CSAH 37: Staff reviewed the proposed CSAH 37 Agreement which has been approved by the City of Albertville and Wright County. Wright County's approval is conditioned on both the City of Albertville and Otsego signing the agreement. The Phil Morris Developer will be escrowing funds to install a three legged traffic signal to control traffic. The signal currently does not meet warrants and may not be required for five or ten years. The Phil Morris Developinent will not have enough traffic to trigger the installation of a signal and most likely it will happen when Otsego's property develops. A round -a -bout in lieu of a traffic signal was discussed and dismissed as a viable option. After much discussion, both Cities reach consensus that the proposed agreement is acceptable. Otsego plans on adopting the CSAH 37 Agreement on August 13, 2007. City Administrator Mike Robertson was asked to meet with Otsego property owners to explain the agreement. According to Wright County Highway Engineer Wayne Fingalson this is the highest traveled County Road in Wright County. CSAH 19 in Albertville would be improved to a four lane divided highway with turning lanes at 70 Street NE. Basic work in Otsego would be a transition from the two lanes to a four lane road meeting Wright County's requirements for a safe transition length. Each City would pay for it's respective work in their City. Currently Albertville updating a feasibility report to better identify the scope of the project and related costs. Both Otsego and Albertville Mayors expressed that improving CSAH 19 is a high priority for both cities. City Administrator Kruse explained that he had approached the Wright County Board last fall and they placed CSAH 19 on the County's Five Year Plan, however, did not have any money allocated toward the project. The County Board appointed Commissioners Elmer Eichelberg and Sawatzke to meet with Albertville and Otsego to develop a funding plan. Albertville and Otsego's consensus was reached on the following action. 1) Albertville and Otsego Administrators and Engineers to meet with Wright County Highway Department and share the design and feasibility study with them to make sure the current design and layout is acceptable to them. Further, to garner their support for the need for the project. 2) Set up another Joint Albertville and Otsego City Council Meeting in Albertville to meet with Wright County Commissioners Eichelberg and Pat Sawatzke to seek their funding support for a project in which the Cities would take the lead and the County would fund their share of the project via their regular funding policy. September 24 and 25 were dates suggested. 3) Seek acceptance of a three party agreement outlining the funding commitment of the Albertville, Otsego and Wright County. In conclusion, both Albertville and Otsego's Council support the CSAH 19 project and encourage Wright County financial participation. 70 STREET NE: Staff reviewed the proposed 70 Street NE Agreement, which outlines each City paying 50% of the cost of a shape and pave project estimated at $350,000 to be completed this year. Both Cities acknowledged having funds to pay for the construction. It was the consensus of both councils that this project should proceed. MACIVER AVENUE NE: Staff reviewed the proposed terms of the Maclver Avenue NE Agreement. Both Albertville and Otsego are in agreement, which in essence has Albertville paying for 50% of the street project abutting Albertville less the trail on the east side of the road. 63 STREET NE: Staff reviewed the terms of the proposed 63` Street NE Agreement (formerly old Maclver). After some discussion, both Cities agreed to the terms of the Agreement favoring keeping the street alignment where it is. INDIVIDUAL AGREEMENTS: Both Cities acknowledged having some different priorities on which roads should be done first. Not everyone agreed that the agreements should be combined into one document. After much discussion, it was concluded that all of the different road agreements should be separate, however, some agreements are conditioned on approval of other agreements as follows: 1. The 70 Street NE and CSAH 37 individual agreements should be approved as soon as possible and are conditioned on both being approved together. 