I am requesting that this policy be approved by the Council for immediate implementation. The policy establishes the process for the purchase of goods or services by the City. The purpose of this policy is described in Section I. The policy establishes dollar thresholds for the authority and approval process. All purchases included in the annual budget up to $1,000 require only department head approval. Purchases from $1,000 to $4,999 require department head and city administrator approval. Any purchases of $5,000 or more and all items not included in the annual budget require Council approval before the purchasing process may begin. The policy also describes the approval and payment process for invoices received by the City for goods or services. All original copies of quotations and bids received as part of the purchasing process will be filed with the finance department. The policy is a very necessary first step in documenting the purchasing, approval and payment procedures. CITY OF OTSEGO PURCHASING POLICY Section I. Purpose The purpose of this policy is to establish the procedures for purchases made on behalf of the City of Otsego. This policy applies to employees and commission members only. It does not apply to contracted employees such as engineering, planning or attorneys. This policy has the following objectives: 1. To ensure that purchases comply with all applicable laws; 2. To ensure that taxpayers receive the lowest price and the best value for their tax dollars when the City purchases goods and services; 3. To provide clear and consistent guidelines for authorized City employees /purchasers to follow; 4. To limit the discretion of City officials and thus limit the possibility of fraud or favoritism. Section II. Purchasing Oversight The City Administrator or designee is responsible for the overall purchasing function. Department heads shall be responsible for purchasing items within their respective budgets. All contracts, bonds, and instruments of every kind to which the City is a party shall be signed by the Mayor and/or the City Clerk/Treasurer on behalf of the City and shall be executed in the name of the City. All credit applications must be submitted to and approved by the City Clerk/Treasurer. Section III. Purchasing Levels Department heads shall have the authority to authorize and/or approve purchases up to $1,000 based on appropriations contained in the City's Budget. The City Administrator shall have the authority to authorize and/or approve purchases up to $4,999 based on appropriations contained in the City's Budget. Purchases that are greater than $5,000, or items not appropriated through the annual budget, must be approved by the City Council prior to the commencement of the purchasing process. Section IV. Use of Purchase Orders Purchase orders will be required for all purchases greater than $5,000 and may be issued for lesser amounts if requested by the vendor. Council approval is required for all purchases greater than $5,000 before the purchasing process may begin whether or not the purchase was previously approved as part of the annual budget process. Before presentation of the purchase order to the vendor /contractor, the Department Head, Finance Director, and City Administrator must sign the Purchase Order. The Department Head must specify the source of funding for the purchase and fully complete the Purchase Order; the Finance Director must ensure adequate funding is available from the funding source and the City Administrator must provide assurance that City Council or his/her approval, as applicable, has been obtained for the purchase. These procedures apply to the purchase of supplies, materials, equipment, or the rental thereof, or the construction, alteration, repair, or maintenance of real or personal property. All purchases City of Otsego Purchasing Policy Page Two must be consistent with the approved annual budget. All telephone or verbal quotes must be followed with written confirmation. Section V. Purchasing Procedures Purchases may be made by the following methods: • Regular purchasing procedures • Price agreements • Emergency purchasing • Cooperative purchasing • Establish use of charge accounts 1. Purchases of less than $ 1,000 The purchase may be made in the open market by an authorized purchaser. The authorized purchaser may be any City employee with the approval of the Departmental Supervisor. Authorized purchasers are strongly encouraged to seek quotations from several vendors if the anticipated cost approaches $1,000. All original invoices, packing slips or other documentation should be forwarded to the finance department to begin the payment approval process as soon as possible. 2. Purchases from $1,000 to S4,999 The purchase should be based on a minimum of two (2) written quotations. Quotations may be obtained by telephone or in written form via facsimile, delivery service, or Internet. Quotations must have a specific date and time period for which they are valid. All quotations should be kept on file for a minimum of one (1) year and include the names of vendors providing the quotations, the amounts of the quotations, and each successful quotation signed and dated. Quotation files will be maintained in the finance department. If no quotations or only one quotation is received, the reason for the deviation from standard policy guidelines should be documented in writing and be attached to the invoice to be paid in the finance department. 