Dr. Ron Bratlie of ISD 728 and Mr. Jay Pomeroy of AJA Associates were present to represent the application. Dr. Bratlie stated that if the School District is successful in having a referendum approved this fall to finance one or both of the schools, the project would take 14 to 16 months to construct and could potentially be opened in the fall of 2009. There were approximately 10 people in the audience. The only question from the public was from Mrs. Beatrice Bastyr regarding the noticing procedure for the public hearing. Mrs. Bastyr said that their property is within 330 feet of the subject site and that they did not receive a notice. City staff stated that the City Council directed that sketch plan reviews be considered as part of a public hearing and that the standard procedure for noticing the public hearing was followed but that failure of a property owner to receive a notice does not invalidate the hearing. City staff later confirmed that the Bastyr's property is approximately 640 feet from the subject site and is outside of the 500 foot distance for notification. The Planning Commission discussed the timing for construction of the site and the facilities to be developed. Dr. Bratlie said that the ultimate capacity for the two schools would be approximately 1,000 students for the elementary school and 1,500 students for the middle school, which is reflected on the site plan. There was also discussion regarding the employment of low impact development techniques for the site to minimize impervious surface and stormwater run off. The Planning Commission closed the public hearing and voted 7-0 to recommend approval of the sketch plan subject to the conditions outlined by City staff. The City Council will consider the sketch plan at their meeting on 11 June 2007 at 6:30 PM. POSSIBLE ACTIONS A. Motion to approve a sketch plan for an elementary school/middle school campus subject to the following conditions: 1. Approval of the sketch plan does not convey any entitlement to development of the proposed use. The following applications must be submitted to formally consider entitlements to development of the proposed uses illustrated on the sketch plan: a. Environmental Assessment Worksheet. b. Urban Service Staging Plan Amendment. c. Future Land Use Plan Amendment. d. Zoning Map Amendment. e. Site and Building Plan Review. f. Preliminary and Final Plat. 2. The School District shall prepare a study estimating traffic generated by the proposed uses, the capacity of existing City streets serving the subject site and street improvements necessary to accommodate the proposed development. 3. The preliminary/final plat shall provide for dedication of right -of -way for Maciver Avenue, 85 Parkway, Marlowe Avenue and 80 Street in accordance with the Transportation Plan and Subdivision Ordinance requirements. 4. Development of the subject site shall require acquisition of right -of -way for the west half of Maciver Avenue as recommended by the City Engineer to accommodate traffic generated by the proposed use. 5. Accesses to Maciver Avenue and 85 Street shall be a minimum of 1,000 feet from an intersection with a collector street, 500 feet from any other access or otherwise limited to right- in/right -out only. 6. Plans for Maciver Avenue shall include extension of the trail along the east side of the right -of -way and the site plan shall provide for internal trails to facilitate pedestrian access to the site. 7. Off street vehicle circulation and parking areas shall be designed in accordance with Section 20- 21-4.H of the Zoning Ordinance, the number of parking stalls provided shall comply with Section 20 -21 -9 of the Zoning Ordinance and off - street loading areas shall comply with Section 20-22 of the Zoning Ordinance. 8. The exterior building materials shall conform to Section 20- 17 -4.B.1 of the Zoning Ordinance. 2 9. The proposed buildings are limited to a height of three stories or 40 feet unless additional height is approved by conditional use permit in accordance with Section 20- 17 -3.B of the Zoning Ordinance. 10. A landscape plan detailing the type, size, quantities and location of proposed plantings and compliance with Section 20 -16-7 of the Zoning Ordinance shall be submitted. 11. A lighting plan detailing the type, location, height and illumination field of all exterior light fixtures compliant with Section 20 -16-10 of the Zoning Ordinance shall be submitted. 12. Development of the outdoor play equipment and playfields is subject to execution of a formal agreement between the School District and City for their shared use, subject to review by the Parks and Recreation Commission and approval of the City Council. 13. Extension of sanitary sewer and water utilities to serve the subject site shall be a school district expense in addition to payment of SAC and WAC fees and all utility issues are subject to review and approval by the City Engineer. 