2. The CSAH 19, Maclver Avenue NE and 63 Street NE individual Agreements should be approved together, after solidifying Wright County's financial support to complete the CSAH 19 project. BORDER ROAD CLOSING COMMENTS: Both Mayor Klecker and Mayor Fournier stated the meeting was really good and expressly thanked Otsego Council Member Jessica Stockamp for requesting the meeting to clear up any questions between the two cities. OTSEGO CREEK: Albertville asked the status of the Otsego Creek project. Albertville expressed concern about a pending large bill that was said to be coming from Otsego that they new nothing about. After much discussion, it appears there might be some misunderstanding that Albertville would be responsible for initial construction, but rather would be responsible for its future share of future maintenance of Otsego Creek. Both cities staff were directed to work together to try and resolve any questions about Creek funding. Both Council's emphasized the importance of the Otsego Creek representatives to meet at a minimum of once a year and to keep communication open. Perhaps there should be an annual report on Otsego Creek. KADLER AVENUE NE: There was not a whole lot to report as Otsego is in the preliminary stages looking at the interchange. Otsego Council suggested staff forward a few of the concepts being considered to Albertville to keep them informed. CSAH 19 AND CSAH 37 INTERCHANGE PROJECT: City Administrator Kruse reported the I - 94 Implementation Task Force will be meeting this fall to get an update on the project. The proposed plat is includes three buildable lots and two outlots with streets and utilities to be constructed by Shamrock Development. A charter school has been proposed for Lot 1, Block 1 and Outlot A and is being processed as a separate application to be considered by the City Council at their meeting on 24 September 2007. Mr. Jim Stanton of Shamrock Development was present to represent the application. Mr. Stanton stated an objection to the City Engineer's recommendation for a 100 foot right -of -way for Kalland Avenue. Mr. Stanton believes that a three lane roadway as recommended by the City Engineer can be accommodated within an 80 foot right -of- way. Mr. Stanton also noted that Kalland Avenue from the north line of Kittredge Crossings to 70 Street is a 46 foot wide street within an 80 foot right -of -way. There was one question from the public. A Real Estate agent listing an abutting property to the east that is guided for commercial use asked if the proposed rezoning will change the land uses guided by the Comprehensive Plan. City staff responded that the subject site is guided for industrial use and the requested rezoning is consistent with that designation. No changes to the Future Land Use Plan will occur as a result of the current application. The Planning Commission discussed the uses allowed in the 1 -2 District and the right-of- way issue. The Planning Commission encouraged City staff to work with the developer to agree on a right -of -way width and roadway. No other significant issues were identified as part of the discussion. The Planning Commission closed the public hearing and voted 6-0 to recommend approval of the applications as outlined below. The application will be considered by the City Council at their meeting on 10 September 2007 at 6:30 PM. POSSIBLE ACTIONS Decision 1 - Zoning Map Amendment A. Motion to approve a Zoning Map amendment rezoning the subject site from A -1 District to 1 -2 District based on a finding that the action is consistent with the Comprehensive Plan. B. The final plat consists of three outlots intended for future commercial development and dedication of right - of - way for a public street. A preliminary plat and PUD Development Stage Plan for Riverbend South was approved by the City Council on 25 September 2006. The subject site is guided by the Comprehensive Plan for commercial uses and is zoned B -3 District. Final plats are processed in accordance with Section 21 -3 -3 of the Subdivision Ordinance and do not require review and recommendation by the Planning Commission prior to consideration by the City Council. Exhibits: A. Site Location B. Preliminary Plat C. Final Plat D. Grading Plan E. Utility Plan ANALYSIS Preliminary Plat Consistency. The proposed final plat is consistent with the general layout approved with the preliminary plat. Subsequent applications for final plat approval and site and building reviews or other zoning applications will be processed on a site by site basis. The final plat allows for construction of streets and utilities in anticipation of planned commercial developments. Approval of the final plat will also establish right -of -way dedication and access locations to CSAH 37. Outlots. The final plat includes three outlots. Outlot A is a unusable parcel encumbered by a gas line utility easement. We recommend this parcel be combined with Outlot B . Outlots B and C include the developable lots identified on the preliminary plat and remnants at the southeast comer of the subject site. 72 Street. The final plat provides for dedication of right -of -way for 72 Street extending from CSAH 37 to the east plat line abutting Wildflower Meadows. Sidewalks are shown on the