3. Purchases from $5,000 to $50,000 The proposed purchase must be presented to Council for approval before the commencement of the purchasing process. The purchase may be made either via sealed bids or by obtaining two (2) or more written quotations, without advertising for bids or otherwise complying with the requirements of competitive bidding laws. Quotations may be obtained by telephone or in written form via facsimile, delivery service, or Internet. Quotations must have a specific date and time period for which they are valid. All quotations should be kept on file for a minimum of one (1) year and include the names of City of Otsego Purchasing Policy Page Three vendors providing the quotations, the amount of the quotations, and each successful quotation signed and dated. If quotations are obtained by phone, they must be followed up with a signed quotation to be considered a valid quotation. The quotations must be forwarded to the City Council for selection and approval. This approval shall be accomplished by an agenda write -up submitted for consideration at a regularly scheduled Council meeting. A Purchase Order must be completed. 4. Purchases exceeding $50,000 The proposed purchase must be presented to Council for approval before the commencement of the purchasing process. Purchases or contracts exceeding $50,000 require formal sealed bids solicited by public notice in accordance with Minnesota Statute 471.345, Subd.3. The purchaser shall prepare or cause to be prepared, the specifications, the advertisement to solicit sealed bids, the opening and tabulation of bids, and any necessary investigation of the bids. The City's designated representative shall recommend to the City Council which bid is the lowest, responsible bid. The City Council shall determine the lowest responsible bidder and shall accept such bid. In all cases, the City Council reserves the right to accept or reject any or all of the bids, and waive informalities therein. The City has reasonable discretion in determining the lowest responsible bidder. Not only must a successful bidder submit the lowest bid price and substantially meet the terms and conditions of the specifications, the low bidder must be considered "responsible" and have the capacity to perform the proposed contract. "Responsibility" includes such considerations as the bidders' financial responsibility, integrity, ability, skill, and likelihood of providing faithful and satisfactory performance. There is more latitude in purchasing items of equipment not capable of exact specifications. In making such a purchase, the City Council may exercise reasonable discretion in determining the lowest responsible bidder. The City Council may consider, in addition to the bid price, the quality, suitability, and adaptability of the article for its intended use. 5. Purchasing through Cooperative purchasing agreements (State Bids) In accordance with Minnesota Statutes Section 471.35, Subd. 15, a municipality may contract for the purchase of supplies, materials, or equipment without regard to the competitive bidding requirements in the statutes if the purchase is through a national municipal association's purchasing alliance or cooperative created by a joint powers agreement that purchases items from more than one source on the basis of competitive bids or quotations. Under these programs, several governmental units can enter into an agreement to authorize one party to solicit bids and provide for the purchase at the option of each participating governmental unit. Once the governmental units agree on the specifications of the item, one party may advertise for bids on behalf of all the parties that participate in the agreement. Rather than specify a specific number of items, the advertising participant will advertise for a range of quantities estimated for the entire group. Each participating City of Otsego Purchasing Policy Page Four unit can make the final decision on whether to purchase the items from the successful bidder. The City currently participates in the Cooperative Purchasing Venture (CPV) administered by the Minnesota State Board of Administration. 