10-10-22 City Council Meeting MinutesOTSEGO CITY COUNCIL MEETING MONDAY, October 10, 2022, 2022 7:00 PM OTSEGO PRAIRIE CENTER Call to Order. Mayor Stockamp called the meeting to order at 71.00 PM. Roll Call: Mayor Jessica Stockamp; Council members: Tom Darkenwald, Tina Goede, Brittany Moores, and Jeff Dahl. City Staff% City Administrator/Finance Director Adam Flaherty, Human Resources/Assistant City Administrator Sabrina Hille; City Engineer Ron Wagner; City Planner Daniel Licht; City Attorney Dave Kendall; and City Clerk Audra Etzel. Pledge of Allegiance: Mayor Stockamp led in the Pledge of Allegiance. 1. Open Forum: Mayor Stockamp opened the Open Forum at 7:01 PM. Jan Hooker, 9360 Kaeding Circle NE and Patricia Sipe, 9366 Kaeding Circle NE, both live in Riverwood National on lots 8 & 9. Ms. Hooker said her house was built in 2016. In 2017 Ms. Hooker had a contractor come in an install drain tile and in 2019 she hired a contractor for decking. It was identified that there were significant drainage issues causing damage to her property. In 2021 the City Engineer was on site and made recommendations. Ms. Sipe said her house was built in 2017 and they purchased in 2019, she also has damage to her house due to water drainage issues. Mayor Stockamp said she has spoken with Ms. Hooker regarding the issues. Ms. Hooker said the contractor in 2017 noted the issue was the water run-off. Ms. Sipe said she has a foot and a half of water in each corner of her house. City Engineer Wagner said all the homes have walkouts and sump pump with sand for foundation. The water is discharged into the swale and can cause the ground to be wet. The swale was not intended to handle this high level of discharges. In 2018 the design and installation standards were changed to include drain tile on properties with clay soil. Ms. Hooker asked why it was not implemented prior? City Engineer Wagner said this was added as the concerns grew. The sprinkler system is owned by the home owner's association. City Engineer Wagner noted this development was approved in 2004 which is when the swale and holding ponds were designed. Ms. Sipe said everyone in the neighborhood has had drainage issues. CM Goede asked if the two neighbors to the north have had any issues. Ms. Hooker said those home owners did not join in on the drain tile installation and costs. City Attorney Kendall said it sounds like they have looked at all the possible options and suggests contacting the builder again to see if they can help with the warranty. Ms. Hooker asked what is done today when a building permit is pulled? Mayor Stockamp said in the building file, the staff and builder review the elevations with the what is planned. Ms. Sipe said they were the last two building permits pulled in the development and the issue was known. City Engineer Wagner said at the time those permits were pulled it was unknown how much discharge the sump pumps would discharge into the swale. City Planner Licht noted there are unknowns with the irrigation system, and irrigation systems often have the largest discharge. CM Dahl asked if this issue has been addressed with their home owner's association and its members? Ms. Hooker said they have only discussed informally as the home owner's association meets annually. September 26, 2022 Special Meeting. 33 Approve City Council Special Compensation for September 2022. 3 4 Approve the Hiring for the Seasonal Utility Maintenance Position. 3.5 Approve the Purchase of a Fleet Vehicle. 3,6 Approve a CUP Amendment — Wright County Highway Department Facility. 3 7 improve a PUD-CUP and Adopt Resolution 2022-76 Approving a SIPA — NCS Office/Warehouse. 3,8 Approve Pay Application #20 for the West WWTF Improvements Phase 1 Project. 19 Approve the Hiring for the Mechanic Position. 3210 Approve the Proposal for Special Inspection and Testing Services — Braun Intertec Corporation. 3.11 Approve Professional Services Agreement for Storm Water Modeling — AE2S. 112 Adopt Resolution 2022-77 Appointing Election Judges for the 2022 Elections. 113 Adopt Resolution 2022-78 Approving the Assessment Roll for Delinquent Utility Bills. CM Moores motioned to approve the consent agenda as written, seconded by CM Dahl. All in favor. Motion carried 5-0. 4. Public Hearing: 4 1 Proposed Assessment Roll .