west/north side of the street from CSAH 37 to the east plat line and on the east/south side of the street from the north side of the first entrance to the east plat line. The sidewalk on the west/north side of the street should be changed to a bike trail allowing for an extension to Roskaft Park within Wildflower Meadows. The City typically requires construction of public improvements identified on a final plat within one construction season after approval. The developer must identify if a different timeframe for construction is proposed. The construction of 72 Street would provide a needed 2 outlet for residential traffic generated by Wildflower Meadows. Landscaping. No landscaping plan has been submitted with the final plat. Landscaping along 72 Street and of the individual lots will occur in conjunction with construction of the sites within the development. Easements. The final plat does not identify any drainage and utility easements. Existing utility easements crossing Outlot C for trunk sanitary sewer and watermain must be identified on the final plat. Drainage and utility easements must also be established over any wetlands and the 20 foot wetland buffer required by Section 20-16 - 9.E.4.a of the Zoning Ordinance. The grading plan proposes temporary sedimentation basins for addressing stormwater management. The need for temporary drainage and utility easements over these basins or other portions of the outlots is subject to review and approval by the City Engineer. Grading Plan. The applicant has submitted a grading plan for the overall site that will allow for construction of 72 Street. Subsequent grading will be required for development of individual sites within Riverbend South. All grading, drainage and erosion control issues are subject to review and approval by the City Engineer. Utility Plan. The applicant has submitted a utility plan for extension of sanitary sewer and water utilities to serve the development sites shown on the approved site plan. All utility plans are subject to review and approval of the City Engineer. Park and Trail Dedication. No land is proposed to be dedicated to the City for parks and trails as part of the final plat. As such, park and trail dedication requirements are to be satisfied by payment of a cash fee in lieu of land. The current fee for commercial developments is $7,000.00 per acre of land not including the 14,610 square feet of land to be dedicated as right -of -way for CSAH 37 in accordance with Section 21 -7 -18.1 of the Subdivision Ordinance. Based on an area of 16.88 acres not including the right -of -way dedication for CSAH 37, the required cash fee in lieu of land for park dedication is 2 $118,160.00 to be paid at the time the development contract is executed. Construction of the bike trail along the west/north side of 72 Street will be a credit to the park and trail dedication fee. An additional cash fee in lieu of land will be required at such time as the turn back property at CSAH 37/72 Street is final platted as part of the overall project. Development Contract. Prior to the City releasing the final plat for recording, a development contract must be executed to ensure completion of required improvements and provision of necessary fees and securities. The terms and form of the development contract remain subject to review and approval of the City Council. RECOMMENDATION The proposed final plat is consistent with applicable development regulations and the approved preliminary plat. The platting of outlots for future development will allow construction of the street and utilities and will lock in right -of -way widths and access locations to CSAH 37. We recommend approval of the application as outlined below and comments of other City staff. POSSIBLE ACTIONS A. Motion to approve the Riverbend South Final Plat subject to the following conditions: 1. Outlot A shall be combined with Outlot B. 2. The final plat shall be revised to identify the existing utility easement crossing Outlot C. 3. The sidewalk on the west/north side of 72 Street shall be revised to a bike trail consistent with the Engineering Manual design standards. 4. A drainage and utility easement shall be established over the wetland and 20 foot wetland buffer within Outlot C. 5. All easements and the need for temporary drainage and utility easements over all or a portion of outlots identified on the final plat is subject to review and approval by the City Engineer. 6. All grading, drainage, and erosion control plans shall be subject to review and approval of the City Engineer. 7. All utility plans shall be subject to review and approval by the City Engineer. 8. The applicant shall pay at the time the development contract is executed a cash fee in lieu of dedication land for park and trail purposes of 118,160.00 minus the cost of the bike trail along 72 Street. 