6. Purchase of professional services The purchase of professional services is exempt from the competitive bidding process described in the uniform contracting and bidding statutes. These services and contractual arrangements include engineering, planning, legal and others and will all be approved by the City Council. Travel All expenditures for travel and training need prior approval by the Department Head. The travel request will then be forwarded to the City Administrator for approval. The City has a separate travel reimbursement policy detailing this process. Invoice Approval All invoices received at the City offices, whether by mail, fax or delivery, shall be forwarded to the finance department. Original receipts, quotations, packing slips and other purchase documentation should also be forwarded to the finance department. In the finance department, invoices will be matched with other supporting documentation and invoices will be reviewed to determine the invoices are mathematically correct. The reviewed invoices will be placed in separate folders in the finance department for review and approval by the department head. Department Heads will be notified of any deficiencies in the documentation accumulated. Department heads shall review all invoices for expenditures of their departments and verify the validity of the charges. Department heads shall sign and appropriately code invoices after ascertaining that the goods or services have been delivered to the City in the quantities listed and that the amounts charged are correct. The packing list or other documentation of receipt should be attached to the signed invoice. Certain invoices are excluded from Department Head review and approval. These include monthly invoices which are allocated to departments based on employee costs or other factors, e.g., health insurance, life insurance, dental insurance, retirement funds, utilities, telephone invoices, refuse removal. However, if unusual or non- recurring charges appear on any of these invoices, Department head approval should be obtained prior to processing. Payments will only be made from the original invoice; payments from statements are not allowed. Employee reimbursements must be submitted on the approved form and must be signed by the employee and the Department Head. All non - mileage reimbursements must have the original receipts attached. City of Otsego Purchasing Policy Page Five Invoice Approval - continued All purchases /payments shall be reviewed and ratified by the City Council at their regular meeting before payments are released. In some instances, payroll and benefit related payments may need to be released prior to approval. Price Agreements Price agreements may be used to acquire items the City frequently purchases in small quantities, i.e. gasoline, propane, and heating fuel. A price agreement is a contract between the City and a vendor. Under it, the vendor agrees to supply all of the City's requirements for the specified commodity during the period of agreement. The price may be fixed or variable, such as a fixed discount from market price. Such price agreements expedite delivery, reduce paperwork, and generally result in lower prices. The estimated annual cost of the price agreement shall be considered in determining the appropriate purchasing procedure. Emergency Purchasing When an emergency occurs that may jeopardize public safety or the health and welfare of employees or citizens, department heads may authorize a necessary emergency purchase. Department head emergency purchases and the reason for the purchase shall be reported in writing to the City Administrator within 24 hours. In an emergency situation, the City Council may dispense with the bidding requirements of state contract law. Before deciding if an emergency exists, the City Council shall consult with the city attorney. Disaster Purchasing The Mayor may declare a local disaster or emergency. The declaration shall not be continuing for a period in excess of three (3) days except by, or with the consent of, the City Council. A disaster may result from fire, flood, tornado, blizzard, destructive winds, or other natural causes, or from sabotage, hostile action, or from hazardous material mishaps or catastrophic measures, or emergencies that are technological in nature. During a declared emergency, the City may enter into contracts and incur obligations necessary to combat the disaster by protecting the health and safety of persons and property, and providing assistance to victims of such disasters. The City may exercise such power as deemed necessary without complying with purchasing procedures prescribed by law pertaining to the performance of public work, entering into rental equipment agreements, purchase of supplies and materials, limitations upon tax levies, and the appropriation and expenditures of public funds, including, but not limited to, publication of resolutions, publication of call for bids, provisions of personnel laws and rules, provisions related to low bids, and requirement for budgets. City of Otsego Purchasing Policy Page Six Use of Charge Accounts The City Clerk - Treasurer shall approve the establishment of charge accounts. The Finance Department shall keep a record of all persons authorized to sign on these accounts. Authorized persons will sign an authorized purchaser form and the city will forward this form to the participating establishments. The City will not be responsible for unauthorized purchases. Date This policy becomes effective upon adoption by the City Council. Minutes for February 13 were approved unanimously. Open Forum The sheriff's office served a warrant on a house off of 85 Stolen property and stolen snowmobiles were recovered. A citizen had a complaint about the slow response by the fire department to a call for service. A car was on fire inside a garage. Elk River was the department that responded. Old Business 1. Mailbox issue - Our previous letter was re-sent but there still has not been a response back. Denise will contact the Elk River post office to try and find out what the issue is or if they are against the idea. 2. Restaurant Tents- Joel has been working on it and will report back at our next meeting. 