14. All grading, drainage and erosion control issues are subject to review and approval by the City Engineer. 15. And has presented such plans and specifications to the council for approval; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF OTSEGO MINNESOTA: 1. Such plans and specifications, dated June 6, 2007, a copy of which is attached hereto and made a part hereof, are hereby approved. 2. The city clerk shall prepare and cause to be inserted in the official paper and in the Construction Bulletin, an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall specify the work to be done, shall state that bids will be opened at 10:00 a.m. on July 3, 2007, in the council chambers of the city hall, 8899 Nashua Avenue, Otsego, Minnesota, 55330. DMM 703.1.4.1 lists examples of organizations that are ineligible for the Nonprofit Standard Mail rates even though they may be organized on a nonprofit basis. This section further states: "...In general, state, county, or municipal govemment organizations are not eligible for the nonprofit standard rates; however, a separate and distinct state, county, or municipal government organization which meets the criteria for any one of the specific categories in section 703.1.2 may be eligible, notwithstanding its governmental status." For example, school districts and public libraries may be eligible under DMM 703.1.2.4 (educational). Nevertheless, governmental organizations are normally not eligible under DMM 703.1.2.6 (philanthropic), since their income is generally not derived primarily from voluntary contributions or donations. Because it is a government organization, we must conclude that City of Ostego, Minnesota is not eligible to mail at Nonprofit Standard Mail Rates as a philanthropic organization, nor does it qualify under any other category. Therefore, the application is denied. This denial does not prohibit you from mailing at the regular Standard Mail rates of postage. If you disagree with the determination, you may appeal within 15 days of the receipt of this letter. Your appeal should include information and evidence to support that your organization is eligible to mail at the Nonprofit Standard Mail rates. MacAuthur Attorney for the City of Otsego RE: 62th Street Dear Mr. MacArthur, The agreement you proposed in your May 22, 2007 draft to us is totally unacceptable to us. As we have stated in our letter to you and the City council on May 27, 2007 we outlined 4 options. These options are on page 2 that are plain to see and understand. The City of Otsego and your quest to dominate all aspects of this agreement is just another way in which you and the city of Otsego have tried to intimidate and harass my parents and myself. We respectfully decline any more meetings with you. As it is just more wasted taxpayer's money to perform nothing. You and the City have proven to be untrustworthy in keeping any agreement that has been adopted from the beginning. In 1998 the City of Otsego adopted a permanent easement for roadway purposes from Bland owners along what is 62 street. Along with an easement for a 16.5 ft snow storage area. This 16.5 ft snow storage area was never adopted to be a roadway or to have a road migrate into it. In your draft agreement the city and you have again underhandedly tried to force the Zachman's to think that there is some sort of expanded roadway that was out along 62 street and to "Seal the Deal " in a very short time line. Mr.MacArthur, we gave you and the city 4 options in our last letter. We feel that these are options that will take care of all the concerns in attempting to resolve this issue for both parties without any legal underhandedness. We will entertain a proposal that is fair and beneficial to both parties. Thank you, Zachman Trust ITEM 13_1 MEMO Date: June 11, 2007 To: City Council and City Staff From: Karee RE: Otsego Clean Up Month Once again it was a very successful month for clean up. We handed out 466 vouchers and 324 vouchers were actually used. The amount came to $9,436.31, although I am checking a couple of things which we might have been overcharged. A few of the residents made comments about the clean up, which I would like to share with you. "This was the best idea the city came up with having a whole month." "It should be advertised better, I didn't even know about it until I saw my neighbor and he told me, but then it was too late." "Could you extend the hours to the landfill, you know some people work and can't get to things like you can." "Could we have one in the Spring and one in the Fall." And the last one. "Could you send a voucher to my neighbor because they really need to clean their yard." The positive out weighs the negative and we will leave it as that. Thank you to everyone who helped out this year; it takes team work to move smoothly. Looking forward to Otsego Clean Up 2008.