3 9. The construction plans do not have horizontal curve information labeled. The final plat has center of right -of -way curves less then the 300 foot minimum. The minimum fire hydrant spacing is 300' (150' radius) for commercial and industrial areas. Please depict all hydrants along 72 Street NE and all future hydrants within the parking lots. 2. Clearly depict the construction limits for this project including the CSAH 37 turn lanes. If MnDOT is to construct the turn lanes or these turn lanes are to be constructed in the future please label as such. 3. Include horizontal curve information for 72 Street NE. 4. The firearms and hunting regulations were initially adopted on 24 July 1995 based upon the recommendations of a special advisory committee. These ordinances include a map designating areas of the City as "No Discharge" zones where discharge of firearms for recreation and /or hunting is prohibited. The City Council reviews the No Discharge Map each year to make adjustments to the map boundaries, primarily in response to new urban development. The map is to be published in the official City newspaper before October 1 The City has recently received requests to significantly expand the "No Discharge" boundaries, in part due to a incident at Hoofbeats and Heartbeats near Mason Avenue and CSAH 39 where a horse was injured. For this reason, City staff has included a broader summary of the existing City Code regulations for firearms discharge and hunting together with recommendations for a 2007 No Discharge Map for review by the City Council at their meeting on 10 September 2007. Exhibits: A. Existing No Discharge Zone Map B. Proposed No Discharge Zone Map ANALYSIS Firearm Defined. Section 5-2 -2 of the City Code defines a firearm to include any devise from which one or more projectiles may be ejected. The definition includes guns, bows and other weapons using either an explosive substance, gas or spring mechanism. No Discharge Zone. Section 5-2 -7 of the City Code provides for publication of a map designating areas where no firearms discharge is allowed. A map must be published before October 1 of each year or the prior map remains in effect. The designation of the No Discharge Zone as shown on Exhibit A encompasses areas of the City developed or surrounded by urban residential, commercial and industrial uses. City staff is recommending only the proposed Dara Glen Addition be added to the No Discharge Zone for 2007. Section 5-3 -3 of the City Code allows the discharge of a firearm within the No Discharge Zone only: • By law enforcement or military personnel in the line of duty or persons with permit to carry as allowed by State Statue. • By a person to resist or prevent bodily harm or death to them or others as allowed by State Statute. • For a DNR certified Firearms Safety training program. • Persons authorized by the Wright County Sheriff for the destruction of dangerous animals. • On any range established in accordance with the Otsego Zoning Ordinance. • For the slaughter of farm animals. • Target practice with a bow and arrow using target tips or a BB gun within a building or outdoors at least 200 feet from any building not owned by them or having the owners' written permission in their possession. Persons under 18 years old must have parental supervision. • Special hunting seasons approved by the City Council. • Discharge of blank cartridges for reenactment of military engagements or ceremonies. Outside No Discharge Zone. Section 5 -2-4 of the City Code establishes regulation for the discharge of a firearm outside of the designated No Discharge Zone. These restrictions include: • Exterior target practice using a suitable backstop at least 500 feet from any building unless owned by the shooter or with the owner's permission carried on their person. Suitable backstop is defined by Section 5-2 -2 of the City Code to include natural or man made barriers capable of containing the projectile being discharged. • Hunting with a single projectile or shotgun with fine shot in accordance with Federal and State regulans provided that any discharge occurs at least 500 feet from all building unless owned by the shooter or with the owner's permission carried on their person. • Minors under the age of 14 carrying a firearm must be accompanied by a parent or guardian in accordance with Section 5 -2 -5.0 of the City Code. 2 Based on continued growth of the Northeast Wright County area and the issues raised by the incident involving Hoofbeats and Heartbeats, the City Council may consider the following additional regulations for the discharge of a firearm outside of the No Discharge Zone. • No discharge shall occur within 500 feet of the following roadways: 1. CSAH 39 2. CSAH 37 3. CSAH 19 4. Mason Avenue 5. 