3. MEADA Meeting - There will be a meeting at Rogers High School on March 26 The focus will be on alcohol and marijuana in conjunction with Prom season. 4. National Night Out- Sandy just recently received information and will report back to the group at a future meeting. The policy establishes a 24 hour workweek as the criteria for participation in City employee benefits on a pro -rated basis. This is a policy that is consistent with benefits offered in other communities. The City currently has two part-time employees that would be affected by this policy change. CITY OF OTSEGO BENEFITS FOR PART -TIME EMPLOYEES The City finds it necessary and beneficial to offer benefits when hiring part-time employees. PROCESS: The Departmental Supervisor must determine the full -time equivalent (FTE) for the requested part-time position. The recommendation will be forwarded to the City Council for their review and approval. The job description shall clearly identify that the position is considered a part-time position with pro -rated benefits. For example, a part-time employee working 28 hours per week is considered a .7FTE. ELIGIBILITY: Part-time employees working less than 24 hours per week shall not be eligible for a pro -rata share of employee benefits. Part-time employees working 24 hours per week or more shall be eligible for a pro -rate share of employee benefits. Seasonal part-time employees will not be eligible. This application is substantially the same as a previous application and submitted by the same proposer and withdrawn on 17 February 2007. The one change in the application is that access to the property to be excavated is to be over PID 118-500- 193200 owned by Independent School District 728. The City of Otsego received a petition for preparation of an Environmental Assessment Worksheet for the previous application submitted by the proposer. The petition was received by the City on 29 January 2007 from the Environmental Quality Board after the agency determined that the City was the responsible govemment unit (RGU) for deciding if an EAW was to be prepared. The City Council at their meeting on 12 February 2007 voted 5-0 to take no action regarding the need for an EAW in response to the petition as the application had been withdrawn. The petition for an EAW to be prepared is kept on file with the City Clerk and the petition remains in effect for no more than one year from the date on which it was filed with the EQB as set forth by Minnesota Rules 4410.1100, Subp. 9. While the petition remains in effect, Minnesota Rules 4410.3100, Subp. 1 and 2 prohibits City approval or beginning of any proposed project for which the nature and location is substantially similar to the project identified in the petition until the City Council takes action upon the petition. The City Council has requested that consideration of the petition to prepare an EAW be considered relative to the current application at their meeting on 23 April 2007 at 6:30 PM. Exhibits: A. School District property concept grading plan (1 Sheet) ANALYSIS Project. The proposer has submitted a narrative dated 10 April 2007 describing the proposed excavation. The summary of the project is 765,000 cubic yards of material to be excavated from approximately 38.5 acres in four phases over three years starting in 2007 and ending in 2009. The proposed phasing plan and project schedule may be affected if an EAW is required to be prepared. The project narrative and submitted plans also describes onsite operations, the grading plan, drainage and erosion control measures, dust control, access, haul routes and trip generation. Included as part of the application is a final grading plan / closure plan showing the site restored to elevations suitable for future low density residential uses guided by the Comprehensive Plan. The elevations for the final grading plan are based on the City's Trunk Sanitary Sewer Collection System Plan. The location and elevation of utilities within the site is dependent upon pattern of adjacent development from which the lines will be extended to serve the subject site and the site plan for a future subdivision. Until the west sanitary sewer service district is expanded to include the subject site, use of the property will continue under A -1 District zoning in accordance with the Interim Land Use Plan established by the Comprehensive Plan. Interim Use Permit. The subject site is zoned A -1, Agricultural Rural Service District. Excavation of more than 50 yards of material for transport off -site is allowed as an interim use in the A -1 District subject to the conditions specified in Section 20- 51 -3.D of the Zoning Ordinance and approval of an interim use permit. The