— Unpaid Special Charges. A. Presentation of Proposed Assessment Roll. B. Public Hearing. Ce Consider Resolution 2022-79 Approving Assessment Roll for Unpaid Special Charges City Administrator/Finance Director Flaherty explained the unpaid special charges, noting residents were given the required notice and time to dispute the charges. An assessment roll exhibit along with a resolution have been prepared for consideration. Staff recommends the City Council approve a resolution adopting the assessment roll. CM Darkenwald asked if these have been carried over the past years? Staff noted these special charges have accumulated since the asassessment. CM Moores asked if all property owners have been notified. Staff has sent and published the required notices. Mayor Stockamp opened the Public Hearing at 7:34 PM. No one from the public spoke. Mayor Stockamp closed the Public Hearing at 7:35 PM. CM Dahl. asked if these are related to the City Code violations? City Planner Licht said yes, these assessments for violations of City Code. CM Darkenwald motioned to adopt Resolution 2022-79 approving the assessment roll for unpaid special charges, seconded by CM Goede. All in favor. Motion carried 5-0. B Consider Approval of a Preliminary Plan, Final Plan and PUD Development Stage Plan. CoConsider Adoption of Resolution 2022-80 Approving a Development Contract. City Planner Licht presented the staff report. The representative from Due North Car Wash was present and had no additional comment. CM Dahl asked if there was a drought, what happens with the three carwashes operating within the City? City Planner Licht said if there was a drought the City Code would need to be reviewed, adding that the applicants would have paid an access charge, so a restriction would be applied to all water users within the City of Otsego, not to a specific user group. City Engineer Wagner noted that carwash water use is small compared to irrigation use within the City. CM Darkenwald noted they have paid for the RECs and the water will be recycled. CM Dahl also had questions about the temporary driveway. City Planner Licht noted the south side could be altered. CM Darkenwald asked if the holding ponds could be combined? City Engineer Wagner said the MPCA requires an infiltration ponds that discharge to the regular pond. CM Goede asked about the signage allowances and application for signs that face TH101. City Planner Licht said there was an allowance for up to two signs on TH101, one of those signs have already been approved; the tenants would need to apply for a sign permit. CM Darkenwald motioned to approve the Great River Centre of Otsego Seventh Addition preliminary and final plat and PUD Development Stage Plan for Due North Car Wash subject to the conditions stated in the findings of fact and decision as presented; and adopt Resolution 2022=80 approving a Development Contract, seconded by CM Goede. All in favor. Motion carried 570. 6. C� Council Reports and Updates: CM Moores said the pumpkin patch event this past weekend was well attended, with 1,307 people. StafF did a great job. Mayor Stockamp agreed the event went over well; there was lots of positive comments. CM Dahl asked about new construction permits and sod requirements. It appears new houses near his home have not fully sodding their yards. Additionally, the driveways do not appear to be completed. City Planner Licht said an escrow is collected for both the sod and driveway. Also, sod is required in the front yard and established seed in the backyard. The width of the driveway is called out in the specifications. Mayor Stockamp said there is a special meeting tomorrow. 7. Staff Reports and Updates. Human Resources/Assistant City Administrator Hille said Jake started in Utility Billing position and Matt started in the Mechanic position. There had been fourteen applications received for the Parks Maintenance II position. City Clerk Etzel said absentee voting is available through the mail or at City Hall. Page 3 of 4 MINUTES OF THE CITY OF OTSEGO REGULAR CITY COUNCIL MEETING OCTOBER 10, 2022 Sergeant Jason Oltmanns with the Wright County Sheriffs Department said the NorthStar Regional Treatment call volumes have increased due to more clients on -site and their partnership is going well. Most of the calls received from the location are medical related, with less frequent calls related to escort requests. CM Darkenwald asked about the call volume compared to the previous use. Sergeant Oltmanns said the previous use had daily calls; the treatment facility has implemented significant improvements. CM Goede asked if the black vehicle causing issues has been located? Sergeant Oltmanns said the vehicle has not been located at this time. 8. Adjournment. CM Darkenwald motioned to adjourn at 8:04 PM, seconded by CM Goede. All in favor. Motion carried 5-0. ATTEST.