80"' Street between CSAH 19 and Marlowe Avenue 6. Marlowe Avenue 7. 83"`' Street between Marlowe Avenue and Mason Avenue • No discharge shall occur within 500 feet of pastured farm animals or animals kept within an open feedlot. • No discharge of a firearm shall occur on parcels less than two (2) acres in area. Exceptions to the existing and proposed restrictions on the discharge of firearms would be the same as allowed within the No Discharge Zone established in Section 5-3 -3 of the City Code, summarized above. An alternative to the additional regulations suggested above would be expansion of the No Discharge Zone to include additional rural areas. The City has also received a least one call from a large acreage landowner opposed to such action. CONCLUSION The City Council will discuss the existing regulations regarding firearms discharge and hunting at their meeting on 10 September 2007. City staff is seeking direction as to any addition regulations that are to be incorporated as part of the City Code, including modifications to the 2007 No Discharge Map. Because of the need to publish the map before October 1 any changes to the 2007 No Discharge Map must be approved at the City Council meeting on 10 September 2007. c. The basic decision that the Council needs to make is to: 1. Provide for no regulation of lawful gambling at the City and allow it to operate under existing State control. 2. Regulate lawful gambling by ordinance, which would provide some revenue to the City and would allow the City to control the market area within statutory restrictions. 3. Ban lawful gambling operations within the City. A decision as to which way the City wants to go on regulation is needed to respond to current inquiries regarding lawful gambling. A decision not to pursue regulation at this time does not preclude the City from regulating by ordinance at a future date. Very ) ew J‘acArthur 7 OURI, MACARTHUR & RUPPE, PLLP ITEM 70_3_ CITY OF OTSEGO COUNTY OF WRIGHT STATE OF MINNESOTA RESOLUTION NO. 2007-58 RESOLUTION ADOPTING ORDINANCE # 2007 -11, WATER, SANITARY SEWER and STORMWATER USE AND BILLING ORDINANCE WHEREAS, the City of Otsego has recently reviewed its regulations pertaining to sewer, water and stormwater utilities ( "Municipal Utilities "); and WHEREAS, the City of Otsego desires to update its code provisions in order to more effectively regulate the use of and billing procedures for its municipal utilities; and WHEREAS, currently Chapter 6, Section 2 and 3 of the Otsego City Code inadequately provides for policies and procedures related to, among other things, billing notices, delinquent billing procedures, special assessment of delinquent accounts and water meters, and WHEREAS, the City desires to provide consistency through out its regulations pertaining to Municipal Utilities. NOW, THEREFORE, the City Council of the City of Otsego, Wright County, Minnesota, hereby orders the adoption and publication of the attached Ordinance # 2007 -11. Motion for adoption of resolution by , seconded by at the meeting of the Otsego City Council on the 10 day of September, 2007. 1 IN FAVOR: OPPOSED: CITY OF OTSEGO Larry Fournier, Mayor Judy Hudson, City Clerk 2 CITY OF OTSEGO WATER, SANITARY SEWER and STORMWATER USE AND BILLING ORDINANCE ORDINANCE NO. 2007-11 THE CITY COUNCIL OF THE CITY OF OTSEGO, WRIGHT COUNTY, MINNESOTA, HEREBY ORDAINS AS FOLLOWS: SECTION 1. PURPOSE. The Otsego City Council has determined that in order to pay for the cost of construction, reconstruction, repair, enlargement, improvement, maintenance, operation, and use of the City of Otsego water, sanitary sewer systems and stormwater systems; the cost of State and Federal regulations; and the principal and interest to become due on obligations issued or to be issued, it is necessary to impose just and equitable charges for the use and availability of the City of Otsego municipal water and sanitary sewer systems pursuant to Minnesota Statutes Chapter 444. SECTION 2. ACCOUNTS. 2.1. Owners or users of any property within those areas where City water, sanitary sewer and/or stormwater service is available may not use a non - municipal system without specific written agreement with the City of Otsego. 2.2. All accounts shall be carried in the name of the property owner who personally, or by his or her authorized agent, applied for such service. The owner shall be liable for services supplied to and consumed by the property, whether he or she is occupying the property or not. The owner shall be liable for services supplied to and consumed by the property even if the property is a rental property. SECTION 3. BILLING. 