proposer has submitted an application for the necessary interim use permit, but the application was deemed to be incomplete pending submission of additional information. If the City Council determines that preparation of an EAW is to be required for the project, the EAW process must be initiated and processed in accordance with Section 38 of the Zoning Ordinance concurrent with the interim use permit application. Surrounding Land Uses. The area of the subject site is rural in character consisting of farmsteads, rural density single family dwellings (Low Density Residential land uses are defined as by the Comprehensive Plan has having a density of 1.0 du /ac or greater) and agricultural fields. Low density residential neighborhoods within the West Sanitary Sewer Service District are located approximately 1,600 feet to the southwest of the excavation area. More specifically, the subject site is surrounded by the following proposed /existing land uses. The area of the subject site is within Urban Service Expansion Area W2, where City staff estimates sanitary sewer and water utilities may be available within 10 to 15 years. The Elk River School District has purchased the 80 acres immediately west of the subject site and has expressed concern about the compatibility of the proposed grading operation with their planned development the property for an elementary and middle school campus. Development of a school on the adjacent property will require a Zoning Map amendment and other zoning approvals. In meeting with School District officials, City staff has also advised that development of the School District property will likely require preparation of an EAW in accordance with Minnesota Rules 4410.4300 Subp. 14.B and /or Subp. 36 based on the floor area of the proposed buildings and area converted from agricultural to developed urban uses. No application has been received by the City for a Zoning Map amendment or site plans for development of a school facility on this site. Thus no entitlement exists for a school use on the School District property and the City may only consider the property as guided for future low density residential uses by the adopted Future Land Use Plan. Mandatory EAW. Minnesota Rules 4410.4300, Subp. 12 requires preparation of an EAW if an excavation is 40 acres or more to a mean depth of 10 feet. The City Engineer has reviewed the proposed excavation of the subject site (including the access road across the School District property) and determined that the grading is over an area of approximately 38.5 acres. The proposed use does not exceed the threshold for mandatory preparation of an EAW under Minnesota Rules 4410.4300, Subp. 12. 3 Phased or Connected Actions. Minnesota Rules 4410.1000, Subp 4 would require preparation of an EAW for multiple projects or phased projects that when defined to be connected actions exceed the thresholds for mandatory preparation of an EAW set forth by Minnesota Rules 4410.4300, Subp. 12. Minnesota Rules 4410.0200, Subp. 9b defines projects as connected actions if: A. One project would directly induce the other, B. One project is a prerequisite for the other, C. Neither project is justified by itself. The proposer originally submitted a project on 7 September 2006 that would have excavated more than 40 acres to a mean depth greater than 10 feet as determined by the City Engineer. City staff notified the proposer of the need to prepare a mandatory EAW based on the scope of the proposed project in a letter dated 25 September 2006. Revised plans were submitted to the City Engineer on 6 November 2006 for an excavation of the site that would be less than the thresholds established for mandatory preparation of an EAW. This application was withdrawn by the proposer on 17 February 2007. The current application is substantially the same as the one withdrawn previously except that an overland road across property owned by ISD 728 has been provided to access the project at Maclver Avenue and 80 Street. Although it would be possible to excavate more of the site than identified by the current project, the proposed project does not induce this action, excavation of the site to the extent possible is not a prerequisite for the proposed project and the proposed project can be justified without excavation of the site to the extent possible. The School District has independently prepared a conceptual grading plan for their property for potential development of a future elementary school and middle school campus. This conceptual grading plan illustrates that excavation of the subject site does not induce excavation of the School District property, is not a prerequisite for development of the School District property and that development of the School District property is justified and feasible without the proposed excavation of the subject site. The proposed project therefore does not constitute a phased or connected action. A future proposal to expand the current project to an area or depth that the overall excavation exceeds mandatory EAW thresholds established by Minnesota Rules 4410.4300, Subp. 12. would require preparation of an