing sequence, (3) provide phone service to the controller for remote servicing, (4) provide for replacement of poles, cabinet etc. if they should be damaged through vehicle collision etc. (major maintenance), (5) provide maintenance for the EVP system which costs would be reimbursed by Albertville and/or Otsego pursuant to the terms of this Agreement. 7. Albertville and Otsego shall each indemnify, save and hold harmless the County and all of its agents and employees of any form against any and all claims, demands, actions or causes of action of whatever nature or character arising out of or by reason of the execution or performance of each party's respective work provided for herein to be performed. The County shall indemnify, save and hold harmless Albertville and Otsego and all of its agents and employees of any form against any and all claims, demands, actions or causes of action of whatever nature or 3 character arising out of or by reason of the execution or performance of the work provided for herein to be performed by the County. Albertville and Otsego shall indemnify, save and hold harmless each other and all of their agents and employees of any form against any and all claims, demands, actions or causes of action of whatever nature or character arising out of or by reason of the execution or performance of each party's respective work provided for herein to be performed. 8. It is further agreed that any and all full -time employees of the County and all other employees of the County engaged in the performance of any work or services required or provided for herein to be performed by the County shall be considered employees of the County only and not of Albertville or Otsego and that any and all claims that may or might arise under Workmen's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said County employees while so engaged on any of the work or services provided or to be rendered herein shall be the sole obligation and responsibility of the County. 9. It is further agreed that any and all full -time employees of Otsego and Albertville and all other employees of the Otsego and Albertville engaged in the performance by any work or services required or provided for herein to be performed by Otsego or Albertville shall be considered employees of their respective cities only and not of the County and that any and all claims that may or might arise under Workmen's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any and all claims made by any third parties as a consequence of any act or omission on the part of said Otsego or Albertville employees while so engaged on any of the work or services provided or to be rendered herein shall be the sole obligation and responsibility of the City employing such employee. 10. In the event that CSAH 37 is turned back to Albertville and Otsego or is otherwise no longer a Wright County highway, the terms of this Agreement shall no longer apply to Wright County. The agreement calls for Albertville to construct a three sided signal and for the additional signal to be constructed by Otsego upon development of the Eide property. It is contemplated that both parties would require the Developer's to pay for their share of the signal as a condition of development approval. The rest of the agreement is a standard County agreement regarding division of responsibility for the signals. Albertville would assume all City responsibilities until the fourth leg of the signal system was constructed at which time City responsibilities would be shared 50- 50 between the cities. The County has added No. 12 to the Agreement stating that they would have no further responsibility under the agreement in the event that CSAH 37 is no longer a County Highway. The form of the Agreement is acceptable. I will be available to further discuss the Agreement at the regularly scheduled City Council meeting on July 23. Dear Council Members: The City has received a request for Consent of Assignment of the current Stonebridge, Inc. lease to Nextera Wireless, LLC. Nextera has entered into an Agreement to purchase the assets of Stonebridge. Assignment of the current lease requires consent of the City through the City Council. The consent portion of the current Stonebridge lease (attached) also states that consent shall not be unreasonably withheld. I have checked with the Finance Department and they have indicated that Stonebridge is current on their lease payments. I have also put in a call to People's Service to see if there are any other problems with Stonebridge's performance. The concern is safety related and it is questionable if OSHA would approve. • A control panel is located in the base of the East Tower that functions with several antennas on the tower these are non city based. Should this control panel be located outside of the tower? Security, access, liability and electric use are issues for both parties which may be better served outside of the structure.