3.1. Charges shall be billed on one bill as applicable to each account. All charges shall be due upon receipt and considered delinquent immediately after the due date of the current bill. 3.2. All bills shall contain the address and telephone number of the City Utility Department; that information shall be clearly visible and easily readable on all bills. 3.3. Residential, commercial and industrial property bills shall be mailed to the owner on a monthly basis and shall specify the water consumed in accordance with the current fee schedule set by ordinance of the Otsego City Council. SECTION 4. UTILITY RATE SCHEDULE. 4.1. The utility rate schedule for all properties subject to this ordinance shall be adopted annually by ordinance of the City Council. The utility rate schedule shall include, but not be limited to, the items set forth in Chapter 6 -1 -4 of the Otsego City Code. SECTION 5. DELINQUENT ACCOUNTS. 5.1 Penalties. A late payment fee of ten percent (10 %) shall be assessed on the unpaid portion(s) on all accounts with a past due balance. The unpaid portions and late payment penalty shall be due immediately. 5.2 Payment Plan. City Utility Department may authorize an adjustment and/or payment plans for delinquent accounts for total delinquent amounts not exceeding $5,000.00. A request for a payment plan shall be directed to the City Utility Department. The City will only authorize adjustments and/or payment plans on a case -by -case basis based upon the facts and circumstances of each account. The City Utility Department reserves the right to obtain City Council approval before authorization of an adjustment or payment plan is fmalized. 5.2.1 Shut -off for nonpayment. If any bill is not paid by the due date listed on the bill, a shut -off notice will be mailed by first class mail and shall state that if full payment is not made by the date specified in the shut -off notice OR if a mutually agreeable payment plan is not approved by the City Utility Department (pursuant to Paragraph 5.2 herein), water service to the premises will be shut off for nonpayment. 5.2.2 The shut -off notice shall contain the address and telephone number of the City Utility Department in charge of billing; that information shall be clearly visible and easily readable on the shut -off notice. 5.2.3 A disconnection fee and a reconnection fee, as set forth in the City of Otsego fee schedule and duly adopted by ordinance, must be paid in addition to the outstanding delinquent balance before water service will be turned back on. 5.3 Certification for collection with taxes. Unpaid charges on sewer and water accounts shall not be certified to the Wright County Auditor until notice and an opportunity for a hearing have been provided to the owner of the premises involved. The City may certify unpaid charges to Wright County on a quarterly basis beginning on October 1s 2007. After October 1st, 2007, certifications may be made on or about January 2 °d , April 1 July 1st and October 1 of each year. The notice shall be sent by first class mail and shall state that if payment is not made before the date for certification, the entire amount unpaid plus penalties or fees will be certified to the county auditor for collection as other taxes are collected. The notice shall also state that the occupant may, before such certification date, attend or schedule a hearing on the matter to object to certification of unpaid utility charges. There shall be an administrative charge due upon the mailing or electronic transmittal of the notice of the proposed assessment. The administrative charge shall be set forth in the City of Otsego fee schedule which is duly adopted by ordinance. 5.4 The owner of the property shall have the option of paying the balance due on the account until the date the notice of the certification hearing is mailed. After the date the notice of certification hearing is mailed, payments will still be accepted but will include unpaid penalties. 5.5 A hearing shall be held on the matter by the City Council. Property owners with unpaid utility charges shall have the opportunity to object to the certification of unpaid charges to be collected as taxes are collected. If, after the hearing, the City Council fmds the that the amounts claimed as delinquent are actually due and unpaid and that there is no legal reason why the unpaid charges should not be certified for collection with taxes in accordance with this ordinance, the City may certify the unpaid charges to the county auditor for collection as other taxes are collected. 