EAW (retroactively) at that time. From a policy standpoint, it may be advantageous to anticipate and plan for excavation the subject site to the extent possible in order to fully claim the gravel resource if a project is to occur. Gravel has been identified as a critical resource locally and regionally needed to support planned urban development which should be excavated prior to permanent urban development being established on the subject site. 4 EAW Petition. A citizen's petition has been submitted to the City on 29 January 2007 requesting that an EAW be prepared for a previous excavation project on the subject site. The previous project was withdrawn but the petition remains in effect for any substantially similar project for a period of one year under Minnesota Rules 4410.1100, Subp. 9. The current application has been submitted within one year of the City receiving the petition and it is necessary for the City to consider requiring preparation of an EAW as requested by the petition in accordance with Minnesota Rules 4410.3100 Subp. 1 prior to granting a permit, approving a project or beginning a project until: A. a petition for an EAW is dismissed. B. a negative declaration on the need for an EIS is issued. C. an EIS is determined adequate; or D. a variance is granted under Minnesota Rules 4410.3100 Subp. 3 to 7. Discretionary EAW. Notwithstanding provisions regarding mandatory EAWs and petitions for EAWs, Minnesota Rules 4410.1000 Subp. 3 allows the City to require preparation of an WAW when it determines that, because of the nature or location of a proposed project, the project may have the potential for significant environmental effects. The City has not in the past required preparation of a discretionary EAW. Criteria. In accordance with Minnesota Rules 4410.1100, Subp. 5, the EQB has determined that the City of Otsego is the RGU for responding to the petition and it is therefore the City Council's decision alone as to whether an EAW is to be required. City staff has reviewed the petition for preparation of an EAW. The information presented raises several potential issues with grading activities generally and/or the specific project. The criteria on whether to require an EAW for the project is set forth by Minnesota Rules 4410.1700, Subp. 7, which is also included as Section 20- 38 -3.D.4 of the Zoning Ordinance: A. type, extent, and reversibility of environmental effects; B. cumulative potential effects of related or anticipated future projects; C. the extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority; and D. the extent to which environmental effects can be anticipated and controlled as a result of other available environmental studies undertaken by public agencies or the project proposer, including other EISs. 5 The Zoning Ordinance establishes comprehensive regulations for land excavation in Section 24, which together with regulations on land use within Shoreland Overlay District in Section 92 and general regulations in Section 16 regarding erosion and drainage, noise, dust and particulate matter and odors, will address any potential environmental effects related to the proposed use under criteria "C" above. With respect to criteria "D" above, EAWs were required to be prepared as part of the Arbor Creek, Martin Farms and Zimmer Farms developments within the west sewer district in close proximity to the subject site and AUARs prepared for the Great River Centre (SuperTarget) and Gateway North Industrial Park (Duke Realty, LP) /Queens Avenue project due in part to the amount of material graded on these respective sites for development and address mitigation of potential environmental effects from grading activities. The same mitigation strategies described by the other EAWs and AUARs approved within the City are required by existing City ordinances and would be implemented for the proposed project with or without preparation of an EAW. Controlling the potential for significant environmental effects is based on requiring compliance with established City Codes, Zoning Ordinance and Engineering Manual regulations or implementation of measures common to grading activities, such as application of dust control. There are two potential benefits to requiring preparation of an EAW. Based on the initial application by the proposer, it is known that there is the potential to excavate material from the site beyond that illustrated on the current plans. In terms of fully utilizing available resources, it would be in the City and region's interest to encourage the gravel and sand to be removed from the site to the extent possible prior to future urban development. A second reason for requiring an EAW to be prepared would be to further document compliance with performance standards applicable to the project by State and local regulations. City staffs analysis of the application that was withdrawn on 17 February 2007 was that the use complied with regulations or could be conditioned to comply with regulations established by the Zoning Ordinance and Engineering Manual. The EAW is prepared by the developer, approved by City staff for distribution and subject