AGENDA ITEM DETAILS RECOMMENDATION: City staff is recommending the City Council adopt a resolution adopting an assessment for the 2022 Street Renewal Project. ARE YOU SEEKING APPROVAL OF A CONTRACT? IS A PUBLIC HEARING REQUIRED? No Yes, held September 12, 2022 BACKGROUND/JUSTIFICATION: The 2022 Capital Improvement Plan included the 2022 Street Renewal Project, which is a street reconstruction project within the Walesch Estates and O’Day Acres subdivisions. This project was to be financed in part with special assessments to benefitting property owners, with the balance of the project costs financed with funds from the Pavement Management fund. The City hosted an open house on March 10th, which provided a less formal opportunity for property owners to ask questions and learn about the project. On March 14th, in accordance with State Statute §429 the City conducted a hearing on the proposed improvement. On May 9th, the City Council accepted the bids from the competitive bidding process and awarded the construction contract to Minnesota Paving & Materials. The construction work initiated the week of July 5th and has since been completed with the exception of a few punch list items. In accordance with State Statute §429, on August 8th, the City Council set a hearing on the proposed assessment, with the purpose of the hearing to give property owners an opportunity to express concerns with the proposed assessment. Property owners were provided mailed notice at least two weeks before the hearing, and in addition, the City published notice at least two weeks in advance of the hearing in the Star News. During the assessment hearing on September 12th, the City Council shall hear and consider all objections to the proposed assessment, whether presented orally or in writing. City Attorney Kendall has reviewed the attached resolution adopting the assessment and has provided recommendation for approval. BUDGET INFORMATION FUNDING: BUDGETED: Fund 201 – Pavement Management Yes 1 CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO: 2022-70 ADOPTING AN ASSESSMENT WHEREAS, pursuant to proper notice given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the 2022 Street Renewal Project, City Project No. 22-03, which is a street reconstruction improvement within the Walesch Estates and O’Day Acres subdivisions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OTSEGO, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the special assessment levied against it. 2. Such assessment shall be payable in equal annual principal installments, extending over a period of ten years, the first of the installments to be payable on or before the first Monday in January 2023, and shall bear interest at the rate of 4.00% (percent) per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2022. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the Wright County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. An owner may at any time thereafter, pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the Wright County Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other City taxes. 2 ADOPTED by the Otsego City Council this 12th day of September, 2022.