5.6 For each certification sustained, the property owner shall have the following options after the hearing: 5.6.1 To pay the delinquent amount listed on the preliminary roll, but without additional interest after the hearing, within ten days of the hearing date. 5.6.2 To pay the certified delinquent amount after the hearing date, but before the County certification deadline, with interest at the rate set in the adopted rate schedule, accrued beginning on eleventh day following the hearing date through the date of payment. 5.6.3 To pay the certified charges as billed to them by Wright County on their property tax statement with a collection term of one year. 5.6.4. Fifteen days after the hearing, the certified roll, minus any payments, shall be delivered to the Wright County Auditor. SECTION 6. WATER LINE CONNECTIONS. 6.1. Every premises served by a water hookup shall have a separate connection and a separate meter. 6.2. No person, firm, or corporation shall hook up any water connection or meter to the City water line without first obtaining a permit therefore from the City. The initial connection and turn-on operation for any water system connection shall only be performed by a City employee or authorized agent. 6.3. Licensed plumber required. No person, firm, or corporation may hook up or service any water line connected to the City water system unless said person, firm or corporation is a plumber duly licensed under the laws of the State of Minnesota or the ordinances of the City. 6.4. The connection charge imposed by the City for hookup to the municipal water system shall be set by a duly adopted ordinance of the Otsego City Council. 6.5. Residential Equivalent Connections (RECs) will be established for non - residential users. The number of RECs per use will be per the current version of the Metropolitan Council Environmental Services Procedures Manual. 6.6. Each property shall connect to the City of Otsego water, sanitary sewer and stormwater system unless excepted by resolution of the Otsego City Council. SECTION 7. METERS. 7.1. All water consumption shall be measured by a City - provided meter. Meters shall be supplied to customers at a price determined by the City. 7.2. Except for the extinguishment of fires, no person other than an authorized City employee shall use water from the City water system unless the water passes through a meter supplied by or approved by the City. No person not authorized by the City shall connect, disconnect, take apart, or in any manner change or interfere with any such meter or its use. 7.3. Every water meter shall be installed pursuant to City specifications. 7.4. Authorized meter readers and repair personnel shall have free access at reasonable hours of the day to all parts of every building and premises connected with the City water supply system in order to read meters, make inspections and make repairs. Denial of such access may result in water service being shut off. 7.5. The property owner or builder shall pay for the initial water meter(s) installed at each property. After such initial purchase and installation of the water meter(s), the City shall maintain and repair, at its expense, any meter that has become unserviceable through ordinary wear and tear and shall replace the meter if necessary. Where repair or replacement is made necessary by act or neglect of the owner or occupant of the premises, any City expense caused thereby shall be a charge against and collected from the water consumer, and water service may be discontinued until the cause is corrected and the amount charged is paid. 7.6.1. When a consumer complains that a bill for any past water consumption and use is excessive, the City shall have the meter re -read upon the consumer's written request. If the consumer remains dissatisfied, the consumer may, upon written request, have the meter tested. If the test shows an error in the City's favor exceeding five percent (5 %) of water consumed, a new meter shall be installed, and the bill shall be adjusted accordingly. If the test shows an error in the customer's favor exceeding five percent (5 %) of the water consumed, such adjustment shall not extend back more than the last billing period from the date of the written request. The result of any test shall be reported to the owner or consumer in every case. 7.6.2. If the City becomes aware of an error for any past water consumption or billing in the City's favor, the City reserves the right to correct said error and collect unpaid amounts from Owner for water service provided. The City shall provide owner with documentation and an explanation of the error. In the event of an error in the City's favor, the adjustment shall not extend back more than six (6) years from the date of notice of the error and in that event, the City shall provide for a payment plan. 7.7. The City reserves the right to remove and/or replace meters as to size and type when deemed necessary by the City. SECTION 8. SERVICE PIPES; RESPONSIBILITY FOR REPAIRS. 