to review by a number of govemment agencies and jurisdictions with opportunity to comment on potential concerns. Given the City's experience with other environmental reviews for larger grading operations than the proposed project, no significant issues are anticipated but the EAW process would confirm that. RECOMMENDATION The project as proposed does not require mandatory preparation of an EAW in accordance with Minnesota Rules 4410.4300, Subp. 12. Furthermore, City staff is of the opinion that preparation of an EAW in response to the petition received by the City would not likely yield additional information effecting the decision of the Planning Commission and City Council on the pending interim use permit application. If the City Council determines that an EAW for the project must be prepared based on the need to document compliance with regulations addressing issues raised in the petition, we recommend that the EAW address excavation of the site to the greatest extent necessary to reclaim all of the gravel and sand material to fully utilize the available resource in support of local and regional urbanization. 6 POSSIBLE ACTIONS A. The site is located on the NE corner of the intersection of Mason Avenue NE and 83 Street NE. The total area to be excavated is approximately 39 acres with approximately 765,000 cubic yards of material exported. The excavated soils will help provide an economical source of material for future city and private projects. The goal is to have the project completed in 3 years (fall of 2009). When the mining operation is completed, the site will be returned to farmland with option of future development. Plan of Operation The proposed mining operation consists of 4 phases, Phase 1 — 2007, Phase 2 & 3 — 2008 and Phase 4 in 2009.Phaze- 1 has 207,000 cubic yards,phase -2 has 91,000 cubic yards,phase -3 has 183,000 cubic yards and phase -4 has 279,000 cubic yards. The mining project will be in operation April — February from 7:00 am to 5:00 pm Monday thru Friday. Saturdays may be worked with prior permission from the city. Each phase consists of 10 +/- acres. It is proposed that the topsoil will be stripped from the phase area and stockpiled in a future phase. Once topsoil has been stripped, mining and export operations would begin. When the export materials in the phase have been exhausted, the phase will be finish graded, topsoil re- spread and seeded. Erosion control blankets with seed will be placed on steep slopes. Once the phase has been restored, the operation will move to the next phase and the process will begin again. It is proposed that the contractor and city have weekly meetings to discuss any issues that may arise. The access for the site will be on 83 Street NE. There will be a parking lot and staging area on the southern side of the site. The site will be gated to prevent unauthorized access. For safety precautions if the proposed school is opened before the completion date of the project, trucks will not haul out of the site during the arrival and departure of students. Haul routes, traffic control and Loads Hauled The travel routes proposed are the following: Leave the site on the west side of the property using the temporary haul road to get to Maciver ave . Travel south on Maciver Ave to county 37 , go east on county 37 to get to Hwy 101. Travel south on Maciver Ave to 70 th street NE, travel west on 70 street to get to county 19. The materials will be hauled off site in belly dump trailers, side dump trailers and tri axle or quad axle dump trucks. The contractor will provide signage along haul routes leaving the site. Erosion control Silt fence will be installed around the site to protect the adjacent properties in areas where runoff could occur. Silt fence will also be placed around the storm water basins to minimize sedimentation. Topsoil stockpiles will be seeded immediately after placement. As stated above, all steep slopes will receive erosion control blankets with seed. A rock construction entrance will be placed on the access road. Ditch checks will be installed in areas of concentrated flows. Dust control and wind erosion control The interior roads will be sprayed with calcium chloride. There will be a water truck on site to control additional dust. The contractor will purchase water from the city for dust control and wind erosion control. Municipal water be purchased from the City of Otsego for use in the water truck. The project will be performed in separate phases. Each phase will be restored before moving to the next phase. Drainage control With the excavating being started from the south going north in phases, the first 2 phases, storm water will be directed to the storm water basin on the south east portion of the property. In the following phases, storm water will directed to the storm water basin on the north east portion of the property. Street sweeping and spill clean up The rock construction entrance will minimize tracking onto the haul roads. However, there are situations, especially after a rain, when the rock entrance is not enough. In these situations, a road sweeper will be available on site to keep the roads clean. If there is a spill on the roadway, the pit personnel will take responsibility for the clean up. Proposed land use After our completion of our excavation, the site will be restored back to farm land. The legal description of the subject site is PID118- 500 - 193100, 118 - 500 - 192300,118- 500 - 192400 and 118 - 500 - 193200. B. The City has received an application for an interim use permit (IUP) to allow for excavation for transport of more than 50 cubic yards of material from the subject site. C. A petition requesting preparation of an EAW for the proposed CUP has been received by the City on 29 January 2007 and remains in effect for one year from that date. D. In accordance with Minnesota Rules 4410.0500, the Environmental Quality Board has designated the City as the Responsible Govemment Unit for determining if an EAW is to be prepared. E. Minnesota Rules 4410.1700 and Section 20- 38 -3.D.4 of the Zoning Ordinance require the City Council to consider the need for an EAW on whether a project has the potential for significant environmental effects based on (but not limited to) consideration of the following factors: a. Type, extent and reversibility of environmental effects. b. Cumulative potential effects of related or anticipated future projects. c. The extent to which the environmental effects are subject to mitigation by ongoing public regulatory authority. d. The extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies or the project proposer, or of EISs previously prepared on similar projects. F. The Memorandum dated 18 April 2007 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. F. The Memorandum dated 18 April 2007 prepared by the City Planner, Northwest Associated Consultants, Inc., is incorporated herein. DECISION: Based on the foregoing information and applicable ordinances and criteria, preparation of an EAW IS NOT TO BE REQUIRED based on the following findings: 1. The proposed excavation does not exceed thresholds established by Minnesota Rules 4410. 4300, Subp. 12.b for a mandatory EAW 2. Mr. Shane Chatleain of Rottlund Homes was present to answer questions from the Planning Commission. Prior to the meeting, Rottlund Homes had clarified that the revised building plans would apply to eight of the 16 townhouse buildings approved on the Wildflower Meadow preliminary plat. The revised units include the four lots final platted and four additional lots to be final platted with future phases. The location of all eight of the revised is consistent with the concept of providing an improved transition between the park, single family lots and eight remaining larger scale buildings previous approved as described by City staff in the review memorandum to the Planning Commission. The revised building design decreases the number of townhouses within the Wildflower Meadows development by 32 dwelling units for a total of 138 dwelling units. The Planning Commission was very favorable to the revised townhouse buildings concurring with City staff that the proposed changes will provide an improved transition within the development between land use types, will provide greater variety of dwelling unit types within the development and that the revised design is aesthetically pleasing. The Planning Commission voted 5-0 to recommend approval of the revised townhouse building for the eight lots presented subject to the conditions outlined below. The City Council will consider the revised building plans at their meeting on 23 April 2007 at 6:30 PM. POSSIBLE ACTIONS A. Motion to approve building plans for eight Tots within Wildflower Meadows as shown on the submitted plans, subject to the following conditions: 1. The Planning Commission directed that the changes to the facade facing CSAH 42 be shown on revised plans prior to the City Council consideration of the issue. The Planning Commission discussed the changes to the auto repair/tire building more extensively. The Planning Commission was generally positive to the changes which include more use of brick on the most visible portions of the building facing CSAH 42 and use of consistent building materials for the car wash portion of the building. The Planning Commission also directed that the windows on the east facade of the building be revised such that the mullions are centered below the EIFS material on the top half of the building. The City Council will consider the revised building plans at their meeting on 23 April 2007 at 6:30 PM. The Agreement is part of the Master Development Agreement between the City and Duke relevant to the 109 acre Industrial Park. The Agreement is patterned after the City's prior agreement with Apex. The agreement requires the City to rebate 30% of actual taxes paid by Duke up to $380,000.00. The rebate is dependent upon the City actually receiving the tax payment. The Agreement must be approved by both the City Council and the EDA so we have scheduled an EDA meeting at the end of the City Council meeting. My recommendation is that the City Council and EDA both approve the agreement, subject to final review by Mary Ippel of Briggs and Morgan, the City's bond counsel.