8.1. The service pipe from the water main to the meter and the connections thereto shall be the property of the consumer. The pipe must be protected and maintained by the consumer. In the event the consumer fails to make any necessary repairs to the service connections or pipe within 24 hours after being notified to do so by the City, the City shall disconnect the premises from City water. 8.2. The cost of all repairs and replacement of any plumbing or service pipes between the property and the main city utility line(s) shall be borne entirely by the owner of the property affected, and if such repair or replacement work is performed by the City, the cost of time and material shall be assessed against the owner of the affected property. SECTION 9. CITY LIABILITY 9.1. The City shall not be liable for any damages resulting from stoppage of the supply or flow of water as the result of breaks in any mains, service pipes or fixtures, by reason of the breaking of machinery or stoppage for necessary repair or any other interruption of service. SECTION 10. FIRE HYDRANTS 10.1. No person, except a person authorized by the City, shall be allowed to use any fire hydrant in the City for any purpose whatsoever without first securing a permit from the City. Payment for the water used, except for firefighting, shall be made in accordance with the rate schedule duly adopted by the City Council. SECTION 11. DISCONTINUED SERVICE. 11.1. A property owner desiring to discontinue the use of city water shall notify the City to that effect, who shall have the service at the curb stop box cut off by authorized personnel. No unauthorized person shall cut off the water service. Where City water has been turned off, it will be turned on only when: (1) a fee is paid; and (2) all unpaid fees, usage charges and late payment penalties are paid. In addition, water service may be shut off at any stop box connection whenever: (1) the owner or occupant of the premises served or any person working on any pipes or equipment thereon which are connected with the water system has violated or threatens to violate any of the provisions of this Ordinance; (2) any charge for water, service, meter or any other financial obligation imposed on the present or former owner of occupant of the premises served is unpaid and in default; and (3) fraud or misrepresentation by the owner or occupant of the premises served in connection with any application for service. SECTION 12. PENALTY. 12.1. Violation of a provision of this Ordinance is a misdemeanor and, upon conviction thereof, a person may be punished by a fine of not more than one thousand dollars ($1,000.00), or such other amount set by law, or imprisonment for a term not to exceed ninety (90) days, or such other term set by law, or both, but in either case, the costs of prosecution may be added. Each act of violation and each day on which a violation occurs or continues is a separate violation. The provisions of this Section notwithstanding, no penalty shall be greater than that established by state statute for the same offense. SECTION 13. REPEAL. 13.1. Chapter 6, Sections 2 and 3 of the Otsego City Code (which codified City of Otsego Ordinances #00 -11 (June 26, 2000) and #00 -12 (June 26, 2000)) are hereby repealed in their entirety. 13.2 Any other ordinances or parts of ordinances in conflict with this Ordinance are to the extent of such conflict hereby repealed. SECTION 14. This ordinance becomes effective from and after its passage and publication. The first resolution is to set a hearing for assessment of unpaid utility billings. According to the Finance Department there are over three hundred delinquent billings which will be notified and that may be on the assessment roll if not paid prior to the scheduled assessment hearing. The second resolution establishes an assessment hearing for those properties which have been billed for City mowing of noxious and other weeds and grass in violation of City ordinance, and have not paid for the service. The City staff indicates that the total amount of unpaid bills for mowing is approximately 63 at this time. The third resolution is to establish an assessment hearing for unpaid City administrative fines levied for continuing violation of City ordinances. The exact number of properties affected is unknown at this time. The assessment hearings must be set for October in order to allow for certification of the assessments by November 15 and in order to allow some time for payment prior to certification. All affected property owners will be notified of the hearing and given a chance to pay delinquent charges The City staff is recommending that these hearings be held on a separate date from a regular Council meeting due to the number of persons potentially involved.
